1. Right ok I will get my dad to do that, then I'll request to know how much of loan 2 was payed off for loan 1. And well if say the claim is less then £10,000 say the 2 to 3 grand mark, could you please tell me how much would court cost, what would be the chances and what would I need to do. Or if you wouldn't mind, your best guess as what the outcome would need and be. Many Thanks Andrew
2. Couldn't of said it better, Please keep us updated, if you need any advice, post here someone will be able to advise. If you would like to know how my case is going. Check my post for it or PM me. Andrew
3. Okay I'll ring them tomorrow, can I talk for my dad or would he need to do the talking? Also will this be ok for my covering letter? or should I include the 2009 loan and 2006 credit card or should I do another claim for them? My Covering letter: Headquarters Trinity Road Halifax West Yorkshire HX1 2RG Date: 00/01/2015 Dear Sir or Madam, Re: Account numbers: (Loan account number 2001), (Loan account number 2003) We am writing in relation to payment protection (PPI) policies, associated with the above accounts, which we do not believe was sold to us correctly or fairly. We believe you have not treated us unfairly for the following reasons: · The term of our PPI covers was shorter than the term of our loans and it wasn’t made clear to us that we wouldn’t be protected towards the end of the terms · The total cost of adding PPI to our loans was not clearly explained to us · We felt that we was being pressured into taking the covers and unable to say no · We was not told how to go about cancelling our polices. · We already had cover in place that could have protected our repayments but was told that we needed to take there covers out too Unless you can provide proof that the polices were appropriate for our circumstances and that we was treated fairly when you sold us the insurances, we will expect a full refund of all premiums, the interest that we have incurred as a result of having the PPI covers and 8% simple interest until settled. We look forward to your prompt response to this letter. If we have not had a satisfactory response from you within eight weeks of this letter we will be taking our complaint to small claims court. Yours faithfully, Is this okay? Thanks Andrew
4. I would go with that and get the letter off with the spreadsheet, 1 class recorded. If they refuse again, take it to small claims court. Won't cost much and not much risk. Andrew
5. right ok well if you can get the credit agreement and it says anything to do with PPI that's proof, also if you have proof of charge you should have a good chance. So what are you thinking of putting in your covering letter? I would start with: Shop Direct Limited 1st Floor Skyways House Speke Road Speke Liverpool L70 1AB Date: 06/01/2015 Dear Sir/Madam Account number: (Littlewoods Account Number) I am writing to reclaim all charges on my account(s) since the (date of first charge) I am unhappy that these charges have been applied to my account and in this letter I am registering my complaint I need you to consider the following (The reason why you feel the charges are unfair/unlawful) I attach evidence to show a spreadsheet of charges and compound interest. I therefore request that you repay all my charges since (date of first charge) and compound interest on the charges which total £(Total amount of charges and compound interest). I also request that you remove all my defaults on my credit file as I believe them to be unlawful. Under the FCA guidelines, Shop Direct Limited has 8 weeks to resolve my complaint. I trust that you will deal with my case within this period. If not, I will refer the matter to the the Financial Services Ombudsman. I look forward to receiving a full response to this letter within 14 days Yours Sincerely Sign here Print name Andrew
6. Please upload all the SAR, We will first need to find out the following details: PPI Policy Number Cover Start Date Cover End Date What was covered You will also need to send a CCA request for the copy of the credit agreement your in with them. after you have them, you'll need to find all PPI charges and put them into a spreadsheet. Then you can start on a PPI questionnaire, It will only need a bit more information that we will go through with you. Andrew
7. Welcome to CAG, Let me be the first to say please relax, Lowells is a DCA meaning they can't send Bailiffs, there all bark and no bite. Contact Littlewoods not Lowells with this letter. Your address There address Date Dear Sir/Madam Account No: (Put your Littlewoods Account Number Here) I am writing to inform you that I am seeking advice and assistance regarding my current financial difficulties. To this end, I would appreciate it if you could hold action on the above account for a period of at least 30 days. Also, during this period, could you please freeze interest and/or any other charges accruing on the above account. I will contact you again with further details of my financial situation and my proposals for repaying my creditors as soon as possible. I look forward to hearing from you. Yours faithfully Name Printed Only sign if you've signed something before for them or it's not needed. This letter can give you some breathing space. So you can either come up with the money. Only pay what you owe, Do not pay any of Lowells charges or interest. Also check your statements for any "£12" charges, if you have any you can claim them back. we will run you through how if needed. If you can't come up with the money, you'll need to do a budget sheet and give token payments of £1 until you can. Andrew
8. Some was less but my highest was 2.780 Id install open office because your going to need it for the PPI to. Andrew
9. Right well if you have already claim them back, there wont be anything else but PPI. But that interest looks a bit low. How many £12 charges were there and how far back? And i mean as in what was the highest "0.000" next to arrears. Because that's the one you'll need to convert into compound interest. Andrew
10. Well if there's no letter from them, 15days after the letter has been signed for. I'll be getting straight on to them. Andrew
11. You are more than welcome I hope you get every penny back! Remember you only convert the highest arrears into compound interest, pop it in the APR box. You need the description to say: (Late or Over limit PENALTY FEE) and you claim until the day you send it off to them, so put the date you send it in the "Claim to". You can only claim back any £12 you see on the statement. I've uploaded a copy of my claim and a blank spread sheet for you. Andrew CISheet v101.xls
12. Please forgive my language but they are [removed] you there. The CAG Team will be with you shortly. Your in good hands Andrew
13. Posted the letter, bet they take longer then the 14days I've gave them to reply. Andrew
14. Okay I'm fully expecting to take this to small claims court. After reading on how everyone else has been doing, it looks like the only way to get the money. I'll be sending my letter today 1st class recorded, I'll include: Covering letter Budget Proof of Income Spread sheet Let the games begin. Thank you for your time everyone Andrew
15. I found extra fee's when double checking my SAR, I've updated the spread sheet and it now says i'm looking at £888.21 so glad I looked into the interest. I'll upload a copy just to be sure I've not done something wrong. Will I only need, the covering letter, budget sheet and spread sheet to claim or do I need to send proof of income (benefits) if I'm claiming under financial hardship? Thanks Andrew
16. I was also wondering should I put in the letter that I want all the defaults removed from my credit file? I know its a long shot, but it's a no shot if I don't ask. Thanks Andrew
17. Hi Emma19860789, I've had the same SAR from them. if they said anything like mine, I'll upload a copy, it's whats next to arrears if you see "2.456" or something along the lines of that you need to use this website (http://www.stoozing.com/calculator/apr-rate-converter.php) and convert that into compound interest. You can then fill out the spread sheet, because you only need the date/value of the charges. Andrew
18. What information did you see in the SAR to make you think you had PPI? Also it's always good to check, there could be a few 100 pounds on just a few years of the insurance running. And I don't think they need to, or there wouldn't be a "CCA Request" But i only say that because that would make sense. I'd get the charges done first, then do the PPI. It needs to be done in a different claim thou. Andrew
19. I can't find either of them statements xd100uk. But I've used the loan analysis spread sheet to work it out. My working out: Loan 1 ran for 23 months, 23months into the loan the balance is £3.683.34 according to the loan analysis. All I did was take the information of the loan agreement and put it into the spreadsheet. Is this right? Thanks Andrew
20. They are the same fee's as mine, they not aloud to charge them. I'll have a look what you should put in the letter. As for the PPI they will just hope you forget. If you have proof of the PPI charges you need to get them in another spread sheet and fill out a PPI questionnaire as best as you can. Also you'll need to send a CCA request for the credit agreement, you'll need it for the PPI claim. Andrew
21. Okay I've dropped the £3.00 charge and charged the charge name. I'll upload again just to be sure. The account is still active I think, I'm still getting statements but my last token payment was sent to them in November from my ex DMC. They haven't asked me to set up a new arrangement yet or added anymore charges. Also he is my updated covering letter Date:05/01/2015 Dear Sir/Madam Account number: 00000000 I am writing to reclaim all charges on my account(s) since the 14/08/2011. I am unhappy that these charges have been applied to my account and in this letter I am registering my complaint and I request that you immediately stop applying further charges to my account. I need you to consider my case as a matter of urgency as I believe due to the charges to my account I’m suffering serious financial hardship and becoming unfairly indebted. In particular, my ability to pay rent, mobile phone contract, food, clothes and basic essentials. Also with the loss of my job my monthly income has been significantly lowed, so I now solely rely on Universal Credit for my income. I will attach evidence to show my monthly income and outgoings. I therefore request that you repay all my charges since 14/08/2010 and compound interest which total £747.65. Under the FCA guidelines, Shop Direct Limited has 8 weeks to resolve my complaint. I trust that you will deal with my case within this period. If not, I will refer the matter to the Financial Ombudsman Service. I look forward to receiving a full response to this letter within 14 days Yours Sincerely Is that all I need or do I need to send proof of income with the covering letter, spread sheet and budget? Thanks Andrew
22. Are ok, I'll have a look around the site tomorrow and ask what you should claim under. And I can't see how that would matter, they haven't said they think you have a claim. So I'd get another letter off, I'd also still include a budget sheet. I think you need one to make a claim but I'll also check. Andrew
23. Don't beat yourself up over it, they did hide it well. You also need to thank dx100uk, he was the one who gave me the website for converting the interest. And I'm sure there's no time limit on claims as long as you can proof it. I'd fill out a personal budget sheet, link below for a good one. https://www.nationaldebtline.org/EW/steps/step2/Pages/Step_2_11.aspx And see how much money you have for creditor's. If its less then what you need to keep all your creditor's payments up, I think you can claim financial hardship. And if you can you can use the same covering letter as me. Andrew
