The 8 page doc. has just been put together since we took out the cards - mine features my current address not my the address 4 years ago.It just demonstrates what we should have been given. Not sure about your second form as it is more detailed than mine. I'm not experienced enough to say if it has all the prescribed terms or not. -

Q for Mr Shed or ONL How would this situation normally be resolved? As I understood it (certainly with an AST) once there are a certain level of arrears (usually 2+ months?) the landlord is entitled to issue Notice and terminate the agreement early (at the end of the Notice period). He can then claim for rent upto the end of the Notice period + any arrears + possibly interest but the Agreement is then terminated and no further obligation exists with the tenant. Is this not correct?

Just had another thought. As we all have the same front form with different reverse side featuring Important Financial Information. If it is a "true" double sided form on the original then that would mean that they had to get the whole lot of forms re-printed every time the interest rates on the back changed! Would cost a fortune but it's either that or having the tea-boy print them off their own computer quickly enough to keep up with the credit card orders.

Presume this is part of an 8 page epic with a (hopefully unsigned) signature box on Page 4 ? Are there by any chance extra staple holes showing on that top left corner? ps you might want to hide the card number on the first pic. -

Good point Mr S. As a s.21 Notice should not be dated to expire on or before the last date of the tenancy then maybe that is the case? BB what is written after "section 21" does it say s.21(1)(b) or s.21(4)(a)? It would help if we could see it (after covering personal details but please leave dates). -

I agree with PD - don't phone them as the numbers charge upto £1.50/minute. No doubt they will give you the run-round for 10 mins whilst you are calling.They probably use auto dialers of every number combination until they hit one which dials & then log this as a "live" number. -
Just had an awful vision of the bailiff with his kecks down being perused over by SOCO with a large magnifying glass.Any volunteers uurgh. Plenty of inocuous sounding signs,leave any valuables neatly packed ready for stealing & make sure the Dobies hand the bailiff or burglar a Business Card from a good no-win-no-fee solicitor before biting them. Welcome to Britain (and hopefully very soon you'll be welcome to it).

Hi SE I'll bump it again as I can't help on these points. I have read that you can acknowledge receipt of the court papers online & extend the time for the Defence to go in but there is a time limit.Please check. -
Hi LNW If the rent was over-paid how are you 4k in arrears & how have they allowed it to build up to that level? If the HB over-paid the rent surely it would be due back to them & up to them to re-claim from the housing assoc.? Can you not cancel the authorisation that pays it directly to them? As I said earlier, it becomes a point of principle & starts to take over your life.But principles can be expensive and it costs lots of time & money when you can now look to start a new life elsewhere. I wouldn't throw good money after bad if this has been going on for years.

The rent arrears are a red herring as they will have no bearing on a s.21 route.(It is not an Eviction Notice). The only defence you will have at court is if the paperwork is incorrect. -

I think it has to go through a public auction but obviously at the moment nothing is fetching any money. To be fair mine went in the spring & fetched a lot more money than I expected so fingers crossed. -

I'm not sure - cant get my head round the wording yet as it doesn't state which anniversary: Either LL or tenant can issue 3-months notice “with notice being served on or before the anniversary of the tenancy commencement after the first 6-month period”; -

I would say the Notice was invalid : Mr Shed is the man to confirm. If your rental period is the 6th - 5th then they cannot demand possession of the house on the 5th. It has to be a day after the 5th because you are paid up until the 5th (assuming the rent is paid obviously). It's like saying you are going to get fined for your tax disc being up on the 31st.You can't be fined until the following day. Having said that it depends what you're plan of action is? If the above is confirmed then needless to say DONT TELL THEM about the mistake or they will simply re-issue Notice. If you were feeling brave you could tell them in December or even sit tight until it went to court.Depends if you want to stay there or not? -
Hi LNW Just had a quick look & will come back later. My first thoughts would be to use the 10k when it arrives to get yourself out of there & make a fresh start.Concentrate on that & maybe find a private LL ? I had a constant battle with my last LL but you've got to remember that the people you are dealing with will still pick up their money every Friday regardless of how upset you are. You can start the ball rolling by getting up to date statements but don't let it bog you down from the main event of moving. If you see there is light at the end of the tunnel then you will feel brighter as well. You will need to do all the prep work before you receive any money as I presume "they" will take this into account when assessing your benefits?
