i bought my car from carcraft in feb 2010 when i was 19

its a fiat punto grande on a 56 plate and 15000 miles on the clock

it cost £7000 in the showroom which i thought was a little bit pricey but i wanted/ needed a car.

 

when buying the car i was told that black horse was financing the car and a second company was financing the warranty and other extra products.

these included smart protects, gap insurance and so on.

 

after a couple of months i tried to use the smart protect plus to repair some scratches on my car which turned out to be an insurance company

and such which was not explained to me at point of sale.

after complaining and badgering the extra products bar the warranty and the gap cover were refunded due to being miss sold.

 

after looking into handing my car back it became apparent that black horse had financed most of the car and the warranty

and all in one turned out to be a personal loan that financed a deposit and the gap cover.

this has put me in somewhat of a financial bind as i cant had the car back with out paying the warrenty in full

and a shortfall on the car ££££ as well as leaving me with a personal loan

i didnt want and under the belief it was a hire purchase agreement.

 

after making a formal complaint to carcraft about this issue

they have told me they accept no responsibility for this as ive signed the paper work.

 

my citizens advice office was quite helpful in pointing me towards trading tandards and so on.

 

im very disappointed in carcraft, they have taken the word of a sales rep who cannot recall the transaction

and so and my complaint has been rejected.

 

any ideas on what i can do?

warranty, why, not needed reclaim it.

 

sadly this pers loan trick is quite common for the two co's you mention.

 

you can contact trading standard/oft via consumerdirect site.

according to black horse i cant have it refunded because ive had the benefit of the warranty.

im not sure how beneficial it was as they haven't paid out on two separate occasions

and tried to invalidate it once on a servicing issue which was wrong on there part.

who the hell are they to say that.!!

 

benefit my foot

they are just trying to put you off.

 

even if its been used, all you do is removed what they have already spent from you reclaim total.

 

just harkign back to the first post

 

if it was an HP agreement it would have had

HP agreement written across the top

this hasn't i take it?

 

so if the car is not mentioned on the personal loan

its your to do what you like with.

 

me thinks they saw you coming.

 

i wonder what our carcraft rep will say about that rather offish answer from another collegue.

im personally quite surprised they put it in the rejection letter in such a care free way

no it does say personal loan which wasn't correctly explained to me at the time.

yeah they did, 19 with out my parents i got robbed

so, why are you trying to hand the car back?

and you indicate you've had issues with it?

 

like it went wrong so is now a useless heap?

and they would not repair it

the car is in perfect working order, but i find it amazing that a car with less than 30000 miles

can need a new radiator, clutch and gearbox with in the first year of purchase.

 

i want to hand the car back because it simply cost to much a month

and would like to move on to something else.

 

this is where im having a big issue,

because its been miss represented to me at point of sale it will cost to much to hand back (2200)

 

with a settlement figure of 5000 and the personal loan of 1500. (not exact numbers)

 

but obviously the car is not worth keeping until the end of the agreement as its only worth £3000 at best now.

take away the warranty loan etc etc

on the CAR finance

what do you owe and how much have you paid

 

is the car not mentioned AT ALL on the agreement

sometimes it IS.

 

in the T&C is the level sof payment mention

like after 1/3 you can

after 1/2 you can.

its a punto active with 51000 miles on it.

it may cost 4.500 in a showroom

but thats not what ill be given by a dealership.

ive had the car valued previously when looking at trade in.

its not worth trading in even against a car worth 3 or 4k because of the negative equity.

but obviously the termination fee is extortionate as well being around 2200.

update:

 

call black horse today, my termination figure is £540

and i can cancel the insurance/ warranty and not pay it.

they also said that the warranty/insurance was added

after the day of sale with in a 30 day period.. and so didnt not

show on there system when i first called them.

surely this is illegal to do this?

little update:

i have given all my paper work to the solicitors

including complaint letters basically everything

and anything ever given and received to look over.

 

guess im just sick of being fobbed of and lied to because im young.

let somebody who knows what there doing sort it out.

lol

my next door neighbour it repair/ paint technician

after about a month he pointed out that the car had been repaired.

the whole right hand side had been filled and re-sprayed including

new wing, door and rear quarter panel.

not declared on hpi but i noticed it had 2 mots in the same year.

not felt comfortable in it since.

only just seen this, is it a legal thing where if they allow you to cancel it they have to let you reclaim it?

or is this just in certain cases?

you didn't have to have it in the first place!! they spoofed you...
