They have silly names in the industry to try & intimidate people... Mr Brown & Mr White are the most notorious. I suspect they have a Mr North,South,East & West now Anyway..if you are adamant that you owe nothing on this account, then i would kick up a fuss & report them to every authority you can think of

So now what will happen is that the newspapers will report what has happened & make out that the consumer has been defeated & everyone now suddenly has to pay up Anyway..i believe a new "UK supreme court" has been set up recently - so it will be interesting to find out how they would rule -

Mr Justice Flaux ruled: “Although the Consumer Credit Act may render the agreement unenforceable, the agreement remains a valid and subsisting contract and rights and obligations under it continue to exist”. Mr Justice Flaux is still saying that the CCA renders it UNENFORCABLE. This high court decision has simply created yet more problems for both sides & done very little to clarify the whole thing. -

If the industry think this will change anything then they've got another thing comming. It only takes someone to appeal the decision, have it overturned & then the cat will be back amongst the pigeons. As far as im concerned..its business as usual -

Yes, just send 1 final letter stating what is what/how it is etc....& then leave it at that. No doubt you'll get more begging nonsense sent to you, but once they see you are sticking to your position they'll soon get the hint.

Once you get the hang of these DCA's..you soon find they are a walkover & you'll soon enjoy playing games with them

They can try & spin their way out of it all they want, simple fact is....no CCA = no enforcable debt = no more payments = end of. The payments you have already made can quite easily be thought of as a "gift"

You are under no obligation to pay these clowns anything anyway - you are only doing so as a result of BCW threats i suspect. If it went to court, then chances are you'd end up repaying £1 per month if anything at all - after all your outgoings are taken into account. If they ring, then refuse to answer security questions, thats the golden rule. BCW dont do court anyway - they only threaten it.

OK, fair enough, but dont expect to get shut of Lowells easily - they will now see you as nothing but a cashcow. I will leave my contribution towards this thread now...best wishes whatever happens....

I have had a CCJ in the past & i can honestly say that it made no difference to my quality in life in terms of getting credit etc... I was still approved for things afterwards. Im not suggesting thats the situation for everyone (before anyone bites my head off again)....but i do think there is alot of myth surrounding CCJ's. Remember, it wasnt that long ago that everyone thought that DCA's had powers over the individual

I bet they think that changing the colour of their envelopes from time to time will somehow make them seem more threatening & have more authority
