  1. Hello. I'm back again! Today i've received a letter from the court for a " Notice of Proposed Allocation to the Small Claims Track". Can anyone help me fill the form in. Not sure what to do Thanks
  2. There was another page that I have just uploaded. Don't know what happened first time! How do I get the money back from the bank? I paid it on Lowells website.

  4. Reply to the CPR 31:14 I sent them. Along with all the information asked for it says that if a settlement cannot be reached it is likely that they will make a claim through the county court. Its the Directions Questionnaire that worries me as i've never seen one before and unsure what to put on form.
  5. Today I received a reply from Lowell with information requested. I also received a copy of a Directions Questionnaire which they have lodged with the court. Do I reply to this when the one from the court arrives?

  7. Hi Thanks for answering. I haven't done anything yet as wasn't sure what to do. Still living in the same house but haven't claimed any benefits for 8 years. Should I contact the council?
  8. Hi Don't know if this is the right place but wondered if anyone could help me and let me know where i stand. Today i received 2 letters from my local council about overpaid housing benefit . First one is for £366.90 from 2005 and the second for £241.77 from 2008. As these are both over 6 years old do i have to pay them?

  10. The court said it fine to file a defence, Have filled out the form for you to look at. Particulars of claim 1) The Defendant entered into a consumer crediticon act 1974 regulated agreement with Provident personal Credit limited under account reference 1325023 ('the agreement'). 2) The Defendant failed to maintain the required payments and a default notice was served and not complied with. 3) The Agreement was later assigned to the Claimant on 29/08/2014 and notice given to the Defendant. 4) Despite repeated requests for payment, the sum of £1,395.00 remains due and outstanding And the Claimant claims a)the said sum of £1,395.00 b) Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of the assignment to the date of issue, accruing at a daily rate of £0.306, but limited to one year, being £111.60 C) Costs 1. The Defendant contends that the particulars of claim are vague and generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 2. Paragraph 1 is noted. I have in the past had an agreement with Provident but do not recognise this specific account number or recollect any outstanding debt and have therefore requested clarification by way of a CPR 31.14 and section 77 request. 3. Paragraph 2 is denied. I have not been served with a Default Notice pursuant to the consumer credit Act 1974. 4. Paragraph 3 is denied. I am unaware of any legal assignment or Notice of Assignment pursuant to the Law and Property Act 1925 Section 136(1). 5. the Defendant sent a request by way of a section 77 pursuant to the Consumer Credit Act 1974 for a copy of the agreement, the Claimant has yet to comply and remains in default of said request. 6. A further request was made via CPR 31.14 to the Claimants solicitor requesting disclosure of documents on which the Claimant is basing their claim. The Claimant has not complied but has stated a general extension of time to retrieve the documents, to date nothing has been received. 7. It is therefore not accepted with regards to the Defendant owing any monies to the Claimant and the Claimant is put to strict proof to: a) Show how the Defendant has entered into an agreement and; b) Show how the Defendant has reached the amount claimed for and; c) Show the nature of the breach and evidence by way of a Default Notice pursuant to sec 87.1 CCA 1974. d) Show how the Claimant has the legal right, either under statute or equity to issue a claim. 8. As per Civil Procedure 16.5 it is expected that the Claimants prove the allegation that the money is owed. 9. By reasons of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.

  13. Ok. I tried to log in using the password etc stated on the letter but it won't let me and yes its for a Provident loan.
