  1. Have a read of this http://www.consumeractiongroup.co.uk/forum/general/33174-consumer-credit-act-agreements.html might help, very long though
  2. If they're still chasing you for the debt then send them a CCA for a true signed copy of the contract. Without the contract the debt is unenforecable (I think) and chances are they cant provide it skb
  3. You need three copies, one for self, one to send to the court and one for bcards solicitors. Would phone the court and ask when they want the court bundle by skb
  4. Royal mail dont always input the details of registered delivered mail into their computer system so your letter may well have got there. If in doubt send another letter. Also go to the post office with your tracking number and claim back the delvery charge. Address is Customer Care, Lloyds TSB, 125 Colmore Row, Birmingham B3 3SF. skb
  5. There is also a third type of interest you can claim which is compound contractual interest. You apply this interest to every charge you have incurred at the unauthorised borring rate which the bank charges you. This is based upon the implied term of mutality and recipcrocity in the contract. There have been several successes of applying this interest and can add up to quite a tidy sum. This interest can be applied from the prelimary letter stage onwards see http://www.consumeractiongroup.co.uk/forum/general/7252-new-way-looking-interest.html skb
  6. Hi Conar Let me get this straight lloyds are saying youve had a loan for 10K but your saying you've never had one. this is a lot of money so you can hardly not notice it going into your account. So my questions are Was 10K paid into your account 10 yrs ago? Two things you can do are submit a CCA reuest for a true signed copy of the loan account and request the appropriate statements from your account I must admit I am somewhat confused by this skb ps they need to retain a copy of the contract for the entire lifetime of the loan.
  7. How about accepting the offer as a partial payment only and then proceeding to the courts to claim the rest. That way you get some cash in time ofr chrimbo - providing of course barclays go for it skb
  8. Nice one Yasmin, seems this is the fourth or fifth victory i've seen today :) Congratulations:) skb
  9. :) Congratulations Pauline:) Always puts a smile on my face when someone wins. Power to the people skb
  10. Somewhere between zero and 1% I reckon. Good luck anyway, if they work i'll steal them skb
  11. I believe barclays and barclaycard are separate companies so you'd have to do them separately skb
  12. Im Due before the judge on 28th Feb an have been at this since July. Still as leamarie says gives us plenty of time to sort out the court bundle skb

  15. Steve, you might wanna remove your account number from post 3.You never know whos looking skb
  16. Hi Kathryn Hear is the spreadsheet Verzend.be - send files up to 1GB for free - 1_CompoundSheet_v1_1_.6printable.xls If you just copy and paste your charge details from your spreadsheet onto the charges and interst tab in this one and then fill in the details on the notes page then it should work. Your interest seems a bit low are most of the charges quite recent?? skb
  17. I Have an atered version of this spreadsheet which will print out a table displaying the charges you have incurred and the contractual interest you wish to claim on each charge, if you want it I can PM u it
  18. Hi Kathryn The spreadsheet is designed such that it will calculate interest levied on the charges by the bank where an overdraft is in place, so in that respect in cant be used for CC's. However if all you require is it to calculate the compound contractual interest as applied to each charge and NOT the interest on that charge then it can be used - hope that is clear example your limit is £350 and a charge takes you too £370. Your monthly statement will have interest for the balance upto £370 but you can only claim the interest for the balance over £350. Now the spreadsheet will only calculate this interest for bank accounts and not CC's. Typically this interest doesnt amount to much and is often not worth the bother The calculations it uses to calculate compound contractual interest are however still valid. therefore the compound interest values on the final sheet can be used for CC's I have not came accross another spreadsheet which will do these calculations. skb ps how much do your charges total upto??
  19. Hi Kathryn I find the best spreadsheet to use for this is the one by Mindzai see thread Mindzai & Lucid vs Lloyds TSB and the spreaedsheet is in post 22 and can be downloaded from here Verzend.be - send files up to 1GB for free - CompoundSheet_v1.6.xls (note that the link take you to a web site from which you download the spreadsheet, for some reason you also have to wait 10 seconds before it allows you to do so but dont worry, it works) its really easy to use, you simply enter your interest amount (19.9 % in your case) in the notes sheet and all your charges in the charges & interest sheet. The compounded interest for each charge will then be displayed in the C.Interest (Daily) sheet. It will also allow you to calculate the interest levied by bcard on each of your charges but this requires balance information which due to the microfiche issue you probably dont have. In any case this type of interest is usually minimal iwhereas compound contractual interest can add up to a nice tidy sum. Anyway let me know how you get on with the spreadsheet an if you've any probs i'll do my best to help skb
  20. Cheers Lookin, my SAR requests are unfortunately gunna have to wait till pay day as am quite quite skint. Gives me a bit more time to read up on the subject though I suppose. On the bright side i've found the account number 1 of my natwest cards that I defaulted on - its on a letter from a DCA. Am also gunna obtain my credit report as this may have details of other cards (store cards, visa's etc) i've had in the far distant past Early Repayment Charges (ERC) On at least three of my loan that ive paid off early i was hit with a ERC. For lloyds these amounted to 3 months interest of the closing balance. I now believe these to be a penalty charges, and thus unenforceable as per bank charges, and I want them back. And will fight tooth and claw to get them. Handy Hint for Avoiding ERC's For the last lloyds loan I paid off I was more aware of these ERC's so what i did was to pay off 95 % of my balance one month and then the following month request a settlement figure, as the balance of the loan was now really small the ERC of 3 months interest of the closing balance was also very small so ended up saving myself a fair wad of cash. skb
  21. Thanks to online banking I now have the loan numbers for lloyds loan 3, 4 and 5. Just the graduate loans one and two outstanding from lloyds. Also have the credit card numbers from Egg and the loan account number from egg. Have a sneaky feeling I had PPI on my NatWest Visa and MasterCard, these were paid off around 7 years ago but know for a fact PPI would never have been explained to me. Still bit of a long shot I think going after them, just finding out the account numbers could take a massive amount of effort skb
  22. Hi All Have been meaning to look into this little forum for quite some time but never managed to get round to it. I have had various PPI agreements over the years and must have paid out a fortune in premiums. To start heres a summary of my PPI history to date (more to clarify in my head what info I need to dig up than anyhting else) Lloyds TSB Graduate loan one £3500 + PPI. Start date around Sept 1999. Was a contractor at the time of taking out this loan so didnt actually qualify for cover as I found out much to my dismay around 9 months later. Bank staff were aware of my employment status. Lloyds TSB Graduate loan two + PPI - a refinance of first loan. Not given option to remove PPI. Only had this loan before refinancing into graduate loan 3. Lloyds TSB Graduate loan three £6500 + PPI (used to pay off previous loan). Start date unknown. Was informed I had to have PPI due to poor credit rating. Tried to cancel the PPI a coulpe of years into the loan but was refused, no idea of the date. Lloyds TSB Loan £8000 + PPI.Start date unknown. Was informed I had to have PPI due to poor credit rating. Tried to cancel the PPI but was refused, no idea of the date. Lloyds TSB loan £9000 no PPI finally got wise (used to pay off previous loans). Start date May 2005. Was finally getting sick of the PPI so paid off old loan. Egg Visa £4100 limit + PPI - no idea when I got this 2001?? paid off now with egg loan Egg MasterCard £4100 limit + PPI - no idea when I got this 2001?? paid off now with egg loan. Both cards automatically came with PPI. I did manage to cancel the policies but only after paying out hyundreds of pounds first. Egg Loan £7000 not sure if had PPI or not (Used to pay off cards) To summarise I need dates and account numbers for each loan. Amounts for the PPI cover. S.A.R - (Subject Access Request) request for each to request statements and copies of loan agreements Question - is there a template S.A.R - (Subject Access Request) available for PPI skb
