  1. If they overpaid you they would soon be on your back, do the same to them. Kick off and tell um you want your money back ASAP!!
  2. Also, If the Tories expect people to pay tax for a spare bedroom - then why don't THEY pay an extra £X amount for the 20 other unoccupied bedrooms in THEIR grand mansions or second homes. Fairs fair, right?! Oh i forgot, there not poor and not on benefits because there fiddling, thieving and cheating the system and grinding everyone down until they take every last penny from us and see us in the gutter.!!
  3. This is the first of many of what we know but to say it happened a week ago, I haven't heard anything on TV news about it? I might be wrong and just wondering if gagging orders might have been issued?
  4. Record everything on your phone when in the assessment as the person assessing you do tend to over exaggerate or in real terms lie and make your appeal more difficult..!!

What annoys me Oblivious is i no how hard it is to bring kids up when you have nothing to live on, i have been there and no what it feels like, i've brought 2 kids up on my own and not known where the next penny is going to come from and scrap every last penny to buy a loaf of bread just to give the kids some toast and had to steal potatoes out of peoples vegetable plot to make some chips for the kids just to survive because i had no one to turn to for help.. yes it were hard and god knows how i got through it but i did, but i get wound up when people dont understand how tough it is and they think its easy to live when you have no other means of money when you have a child to look after as well.! I wish you and your child all the luck and hope you get something sorted out real quick.. !

Think you might be a little bit out of touch Nystagmite as i am also on prepay meters for gas and electric the same as Oblivious and have to pay water rates every week as i have a water meter so at this time of year before i pay anything out i have to pay between 30/35 pound a week on gas, electric and water and pay even more in winter so i can understand where where Oblivious is coming from.!

I brought the child into it because of the simple fact is she as a child to look after and do you think that the tax credits and child benefit will keep her and her child for two weeks when she as rent, gas electric, water rates and whatever else she as to pay out a week let alone FOOD to buy then if you think she can manage to get by on that then i would like to no what planet you are on and what she would gets on tax credits and child benefit she would spend that alone on gas and electric just to keep them with light and heat.. so yes.. that's why i brought the child into it..!!! And i'm disgusted with it because its alight people talking and thinking its easy living in this day and age and you thinking she can get by on the pittance she would get on tax credits and child benefits and as she as had her benefit sanctioned she wouldn't get tax credit anyway and if that were the case she would only have £20.30 child benefit a week for her and her child to live on..!!
  9. I just cannot understand the law that they have the right to stop peoples benefits and leave them destitute and in debt and especially more so in your care with you having a child? I no its hard to bring your human rights into it and the law is the law but the more people who go down different routes and complain in stead of just excepting it then it could get highlighted to show how people are been bullied, intimidated and treated like a animal. I would advise everyone to complain to there MP, downing street, solicitors, CAB and even write or fax European Court of Human Rights. People have nothing else to lose so why not..! Glad you have got something anyway..!
  10. How on earth can they do that..? Is your human rights been affected here as it says in "Article 3: Prohibition of Torture" that the government should not withhold state support from asylum seekers because doing this would leave them destitute (penniless). Now i'm no expert on the human rights act but if the government wont sanction asylum seekers benefits then why should they do that to you and especially you have a child? You are going to be 2 weeks in debt as well with the rent, plus you will have to borrow till you get your money sorted and you dont no when thats going to be..! i can't beleive they can do this type of thing. I would try alsorts, i would get in touch with my local MP, email downing street and i would go as far as getting in touch with the european courts, yes i no they cannot do anything but i would still do it and get as loads more people from this site to write or fax them with issues about the same thing because they just cannot treat people like this.. its all wrong and i'm fuming.!! Two people last week as been thrown off ESA, one is as blind as a bat and suffers with angina and depression and the other is autistic and doesn't understand a word anyone says to him and cannot speak a word himself, and both need carers.! yes they are appealing but that's not the point.. this type of thing should not happen..!! I find it quite easy to grasp as I'm talking about the first time when she said "1 stop later the ticket man came and checked my card, and i had 40p less then the price" So when i said "WOW....! all this over 40p." she is already been taken to magistrates court for the amount of been 40p short so to me all these hundreds of pounds thats going to be spent taking her to court over 40p then yes, i'm sure they is a better way to recover the debt and incur a small fine rather than going through all that.? In the second paragraph she got caught over a UNPAID FARE but i were not on about that so no need to dis me man..!!

Let me get this right..! you have been issued with a court summons to appear before a court of law over 40p? and they wanted you to pay a £250 out of court settlement they wish to claim for you been 40p under the fare? is it 40 pence or 40 pounds? as i find this hard to believe that you could actually be served with a summons to appear in a magistrates court because as i see it, its not a criminal offence its a civil offence and if you have a summons it must be for a small claims court? how much all together on both times were you short and on the summons does it say magistrates court or county court?

I dont no how you can get to them figures as andy hasn't said how many days out of the two years he worked for the agency? all he has said is he worked " odd days here and there" now if andy said how many days he did work in the two years and how much pay he received then it would be a lot easer to work out and maybe not as serious but by the sound of it the DWP can prove he worked full time for two years and thats why they want the full amount back. The agency would have supplied all the information as to how long andy has worked for them so until andy says how long he as worked then you cannot even get a rough figure..!

To be honest i dont think it matters how much you dispute the 12 grand i think the main thing here is the word "INTENT" signing up with a agency is 100% odds on it were gunna come on top that one day you were gunna get caught working on the side as the DWP as always worked closely with the agencies since the 80s since it were called the DHSS. Now i'm not aiming this at you personally and i dont blame anyone who wants to earns a few quid on the side to put food on the table for the kids to survive because we all no that living on low income is hard and i would always turn a blind eye to something like that but if someone wants to take the **** and earn money on the side because they want it for other things like drugs and alcohol then there is a line? i'm not saying your like that but i just cant understand why you thought you could keep on claiming benefits while working for a agency you wouldn't get caught? I think you need to prove If your a genuine case that you did it for your kids as otherwise you would not have been able to afford to live but like i said, they will try to prove the word INTENT which means you knew exactly what you were doing claiming the benefits whist working?

It sounds like they have all the evidence from the employment agency as to how long you have been working and receiving benefits and i think you will struggle to prove you've only worked "odd days here and there". The £12.000 seems about right to me that they have paid you in two years, that's benefit for you and housing and council tax benefit as the benefit for a single person comes up to £3510 a year alone and then add the rent and council tax on for the two years so i think its about right..?

  20. @ErikaPNP It is true. she were young and have never heard or experienced anything like this before, she were in shock just at the thought of going to such a interview and when i said she were "ordered to a interview" basically they said if she didn't attend then her benefits would be stopped, so whether she liked it or not she had to go! When you've never experienced or heard anything about the laws regarding who can stay and who cant whilst your on state benefits and then get called to an interview that you dont no what the hell it is about until you get there can be quite petrifying especially when you think you have done nothing wrong. The interviews that people have had that i've heard about have not been professional and a lot of things get said on home visits that cannot be proved..!!

I know of a young couple that last year they split up and the boyfriend went back to live at his mums while the ex girlfriend lived at the home with her two kids, as always like kids do they got back together but he still lived at his mums but also stopped at his girlfriends maybe twice a week and thats all. a few weeks later he finished with her again and got a new girlfriend and never bother with his ex but just saw his kids through his mum. three months later the young girl were ordered to a interview as someone had said her boyfriend had been living there, he didnt live there but like i said, he stayed a couple of nights but not every week, she were questioned for over an hour and half saying that they had prove that he had been living there, she continued to deny it as it were three months back and didn't want to drag things up by involving the ex boyfriend so she just kept her mouth shut, they did use scare tactics and told her that if she didn't admit he "LIVED" there they were going to stop her benefits including housing and council tax benefit and were going to ask the council to have her evicted. after that she told them that he had only stopped a couple of nights and that were all as that were the truth, now just because she admitted that they didn't believe her and wanted her to admit to him living there all the time. she ended up crying and were in a right state so they finished the interview and told her they were going to investigative her more and someone would be coming out to see her. After that she couldn't go back home as she were petrified just in case even any of her friends called round as she thought she could get into trouble. because she is young they took advantage and proper scared her to death and within 2 weeks she went private as she feared she would lose her council house. a few weeks after she were visited again by the investigating team and made her sign a statement saying that if her boyfriend or anyone else stays at her home and she fails to tell them she would be prosecuted, fined, made to pay back her benefits and possibly jailed.. ! A lot of people may not believe this but its 100% true..!!

IF..... and it is a IF, they will reckon up how much you may have had over you should have and then have to pay it back at so much a week but if it runs into thousands then it could be a court job? if your ex is a working man and as been living with you they go heaver on that because of the housing and council tax benefit they have been paying for you? But remember, if they cant prove anything they will try and force you into a admission but if you haven't done nothing wrong then you dont admit anything no matter how much pressure they put you under?
  23. You can pay any bill through anyone's bank account with there permission of course. Just explain what you have said on here but i would not tell them that he as slept at yours at any time but thats up to you because if you did it just makes them think he as been staying all the time and just might complicate things.?
