Theres a couple of things you can do 1) apply for your credit reports from experian and equifx at £2 a pop, these will have the last 6 years of your credit history on them and should have the card numbers of on, 2) Send a reworded S.A.R - (Subject Access Request) along the lines of - You may need to supply them with proof of identity as well, photocopy of a utility bill and driving license should do it skb
  2. Im playing at night owl tonight and since at the stroke of midnight I got paid i've just fired off my onlline requests for my statutory credit reports from equifax and experian. A fine example of section 7 of the DPA allowing us to get these for just £2 each. They have a legal obligation to deliver these within 7 days so pretty soon I should be able to see whether we can tally the payment history on the report with instances of being charged. Cant wait. Hopefully this will give us a way round the old microfiche baloney skb
  3. Hi I would expect a settlement offer pretty soon for the difference between each charge and the so called £12 'recommended' (NOT) by the OFT. You can then accept it as a partial settlement and plough on with your court claim. In many ways bcard are playing into our hands with the partial settlements as they help fund the court fees for your claim skb
  4. I agree PPI has its place and can save you a lot of trouble when things go wrong. The key is to not pay over the odds for it. Trouble is its not widely publicised that you can get it separately to your loan at a much cheaper rate. I guess in an ideal world the banks would tell you this when you take out your loan so you can shop around for the best deal. With time this has to happen (or will be forced to happen by the OFT) and then I reckon the banks will be forced to lower the premiums on the insurance they offer or otherwise miss end up missing out on a lucrative market. Sites like this one and MSE are just whats needed to help spread the word skb

  6. I used to have one but cancelled it as was no longer necessary. I went with payment care.co.uk Loan Payment Protection Insurance - Mortgage Payment Protection Insurance : Paymentcare UK and found all the details about it on moneysavingexpert.com. Worked out at around £20 to insure £500/mnth of loans. You can also take out income protection so if you lose ur job rather than getting loans paid off you get an income from the insurers I would advise you to read up on the them and read the small print before taking one out to make sure it covers your needs skb
  7. Am now ready to send off my S.A.R - (Subject Access Request) request. Have pulled a few things together and am gunna send them this, its a bit OTT but may as well get as much info they have on me as possible. Lets see what they send me skb
  8. Hi Kathryn AS youve only been going since 2004 its probably right. all compound interest means is that say you have a £20 charge at 19.9 % APR. After 1 month it will be £20.30. Interest is then charged on £20.30 for the second month so the amount then becomes £20.61. After twentyfour months the total is £28.32 and the interest for that month would be 0.43p. So note that the interest for the first month was 27p and the interest for the 25 month is 43p. If the interest didnt compound you would just charge 27p interest a month. Obviously compounding the interest makes the total we can claim higher than not compounding For example £20 over 24 months not compounded £27.20 £20 over 24 months compounded £28.75 This is how the CCC's charge interest so we can do it right back at em skb
  9. Ok, I've gone through my statements several more times and there are definetely only 11 £20 charges from may 04 to Now. For additional info I have a credit report from experian which I obtained in Oct 2002 which lists my payment history with barclaycard. Now according to the report there were 31 missed payments between dec 1998 and Nov 2002, with 12 from April 2001 to Nov 2002. If we take it as said for now that Bcard werent charging before April 2001 then I have missed 12 payments in the period april 01 to Nov 02 alone so unless they werent charging me for these missed payments then there offer is way way off. Think what im gunna have to do is either wait for the microfiche b*llocks to sort itself out or request a couple of statements which by reference to my credit report should have charges on them. Out of shear idle curiousty and a fair dose of distrustful suspicion im gunna request a couple from pre April 2001 that I reckon should have charges on, and if they do boy are bcard gunna be in trouble Am also gunna obtain a new credit report and see if I can tally up charges on statements with payment history info from the report, if this works could then use it as a more accurate basis for charge estimation skb

  11. Hi Spotnot, Bcard are just complete w*nkers bout this. They know the ICO is gunna rule microfiche is a relevant filing system but they still drag their heels. Wait until the 40 days are up then complain to ICO. Bcard have issued they Final response on the matter so no need to send them LBA unless your taking court action for statements. I believe the ICO will be issuing its report on its visit to bcard sometime in december so the issue may well be resolved by xmas. Not likely to make them send them out and you would have to justify such a high claim when you went to court. Claiming £5000 without any reasonable justification for it (ie based on charges post may 2004) may be seen as somewhat fraudulent. skb
  12. Yeah, id also copied the index from someones court bundle they'd listed in their thread with the aim of amalgamating the two. Have looked back and it was one against Abbey hence the need for the DPA. HAve removed it from mine cheers skb
  13. For info, have checked over correspondance and [problem] requested a stay but were Denied. Ha. Still gunna pester them for settlement, make em earn the £200+ an hour they're charging lloyds skb
  14. Hi Poppy, If you havent already sent off your N1 then you can add additional charges to it, now is also the time to apply the 8% interest. For this you must include in your particulars of claim the phrase skb

Hi Fuzzy, This is what I put for bcard, cant remember where I stole it from. just amend accordingly Section 7 - date of fob off letter Section 9 - All relevant documents - copy of your SAR and Abbey fob off plus any additional correspondance you entered into regarding mfiche Secion 10 - List them that should do it skb

Cheers Kath, I no that, you no that, bcard no that but they still like playing silly beggars Does seem a bit odd, get the feeling that they have only included charges post may 2004 and I might have missed a couple when going through my statements so am gunna recheck them. Maybe out of shear generosity they've refunded me £10 for each charge rather than £8??? But somehow I thing not. 27 days and counting since CCA request and still no sign of signed copy of contract. What are they playing at. They cant surely have lost it can they?? skb

  19. Received a letter from Carol Jones today the jist of it being My response, well I will accept it as a partial payment only. As for the amount I dont quite know how they have arrived at it. By my reconning I have been charged 11 times since may 2004 and estimated at 18 times between april 2001 and may 2004. The £110 divided by 8 is 13.75?? as all my charges have been for £20 pounds it would seem their maths just doesnt add up. Additionally it would seem I have only been charged twice between april 2001 and may 2004. This i find very, very hard to believe as this was when I was at my worst with regard to charges. So whilst I will gladly accept their £110 I will pursue the rest based on MY estimate until they supply me with evidence that my estimate is wrong skb

  21. Im bored and at work so have started to compile my court bundle really early. Quick question though do I really need to include the entire DPA act and if so does anyone have a word version?? Cos it will take for ever to copy and paste from Data Protection Act 1998 Is it not more reasonable to only include the relevant bits?? skb

  24. Hi Timmy Sent my Data Protection Act in june, filed court claim in august and hearing date is end of feb. will be 8 months in total but thats with a 4 month wait for a court date. Your time limiting factor will probably be how busy your local court is skb
  25. The 8 % interest you can claim is under section 69 of the county court act 1984 is only to be applied when submitting a claim. As it forms part of the county court process it stands to reason that it CANNOT be applied until a claim is submitted. I've seen the templates on MSE and IMO they're no where near as good as the ones that can be found here. They are also wrong. By requesting the 8 % before a claim is submitted you basically demonstrating to the banks that you dont know what you are doing. IMHO i'd forget the 8 % interest and go with the higher rate of contractual interest which you can claim right from the start. Its your choice of course which you go for skb
