I am still eagerly awaiting. They are a bit late methinks. The time has been well spent reading Dayglos account of Vodafone and getting somewhat concerned. Whole thing is very annoying as was only a couple of months late with a final settlement bill of £16, which was in dispute for half of that time. After a week of gorgeous weather, I in all my infinite wisdom have booked next week off work to sit in the rain and collect together all my VF correspondance and have a good long read of the Data Protection Act skb -
Thats right they dont have to send statements just details of ttransactions and charges skb

Hi Jmat You can claim everything back apart from charges for having a particular type of account. For instance if you have a select account it costs £7 a month and appears on your statement as 'account charge' Overdraft xs fees, unpaid DDs and unpaid cheque charges can all be reclaimed. Interest is a bit more tricky as you can only claim that portion of the interest which was levied on the charge and not for you total overdraft. Hi Debbie GaryH has prepared a letter for claiming costs where the defendant has acted in an unreasonable manner i.e. taking everything to the last minute and generally acting like a t*t. In that case deadline is 5th May. I would expect you to receive their standard defence somewhere around then, give or take a couple of days. Are you sure its chicken pox and not 'dont want to go back to school after easter pox' skb

I seem to remember reading somewhere that lloyds dont even open letters that arnt sent recorded delivery. I might of dreamt that though so dont quote me skb

Not worth the bother IMHO. They're not likely to file any documents or turn up on the day. Most likely they will pay your claim straight into your bank sometime between now and the 25th. Not sure if its been mentioned in your thread yet (ive only quickly scanned it) but you will have a case for applying for costs. See here Application for costs skb

Hi Jodes In total they have 28 days from when the claim was served in order to file a defence. You filed on 30th March so they have until around the start of May skb

Do you mean a response to your SAR in 40 days? If so then yes you would generally get your statements through within the limit. As for settling before court stage this is not likely unless it is a very small claim, Even then you'll probably have to file a claim before they pay up skb

I havent been able to find anything with CC numbers on so sending SAR out tomorrow regardless. Will have bank account no. and sort code so they should be able to find out my credit card accounts. failing that, when/if I get statements through my CC numbers should be on there as they were paid from this account. Anyone know who underwrote lloyds insurance from 1999 to the present. Am going to send them a SAR for all details they hold too, will be interesting to see just how much the insurance actually cost skb -

Update: Am still chasing lloyds up for missing info about first graduate loan. They finally got back to me with some fob off about needing more info from me in order to chase it up, id already given them the dam loan account number twice. So sent them what they need and am wating again. God but they annoy me skb -

This is not quite so simple. To convert monthly to yearly use the following formula: yearly rate = ((monthly rate + 1)^12)-1 The rate should be expressed as a decimal. Therefore Yearly rate = ((1.87+1)^12)-1 Yearly rate = 0.249. So as a percentage is 24.9 %. To do it the otherway around i.e convert yearly rate into monthly rate use the following: Monthly rate = ((1 + yearly rate)^(1/12))-1 or to convert to daily rate Daily rate = ((1 + yearly rate)^(1/365))-1 Hope this is clear. Update on my CCA request for signed contract. Bcard have still to date not responded to a single letter I have sent them asking for this. Not a peep, not a whistle. I take this as firm evidence they dont have the contract. When I get the time I will have to make the effort to report them to the relevant institutions. skb

My next steps: Update my schedule of charges. I am still going for contractual interest, but whereas before I was just going for 17 or so % what im going to do is apply the rate of interest for each charge that was applied when the charge was debited upto such a time when the rate of interest increased. The new higher rate will then be applied. This is because the rate bcard charge has increased over time from 17.5 % to the 24.9 % that im paying now.

Cheers Micky, almost there now (ish) The supply of statements saga continued for some time. I sent them a letter basically saying come on lads the ICO has said microfiche is relevant so give me my statements. Now. In response, and I found this very very annoying, they merely sent me my letter back with a compliments slip attached with the words "No cheque attached" blazened across it. I was not amused so sent them this: This seemed to do the job in that they have now sent me statements from june 2001 to may 2004. Still missing anything prior to june 2001, now I knoww that bcard assert that they did not charge before this but im unsure whether or not I believe them. Does anyone have any evidence of charging before april 2001??? The really disappoining thing about this is that the number of charges for this period is nowhere near my estimate. Bcard in all there ultimate glory and wisdom have on numerous occasions during this time NOT charged me for late payments and exceeding limits. I am quite frankly very disappointed in them, when I commit these transgressions I expect to penalised so that I can then have the gratification of claiming it back. Between june 2001 and may 2004 I was charged a measely 2 times and not my estimated 18 times. Why o Why didnt I file against them with an estimated claim. Still the silver lining is that my court fees will be considerably less when I file in a couple of weeks. skb

Bong has very kindly started a thread here which details how far back different banks have been able to supply statements. For instance Abbey hold theirs as far back as 1926. Basically if they have them then they have to give them to you. They might try to deny they have them so you must include in your SAR sometheing along the lines of: A good starting point for claiming back beyond six years is here. skb
