  1. Hi chaps, a bit of advice please. Earlier this year I attended a military vehcile event, and quite frankly, the toilets were poo! The toilets were the subject of a debate on a military vehcile forum I go on and I wrote a letter of complaint to the show organiser, to which I recieved a reply. I started a new thread on the forum showing my letter to the show organisers and thier reply to me. However, the forums owner deleted the thread saying that unless the sender of the reply gave permission, the letter cannot be published on the forum due to 'legal' issues. So my question to you; can I publish a letter sent to me without the senders permission? cheers.
  2. I know you can insure a car with just the chassis number, and was under the impression that you can go to a pre booked MOT with just the chassis number. I have done this in the past.
  3. I know it does'nt help, but my experience of car warranties is they are not worth the paper they are written on! You are better off telling the dealer to forget the warranty and ask for some money off the car. If your spending alot on a car, an inspection is a MUST.
  4. I listed everything in my flat and sold it to my sister for £500(I think). Made a list of EVERYTHING and my sister signed the reciept. IF bailiffs ever managed to get in my flat, show them the reciept and end of bailiff trying to take my stuff.

  6. TBH I never take any notice of a stamped service book, loads of fake stamps on the market. The best thing to do is phone the dealer, I bought a mercedes van and the book was'nt stamped but the independent dealer said it had been serviced by mercedes from new, a quick call to the dealer with the reg and the dealer confirmed it had been serviced with them and I could pick up a printout if I wanted to.
  7. Great result!, but I would have had his certificate taken away from him, he will feel he has got away with it. The fact that he has a family has, in my opinion nothing to do with it.
  8. This is what I done when I was having hassle with bailiffs. I made a list of everything in my flat, and I mean EVERYTHING. I then sold all my goods to my sister(nudge nudge wink wink). I made sure that I sold her the goods before the bailiffs got involved(nudge nudge wink wink). If a bailiff ever entered my flat I could prove that the goods did not belong to me. If asked why I sold my stuff to my sister I would say that I am leaveing the country and my sister is an e bay addict and would sell my goods(now hers) on e bay. Remember, it is down to you to prove that the goods do not belong to you, keep the recipt handy and if the bailiffs want proof you have it.
  9. Do not bother appealing this ticket, if it's a double red route you CANNOT stop at anytime. I am a london private hire driver and we get tickets for dropping off for less than 10 seconds. We have only recently got exemption.
  10. Pizzamaker, you are slightly wrong. A london taxi can only be owned by one person or a company. Bailiffs(not HMCS) CANNOT take a london taxi or pco private hire car, they fall into tools of the trade. Bailiffs will always use the excuse "you can hire one", but, and this is a big but, I cannot find anything in law that says if you can hire a vehcile bailiffs can take yours. I had bailiffs turn up and try and take my private hire car and the police were called, bailiff came out with "he can hire one" excuse. I got a copy of the 1982 magistraites court act out of my car and showed it to the police, police told bailiff to leave. You have to know the law, to fight the law.

At the time of the seizure we were unaware the vehicle was subject to a Hire Purchase Agreement and would refer you to Regulations 45 1 (a) which directs us to seize goods OF the debtor and not just goods OWNED by the debtor. The judge in the case of Ann Ambrose v Nottingham City Council (2004) clearly states that he considered that the phrase was wide enough to include goods that were not actually owned by the debtor but were in their possession and control which is the case with a car that is on hire purchase. The above statement REALLY worries me. What if I borrow a friends car?, I am in possession and control of the car, are bailiffs saying they could take that?. THis whole situation stinks!!!!.

  13. If this does become law and bailiffs start "kicking in doors", a bailiff will end up being killed. Imagine this........ I'm in bed during the day sleeping(I work nights), all of a sudden the doors kicked in and a couple of big blokes come running into my house shouting"bailiffs", I jump out of bed and hit/stab/punch them, would I be in the wrong?, how do I know thier bailiffs and not burglars useing the word bailiffs as a cover?. Very worrying. The bailiff industry will say "there will be strict rules and guidlines in place, etc etc", but, as we all know, they break the law now, and there are laws in place to protect us, will bailiffs become law abiding overnight?, I doubt it. Is it any wonder more and more people are leaving the country every year?. Great Britain?.....NOT ANYMORE!!!!!.
  14. The watcher, that's a good point. I am a private hire driver, I was stopped by the police for not wearing my seatbelt, I told the police officer that I did not have to wear a seatbelt when I had a passenger on board, the policeman said "I will give you a ticket and you will have to write a letter to appeal", I told him I would not accept the ticket and made a right fuss, he got on his radio and then let me go with no ticket. I think what we need to do is have the relevant legislation handy when dealing with bailiffs and then if the police get involved we can show the police the law, they then MUST act to help us.
  15. I do not expect the police to know every law, even solicitors don't know every law. What I do expect though is when a bailiff act's illegally(ie, takes a car on finance) the police should act. I am fed up with the standard police reply of "it's a civil matter". There are counless example's on this site where bailiff's have acted illegally and the police have done nothing. I am currently is dispute with a council about an illegaly issued parking ticket, the tickets have already been proven to be illegal and yet they keep issueing them, if I was not aware of how to challange the ticket, the next step would be a bailiff calling at my door. The whole system is a complete nightmare!.
  16. John mc kenna, thank you for your post and for being honest. I agree that people who can afford to pay thier debts must pay. I also understand the need for bailiffs. The thing that angers me, and people on this forum is when bailiffs lie and break the law to carry out thier jobs. I would imagine that you hate them as much as we do, they give you, and all the decent bailiffs a bad name. The problem, from what I can see is that bailiffs work on a commision system which forces them to lie in order to earn a living, until this stops there will always be dodgy bailiffs. The current TV seris, cars, cops and bailiffs shows what some bailiffs are like, a bailiff from JBW is always saying "I'm from northampton court", a blatant lie. 99% of dealings that I have had with bailiffs has been through ILLEGALLY issued pcn's, whilst I understand that the bailiff can only act on the information a council supplies to them, it fells that I am getting shafted twice over. The only bailiff I have ever dealt with who has been fair and acted legally, was a court bailiff, but they are employed by the court and are on a set wage(as far as i'm aware). Thanks to sites like this, people are becoming more aware of the law and thier rights, which has to be a good thing.
  17. Hi nat, first thing, don't worry, you can get this sorted. DO NOT open the door to the bailiff, even if he is being nice, make sure your disabled badge is in your car, I am 99% certain a bailiff CANNOT take a car with a disabled badge in it. Contact northampton county court TEC centre and fill a late statutory decleration, this should put the bailiff action on hold. When you fill out the late stat dec make sure you tell them that you are on income support and disabled and have not been able to pay the pcn and that you are willing to pay the original pcn cost. Bailiffs will send all sorts of intimidating letters with big red lettering to scare you, but NEVER EVER let them into your house. When you have sent off the late stat dec, call the bailiff and let him know, he should stop pestering you. Please stop worrying.
  18. A couple of years ago I was having major problems with bailiffs and this is what I did. I made a list of everything in my flat(took about 2 hrs) and sold it to my sister for £1000(nudge nudge wink wink). My sister signed the recipt and so did I. That way if a bailiff ever gained entry to my flat I could PROVE that the items in my flat did not belong to me. If the bailiff asked why I had sold all my goods to my sister I would have said "because i'm leaving the country and when I go my sister is going to sell the stuff on ebay". You must prove that items in your house belong to someone else. You could say something along the lines of "I sold my stuff to my sister to help pay a debt and when I get infront she is going to sell them back when I can afford it".
  19. Bailiffs cannot enter your house and sieze goods. They can enter through an open door or window though. DO NOT let the bailiff in under any circumstances, even if they are being nice. Contact Northampton county court and ask for a late statutory decleration, have the pcn number handy. This will put the bailiffs action on hold. Bailiffs can and will take your car, so hide it somewhere.
  20. Bailiffs are not allowed to take a car on finance, however that does not mean they won't. If they take the car it is NOT theft, it's TWOC, taking without owners consent. The difference?, theft is to permantley deprive you of your car and that is not the bailiffs intention, pay the tickets and they give you the car back. Print of the relevent legislation and go to the police station. The police will say it's a civill matter, but it is NOT. When you show the police the legislation, they must act, do not take no for an answer. Just another example of bailiffs doing what they like. Be prepeard for a long, hard struggle.
  21. The main thing that worried about last nights programme was the fact that the police and the bailiffs were working together. I am asuming that the bailiffs ANPR gets a hit on it's computer and the police stop the car for the bailiffs. I was under the impression that PCN were decrimilised, so why are the police getting invoved?. If I was stopped by the police on behalf of the bailiffs I would REFUSE to talk to the bailiffs.
  22. When they were lifting the red alfa it swung and hit the BMW parked behind. The owner of the alfa appealled and won both tickets, hooray!. The young bailiff yet again saying he was from northampton county court, what a [edit] The bailiff trying to take the siver sports car, the bailiff should check with the dvla the SAME day he wants to remove the car. If the owner had not of been in the bailiff would have taken the car illegally and come out with some crap along the lines of "we can only go by the information we have". The whole programme just shows what lying bar stewards bailiffs are!.
