  1. To set the scene, court bundles were due in on 14th Feb, mine was duly delivered on the 12th Feb. On the 14th I received into my bank account full settlement. Hearing date was for the 28th. On the 15th Feb I received a letter from the courts saying [problem] (Lloyds solicitors) had wrote to them saying the claim had been settled so could I please inform the court if this was so, so I sent the court a letter saying full settlement had been reached. I included in the letter an application for costs. This letter was delivered to the court on 19th Feb. Also on the 19th I received a letter from [problem] saying heres your money please tell the court the claim is settled. On the 27th Feb I called the court to check they had received my letter, they said yes they’d got it on the 26th and the judge would be reading it that afternoon. On the 1st of March I then receive this: What I want to know is how can my claim be struck out when its already been settled? and what’s happened to my application for costs? the court order makes no mention of it just some mysterious letter from [problem], is this the letter they sent the courts saying they had settled?? What do I do now?, is there someone specific I can contact at the court for more information? Should I write them another letter??   5. Not worth cancelling it then, if it turns out that they havent received it then just send another, alternatively you can take the letter and cheque into any branch and get them to sign for it. They will then forward it to the appropriate dept, at least this way they are guaranteed to get it skb
  6. I agree, you need to keep them separate because you cannot use the UTCCR for business accounts, only personnal skb
  7. Hi Birmingham A few questions Did you send the letters from the templates library?? ie SAR, prelim and LBA?? Was it Statutory interest at 8% claimable under section 69 of the county courts act 1984 that you requested or contractual interest at their authorised/unauthorised borrwoing rate??? If it was the Statutory interest at 8% claimable under section 69 of the county courts act 1984 then this is ONLY claimable if court proceedings are started. You CANNOT request that lloyds pay this interest unless you issue a claim against them. MOST IMPORTANTLY if they have offered you the full amount of charges that you requested to be refunded then you MUST accept it. You CANNOT issue a claim just so you can get the 8 % interest. However, if it was contractual interest that you were claiming then yes you can refuse their refund and issue a claim for the full amount skb

  10. Hi Candy Has the cheque for £10 included in your SAR been cashed?? If so Lloyds have 40 days from receipt of your SAR to send you your data. However it maybe that Royal Mail have lost your letter, although delivery details are not always logged onto their computer system. You could always try ringing lloyds a call on 0121 633 5411 or 0121 633 5452 to check they have received your letter. If they havent recevied it then cancel your cheque and send another letter, royal mail should reimburse for the one they lost. I would definetely wait until you have all your charges for the last six years before proceeding to your prelim letter skb
  11. Letter now sent to and received by Sheffield Court for costs. Claiming £530 ish, more or less same breakdown as in post# 68. Will nom have to wait and see what the court thinks. Strangely enough when I got home from work on monday after sending the letter there was one waiting for me from **** on my door mat. The letter was supposedly in response to a phone conversation we had had (despite never having spoken to them in my life) offering me full settlement etc and could I let the courts know they had settled. Well thats covered in costs letter so no problems there ****. On a different note how do I change my thread title to WON and move it to successes forum?? skb

  13. Prelims sent off on saturday Last six years charges + 29.8 % CI - £3787 Older charges + 29.8 % CI - £4915 Now eagerly awaitin standard template fob offs. I wonder if they will notice that one of the prelims is for charges over 6 years old skb
  14. Hi All Sending off my SAR today for statements etc on 2 egg cards (visa and mastercard). Im going after a double yolker as am chasing penalty charges and mis-sold PPI. skb
  15. Hadnt noticed the diofference myself, probably something to do with a difference in the calculations used. Personnaly id keep it simple and use the one that gave me thhe most cash skb

Given the run around they put us through I believe it to be true and just for them to be penalised for their abuse of us and the court system. Indeed I know of one instance where someone has been granted £950 in 'compensation' http://www.consumeractiongroup.co.uk/forum/rbs-bos-successes/49470-contractual-interest-details-case.html against RBOS. This was for inconvienience caused, distress caused, priniting costs, exemplary charges and aggravated damages. My Expenses so far Printing/photocopying at 10p per sheet for 386 pages = £38.60 Postage = £9.76 Time charged at £9.25 / hr Preparing DPA - 1 hr Preparing Prelim and schedule of charges- 5 hrs Preparing LBA - 1 hr Preparing allocation questionnaire - 1 hr Researching relevant case law and regulations - 40 hrs (although was probably much higher becuase i spent a lot of reading up on the subject) Preparing court bundle - 5 hrs Gives a total of 54 hrs = £499.50 Grand total £547.86. This seems a bit high to me but then I have devoted a hell of a lot of my time to this since May 2006. However CPR 27.14(2)(g) of civil procedures for small claims track does state Although I have still to receive any correspondance from [problem] or Lloyds informing of there intent to settle so should I wait until I have received such a letter or just press on with it now?? skb

  20. For reference I have not heard a single word from either **** or Lloyds as yet, will see what the post brings over the next couple of days. Payment was made direct into my account in three separate deposits each entitled REFUND BANK CLAIMS and were for the following amounts £595 (charges) £214 (8 % interest, oh how I wish id known about contractual interest when i filed) and £80 for court fees. £500 is now winging its way to my GF who kindly helped me pay off my overdraft when lloyds demanded in back last july. Thanks to this site she is now taking RBOS on to get her charges back. See her thread here click! Success survey completed and donation made (a modest one cos still skint but every penny counts) Power to the people gary
  21. Hi Katie Lloyds have paid out today on my claim, the date that the court bundles were due in. They also paid out on merewynkitt who had same court date as me in sheffield (28th). May be a new tactic of lloyds to actually pay out BEFORE the court date. Fingers crossed may only be another 14 days skb

  23. Have been skint for the last few months so have let this claim slide a bit since I couldn't afford to submit a claim. After a success against Lloyd's earlier today can now finally afford it. I now need to follow up on DPA non compliance and CCA non compliance then im ready to go. Want my court claim in by the end of the month before i spend all my money so watch out bcard cos im gunning for your ass skb
