I bought the laptop from ServiceX and paid to SkunkWorx but ServiceX fully acknowledged the payment by sending me the laptop They are the ones I have a contract with, loud and clear. I've already attached the ebay sale note which has the company name and address. This is not a company number but I've found that there is only one company with that name registered on that address so I would imagine I am rather safe to assume I have found the right company. I have a whole letter as instructed. I am just hoping to run my calculation through you before sending: " It is 328 days now, since 30-September, and I have received absolutely no response or refund from you. I am now making time of the essence and request the following reimbursement within 21 days: 1. GBP 679 for laptop, as per sales price 2. GBP 48 interest, calculated as such: (328/365)*0.08*679 3. GBP 60 Court fees, online claim form " Is the interest calculated correctly? Any other fees I may be entitled to?
  5. Well I only resolved the confusion recently. I bought the laptop from ServiceX. The paypal they linked for payment was of SkunkWurx. Therefore, I thought I was dealing with SkunkWurx because that's where the money went, right?.. Obviously, my warranty was with ServiceX and that's where I have returned the laptop to. I know I am dealing with ServiceX, who are still active. I will prepare my letter tonight and update. Many thanks for the help. I hope I can somehow bring back something to your system. (Definitely, if I will see any money back from it, there will be something in it for CAG) (but I am willing to help in any conceivable way, in addition to money)

So the UK government doesn't care if a business has (hopefully for me) a court award against them and they can continue to con people, switch companies, STEAL laptops?
  7. Ebay/PayPal are long out of the question at this point. Could you give me an idea what kind of expenses will the court take? I don't mind risking 100 pounds for my dignity knowing that I tried to get what's mine. Laptop: 700 pounds Compensation? Interest? Blagodarya
  8. It's gone up because of inflation. No matter what we vote for, we can't get out of the interconnected world that is now, and in this world, a pound today buys you 22% less than it did in June 2015. Even if the whole production cycle is encapsulated in Britain, prices are still changing with GBP exchange rate because UK exporters have an opportunity cost, etc... BTW, I am on a ketogenic diet and I munch on whole butter packs. I've lost 2 stone and on my way to a sixpack. My cholesterol and overall health has never been better. My mood and hunger levels are more stable too. I've never bought any of those fake butters, they are a by-product of the petrol industry and a total attack on your cardiovascular system.
  9. Well, the ebay seller account from which I bought the laptop was ServiceX. I paid automatically using PayPal and the PayPal account is Skunkwurx. I think legally, since they (ServiceX) have shipped the product, they acknowledged the payment, even though it was sent to Skunkwurx? I've returned the laptop to ServiceX. Sorry for bumping, I am just wondering what is my next step...
  10. So, what is my next step? Send them another T&SF paper mail or go ahead with the claims? The company I bought it from has 6000 item for sale on ebay, they are not going anywhere. If I do win an award, is there any pressure on them to pay it up or the government is NOT on my side here and I could be waiting for it all my life?
  11. (Thanks for sorting out my posts) Since they are quite horrible people and they will contest it, what are their possible lines of defense? 1. Can they say that they have never received the laptop? I have the tracking numbers from Royal Mail but it does not say what I am shipping or to whom. Only that it has been received by "dave" and a scribble. It doesn't even say the address. 2. Can they say that since I wasn't looking for the laptop for a year, I've forfeited it? 3. Could my legal dispute with them backfire to me? Like, if claim from them through the authorities, they will hire a super expensive lawyer and make me pay for it? Thanks again
  12. It's an odd case. Mostly because I have autism and I struggle to communicate. I am sometimes catatonic for months. In March 2016 I bought a refurbished laptop with 1yr warranty from SKUNKWURX LTD (they use many names, line svx-online, and others). The laptop failed (motherboard burnt) and I returned it for repair under warranty. The laptop failed again and I demanded a full refund. Unfortunately for me, I was using the advice of Citizens Advice and Money Saving Expert, which are quite inadequate, to be honest. (Since then, I've had the luxury to discuss with YOU my Ford problems, which YOU helped me resolve and I was happy to donate to your cause) They said to return the laptop to them "for inspection". I decided to do so and sent them the laptop with a letter of final rejection. I really had nothing to do with a burnt laptop anyway. I had sent the laptop on September 2016. A year has gone and I neither have a message from them, nor a fixed laptop or my money back. I've sent them a reminder 6 months ago. All correspondence done tracked and signed. They received my letter. They are still an active company. Can I do anything about it? Much Obliged Oh, it dissolved on 25 July 2017... I guess that's it... ? The director has 6 more companies, with similar names and same address.   13. Update: I arranged a meeting with the seller. 1. He claimed he is going through bankruptcy and therefore I must accept any offer that he has because there will be no other money His offer was 2000 pounds back. I called on this and said I'd take my chances with the liquidator then. 2. When he realized he's not selling me this ,he offered 2300 (a 600 pound loss for me). I was willing to concede 200 pounds. We eventually settled on 2600, a 300 pound loss to me. 2600 doesn't sound as good as 2900 but it sure beats 0. Happy to just move on with life. Now what's left is to make this cowboy as public as possible on all review sites. Wanted also to note someone who gave me quite decent legal advice They caught my mistake of having addressed my LBA to the man, not to his company, which was why he ignored the first one. I want to return a favor to the community. I can't promise to hang around here too much but if someone is going through this kind of trouble, they may contact me and I will happily go through all the details. Thanks a lot!
  14. Don't I wish... HSBC are useless in regards to chargeback. Very disappointed. They told me they would issue a chargeback but if the seller refuses, they will not cancel the transaction. Then, when I got the SMS from the trader implying a refund, HSBC told me they won't start a chargeback because "the trader explicitly agrees to a refund and I should go to him". Lucky I don't need to chargeback anything from a vacation in far Asia...
  15. OK, Development! 1. I called a solicitor (95 pounds per hour - not bad, compared to my local solicitors of 300 pounds per hour). He said the letter was just right but I addressed it to the Person owning the company instead of the LTD company. He said I don't have to resend (with the correct address) as the judge viewing the case will understand that I am not a professional (plus, I did get the address right). he said resending the letter is OK and I did. 2. I got a phone call from the trader but I didn't pick up. I am a very anxious person and I am under a lot of stress and I can't handle it. 3. He did send me an SMS saying: "Please bring the paperwork ( service H MOTs ets) for Ford Focus With the card you paid with when you purchased it for refund you agreed" (errors are from the original text). I understand from this that he is willing to refund me. I don't understand why I have to go to his premise. I really don't want to. 4. I called HSBC and they were, of course, unwilling to do a chargeback. You know how helpful big organizations are... They said if the seller agreed to a refund, there is no dispute and hence no charge-back. However, I do believe this is still a dispute as he is not entitled to tell me where to go. It's a big journey for me to get there. Questions: 1. Do I have to actually go to his premises? I would like to add that the trader's ethnic group is very hostile to my ethnic group and us getting along is a rarity. It was OK while I was buying a car but add a little lack of goodwill and I'd feel very tight in that situation. 2. Couldn't he just call his bank to reverse this transaction? Or ask for my bank details and wire the money to me? Thanks
  16. not sure it helps a lot. Ad sites just say "Trade Seller", so the buyers can't really google the trader. On the other hand, if the trader is running any sort of damage control, they'll be aware when their names pops up on the internet and may access this thread to gain information about my next steps and other information I wouldn't admit to them.

  18. According to my bank (HSBC), I can go the chargeback route for 120 days since the purchase. I would definitely consider it, depending on the response I get. I didn't send the letter yet, was wondering if anyone could take a look and comment please?
  19. From what I read in google, section 75 can be used by credit card payment only. Anyway, section 75 isn't a silver bullet, it's a claim against the bank. I think I'd rather sue some barely-speaking-english garage cowboy than the bank

Do I need to say something about his claim that I "caused the damage by driving the car"? Do I need to say something about his own assessment that the repairs are worth 1000 pounds?   24. From what I see on google: yes, the burden of proof is on the trader. However, don't I need to get Citizen's Advice on my side first? As far as they told me, they will progress the issue with trading standards (I can't do it myself, I've been told) if it requires escalation. From what I see in google, I cannot do a "section 75" with a debit card. Chargeback sounds illegal at this point - don't I need to get a resolution saying I am entitled to my money back? I noticed a small noise after about 190 miles. Drove it home like that and called the trader. He told me to "gently drive it to his garage for inspection". It broke down en route to him. Ford Focus, 89,000 miles, FSH - no advisories, 6 months MOT. Is it imperative that I tell you the trader's name? I'd like my public correspondence to stay untraceable for now.

Bought a car: - made in 2010 - 89,000 miles - Ad said: "car is mechanically excellent" - Paid GBP 2900 with debit card - Trade seller After 200 miles, car broke down (engine noisy, smoking and not going anywhere). Seller said I was driving the car with a problem, hence it's my fault. Called citizen's advice, got deferred to consumer helpline. They called today, saying: 1. The burden of proof is on ME 2. I need to take the car back and get an independent export report 3. I need to prove it is a "manufacturer's defect" All these 3 are totally contrary to what I have found via google. What in the name of Elvis is a "manufacturer's defect"? this is a 7 year old car! What to do? Bought car: 20 Jan 2017 Car broke down: 27 Jan 2017 Dealer picked up car for inspection: 2 Feb 2017
