  1. As far as I know you were merely given a "ticket" and Fixed Penalty Fine. You would have been read your Rights (under caution) but you weren't given an Official Caution which is given by a Senior Officer at the Police Station when you admit an offence which would otherwise face prosecution (Public Order offences, etc). I stand to be corrected .....?

  4. Banks are desperate for any cash at the moment but don't let them think the F&F is from your own money or they will keep pushing.If you genuinely have nothing (& no assets) just offer what you can afford each month. Could you explain the "42 days" with AMEX?
  5. Can you rent the place for a while & stay with family/friends on the cheap while you catch up a little? The tenants will probably cover most of the mortgage as well as all the bills.

  9. I think they are making it up as they go along. Nearly every sheet has multiple staple holes in it. I think they swap the paperwork around to suit whoever is writing to them. If you read their statements regarding CCA obligations they are probably correct but are answering a different question. " I enclose the necessary documents to demonstrate a fully executed agreement under s.78 of the CCA 1974." Yes, you have but the one original page that I have signed doesn't seem to!
  10. That's an interesting one - wait for Mr Shed ! So you are saying that - in effect - because you are paying the landlord you are still renting the place? If you were you would be liable for all the associated expenses (rates, etc) but I'm not sure if you could ask for the second rent to offset the losses LL thought he was going to suffer upto the break clause?

  12. Hi NH Sometimes it never rains but it pours. Hope your mum is ok.You concentrate on getting her well - you might be suprised how quickly she mends. When you are at the hospital just think about all those folk in there who would gladly swap places with any of us if all they had to worry about was money!
  13. I'm pretty new to all this SE but I thought a copy of the disputed contract (loan agreement, lease,etc) had to be served alongside the summons form? Maybe it's not obligatory - I'll bump it for someone more experienced to have a look at for you.
  14. Just re-read the thread (apologies for being half asleep!). Was a full copy of the agreement not attached to the court paper work they served on your mum?

Hi SE My thoughts would be that the missing 2 pages would be required to comply.Were the first two attached together (stapled?) etc & wonder if the tea boy lost them on the way to the post room or are they totally lost? Is the signature anywhere on the first two pages? I would query that part. They only need to supply a true copy of the original agreement (with prescribed terms,etc) & I think you would need to SAR to get all the later paper trail.
  16. HI FF Glad you are using P/O to avoid giving signature & I wouldn't let them have your debit card details either (just in case they fancy a self-service;)). If the card is that old I would think you have a good chance of seeing.............nothing.Hopefully that will be the last of the payments till they comply. Can't help re:SAR haven't got that advanced yet lol.

  18. Next time just park something big in the gate-way. Then it's a civil matter if they want to retrieve their van. Quote the man in the Hoover Free Flights offer case: When he didn't get his free flight tickets he called out the Hoover man to fix his washer & then blocked his van in saying he could have the van when they spun for the flights.

Not for the money but you have to be able to play everyone else's hand as well as your own.I've only been into all this CAG stuff for a couple of months but I think you start to get a sense when they are struggling & flanneling. As I said with mine they just went into overload - "you've been quite happy upto now" letter, tons of T&C, big shiny new agreement,BOS threats, so at the moment I'm treading water until I can afford the tenner to SAR them! Unless things change I am happy to call their bluff because if they were holding "Pocket Aces" they would have upped the stakes by now.

Sorry JM I did say to double check but I thought I had read on CAG that you could claim interest on these illegal charges (prior to the court interest) as someone mentioned the 8% and another added that you could claim 8% or the relevant interest rate that you were being charged by them. (Or am I confusing credit cards with bank accounts?)
  22. When you say "new" CCA do you mean another ie repeat copy? I asked this question on my own thread but never got an answer. I would have thought that if a S.A.R - (Subject Access Request) covered everything they held on you then they should suppy another CCA but they may say that you have already had that one.Not sure. Their reply doesn't really add up as it's "too much".It probably covers their responsibilities under CCA but they may be answering a different question. Can't understand why all my papers from them are covered in (fresh) staple holes? Even the single photocopy of the Signature sheet???

At the point where this account entered into the default situation as described in s78 (6) CCA 1974 no other charges are allowed to be added until such time as HBOS become compliant with my request. As HBOS are still not in compliance with my request I insist that the following takes place with immediate effect All charges levied since (DATE) be removed from the account and further charges cease until such time as HBOS comply fully with my original request or such time as a court makes an enforcement order. All entries which refer to missed payments be removed from my credit file All collection activities by your company cease with immediate effect until HBOS comply with my request from (DATE ) received by HBOS on (DATE); or such time as a court makes an enforcement order In addition, I draw your attention to the Office of Fair Trading’s guidance on debt collection The OFT guidance which was issued July 2003 (updated December 2006) relating to debt collections and what the OFT considers unfair, I have enclosed a quote from page 5 of the guidance which states : 2.6 Examples of unfair practices are as follows: h. Ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment Clearly your pursuance of this debt falls into this category.
