That letter looks OK, but don't expect LTSB to cave in. They'll stall, lie and mislead incessantly. I'd also consider complaints to the OFT, and the FOS as well. Again, nothing may well get done about it, but it'll aggrieve the bank and that's enough reason for doing it. LTSB deserve it.

They have to fulfil your request before commencing action of any kind. Wait and see what they turn up. If your request is fulfilled, and it's MBNA, and it's a pre-2007 agreement, chances are it's unenforceable.

It may help if you quote the exact section of the UTCCR. In this case, it would be Section 2083, Schedule 2, Regulation 5(1e), which states ' requiring any consumer who fails to fulfil his obligation to pay a disproportionately high sum in compensation'. This is the passage of law that specifically applies, as LTSB will no doubt need to be reminded. Their staff don't know their ar*eh*les from a hole in the ground, as has by now been amply demonstrated to the British public. Take it from me, LTSB will try any and every fob-off excuse under the sun. Why this bank wasn't left to flounder into oblivion is a complete mystery to me! Bear in mind that it's managed to haemorrage staff, alienate the entirety of the Islamic community, be caught breaking international sanction law, aggreived the Competition Commission (which looks as if EU Intervention will be becoming involved!) And this is all in the space of a few months! The nerve of this bank for needing a £17 billion bailout - banks are shameless, and this is the worst of the lot! Still, under this government's control, it's doomed, so there's some consolation there.

If last payment or written acknowledgement was May 2003, it's statute barred and nothing can un-statute bar it. No payment or admittance of debt should be forthcoming. Send off the statute barred letter, then forget about it.

A squashed doughnut with plenty of icing sugar seems the only choice, postggj. DCAs love sugar - they drop everything they're doing and take a day off work to focus on the sugar. A bit like ants, really. -

Sorry Kraken1, and with all due respect, I don't believe you are correct on this. DCAs routinely 'trade and swap' information between themselves. I can categorically state - just for the sake of an example - that MacKenzie Hall receive details from First Credit. And then in turn, companies like Lowell and Meritforce receive it in turn from MH. MH and Meritforce, since they amalgamated, use the same computer system, and I know this to be fact. So yes, I can well believe that the CSA (look who forms it!) is circulating such information among its members. -

A CCA request will stop AIC taking any kind of adverse action. However, this won't stop the automated silent calls (when are AIC going to get fined for that?), though after you get about two or three of them and not respond, they'll stop. If they phone and you do get a human on the other end (used in broadest possible terms!), refuse to confirm or discuss anything with them. You don't have to justify/explain/excuse or tell them anything verbally besides 'In writing only!'. -
Don't be surprised if they try it on and mock up an agreement. In response to a CCA request sent to AIC before, he got a letter from AIC stating the agreement was unobtainable. Then, it was a bit of a shock for him to receive a Credit Card CCA (he's never had a LTSB Credit Card) with his signature on, but all other details completed by two separate people. The date of birth is unclear, and the phone number completely wrong. LTSB aren't above dirty tricks - but then again, being found in possible breach of UN Sanction Law (as they were caught out doing in January this year) isn't above them, either. Ignore. Meritforce are bottom feeders. If anyone shows up, photograph/video them, then report them. If you haven't authorised such a visit, then it's not an authorised visit.
