  1. I Have now gone through the info supplied which is summarised below. There is unfortunately no info on my first loan which was opened in 1999 and closed in 2001. As the close date is within the 6 year limit for a SAR then i'll be raising a complaint if they dont produce it. Term 60 months Graduate loan 1. Loan amount £3500 - monthly repayment £70.76 Insurance amount £709.07 - monthly repayment £14.34 Total loan £4209.7 Total monthly payment - £85.10 APR - 7.8 % Term 60 months Start 16/11/99. Insurance rebate – Believe I did get one Insurance to claim back – 18 x £14.34 = £272.46 + rebate of ??? Graduate loan 2 - £2910 in cash and £3090 to repay graduate loan 1. I calculate that rebate should have been around £711.   4. Update: Well I asked for it and lloyds have certainly gave it to me. In response to my rather detailed S.A.R - (Subject Access Request) (post 5) they have sent me a nice liitle bundle of information. Comes to a wad of A4 printouts 3 inches thick. Is gunna take me ages to plow through it all. On a quick glance everything asked for seems to be there, everything from loan agreements to credit scoring info but not got time to go through it until after chrimbo. There are even copies of my prelim and LBA for claiming back unlawful charges skb

Hi special Im still waiting for statements and have had no response to my letter requesting them, im note gunna be able to file a claim until the new year anyway so am not in anby mega rush to get them, if I can find the time i'll give them a call to see if i can speed them up. On the lloyds front i've noticed that they seem to paying out on new claims a lot quicker than they have in the past but I dont hold out much hope of seeing any cash before february skb
  6. To be honset I dont know whether or not they can do it however I think they would find it very hard to defend such retaliatory actions in a court of law. skb
  7. As its only one charge and was for a measely 65p your best bet is probably going into your branch, phoning your branch and asking for it back. If they refuse then send them the prelim letter in the library section. Is this your first charge or have there been others, if there have then it may be worthwhile submitting a SAR and claiming them all back skb
  8. Hi 29 an Trolly There are several things you can do which may (or may not) improve your credit rating.   9. Hi Nat You can claim interest on the full charge upto the date of the refund. So on your spreadsheet keep everything the same with the following variation (for this i'll assume your using the simple version of vamps s/s) On the bottom line type Column B - Partial Refund Column C - Amount of refund with a minus sign in front (i.e -104) Column D - Date of refund Column E - Type nothing Column F - Delete the contents of this cell This will give you the outstanding amount and the amount of interest and the total owed. To calculate the daily rate of interest multiply the outstanding amount (not including interest) by 0.02 to give the daily rate in pence. skb

Something along these lines should do it They will then do one of two things 1) Recind their offer of £750 2) Give you the £750 and you then pursue them for the rest You can also keep adding charges to your claim right up until you file in court. Once you've filed your claim you have to pay to amend it (£35 i think) skb

  14. Was the £170 deducted from the loan?? If so id go into your bank and ask if the cheque is still valid, if its expired then there should be no reason why they wouldnt write you a new one or pay the money into your account. Its your cash afterall skb
  15. Have you submitted a SAR for the details of the loans?? To my knowelegde they have to retain all financial records for the last six years so they should have the details There is a good forum on this site all about reclaiming PPI http://www.consumeractiongroup.co.uk/forum/ppi/ Where there have been successes in reclaiming mis sold PPI, if you havent seen it yet I suggest it as a good place to start. I would suggest starting a thread in the PPI forum where you can get more expert advice. Miss selling of PPI may be the next big scandal to hit the banks and you may have a very good case for claiming it back. Im no expert on the subject (yet) but am in the process of claiming it back myself. Certainly the first thing to do is a SAR for all details regarding the loans. THe next step is a prelim letter requesting repayment of all PPi paid and any added onto the default total followed by LBA and court claim. skb
  16. Hi Craig The county court system allows u to calim 8 % interest on your claim. To calculate it download the simple version of Vamps spreadsheet and enter your charges with dates. the interest will then be automatically calculated for you. I strongly recommend that you include it as its yours by right and is more money in your pocket. If you do then remember to include the phrase skb

Hi Sadie, to answer your questions yes the interest will automatically calculate itself and yes enter the charges in the order they come in on your statements, in date order basically, earliest first most recent last. It doesnt matter that the time limt from the LBA has elapsed, its your claim you can take as long as you want. lloyds are a bit snowed under right now for some reason so its not unusal to not get a reply, besides you can a template of the letter they will send you in this forum - the usual fob off drivel. If you follow the guidelines for completing our N1 you wont have any problems skb ps remember to enclose the fee with your form (£120 for your claim) and take a couple of photocopies of the completed form for your records

Hi Sue, Ive only submitted my SAR for my loans with lloyds so far (am still waitng but have no response whatsoever) but am going to get the ball rolling with egg in the new year, I too have a nice £15K loan with egg, which fortunately doesnt have PPI on it. My egg card PPI ended up costing a fortune cos I had two of them (visa and mastercard) each up to there limits of £4100, I cant remember exactly but have a feeling the PPI was costing me around £40 to £50 a month on EACH card. Think it might have been a pound for every £100 on the card. Still the SAR will sort out exactly how much it all came too. To be honest I dont think it will be easy getting our cash back but im going to give it a damn good go. There is also of course the niggling worry that egg will retaliate and demand immediate repayment of loans but I say let em try it and i'll see them in court. Anyway keep us informed on your progress skb
  20. Hi TFD As you said accept the offer as a partial payment only, personally i would then complain to the ICO and write to bcard to get the pre 2004 statements. Then once you have these you can revise your schedule of charges and fire off a final LBA, taking into account the money already refunded. skb

  23. I beg to differ, Failure to supply the original document renders the agreement unenforceable not the debt. The contract is therefore no longer enforceable ie the terms of that contract relating to dates of payments interest rates and charges etc. I have however still received money from them which can be proved through my statements. Bcard is therefore entitled to recover that money in the law of restitution as oppose to contract law. If I was to stop payments they could, in theory, apply to the courts to enforce the debt. Also if at any time they were to come up with the contract the agreement would become immediately enforceable However as Bcard have gone past the 42 day deadline they are in default and have commited a criminal offence, this can be used as leverage to force an early settlement for repayment of charges, and is some cases (dependent upon the size of the debt) to 'write off' the outstanding balance of the card. An important thing to remember is that without an agreement their charges are completely indefensible so they wouldnt have a hope in hell of defending them in court skb
  24. Would appear that you can tally late payments from Credit file with charges but not exceeding limit. However given ICO ruling on bcard mfish would seem we can now get our statements. Must keep reminding myself to get round to complaining to ICO to make sure bcard cough up. 12 working days plus 30 calender days have now passed since CCA request for true copy of agreement without even a whisper from bcard, so they are now in default and have commited a criminal offence. Naughty little blighters.
