      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi. luke. it is not 7 days it is 5 or in some cases by that **** the next day. you need to call into your police station and talk with them and ask them why they got involved and that you have lost your car because of them. also print off as much as you can from this site and also from office ot fairtrade site. ask them why they let them take your car without a court order and be firm with them (they were at fault)

now as far as your payment

you called logbook loans ltd this is not nine regions ltd (same directors) but differant companys.

you need to talk with

My car was repossessed yesterday by Logbook loans.

 

Ive never even had loan with Logbook Loans!

 

The loan was taken out in 2008 by someone who owned it 3 owners ago and because she didn't pay it they've hunted the car down to me who brought it in April this year and yesterday they towed it away!

 

How ca these cowboys think that this is acceptable?

 

Ive lost my car and Ive lost the £1100 I paid for it.

 

What can I do???? Logbook loans on;y responsewas to offer to sell MY car back to me at a cost of £998!!!

Hi lady bird. you are just another victim of logbog / nine reigions ltd. the problem is they resell your car as fast as they can. (they can sell after 5 days) so by the time you have asked them for all the paper work to see if it was there car. your car will have been sold anyway. were did you buy the car from ?? did you hpi check ?? and how old was the car

I bought it from a private seller who, having spoken to him yesterday, also had no idea about the outstanding debt. And I was stupid enough not to have a hpi check done!!!! It was only a V reg peugeot which I paid £1100 for but ive now ot no car and no £1100!!! What can I do?!

to be honest if lbl hold a bill of sale for that car then you have lost it. but you can check with logbook loans to see if they have been in contact with the guy you bought it from. and if so you can claim though small claims court to get your money from him.....DO NOT BUY YOUR CAR BACK FROM THEM they are **** and will only take your car again in 5 months. a bill of sale is very hard to fight and if you still had the car then it would have been worth it. but with no car you will be wasting your money.

with not doing a hpi check then there is not much you can do.

now you will be looking for another car, there is over 1800 cars out there attached to a bill of sale and not all show up on hpi. always involve a solicitor when you buy your next car it will have a cost of around £150 but it will give protection if you get into a problem like this again. 1 more question were did they take the car from. driveway/private road/ work place ???

The took the car from outside my house, the houses on my street have like a joint drive way which we park on just in front of our front gardens. But they toldf me that if it was behind locked gates they could have taken down the gates to get at it!!!

if it was parked on a drive way (not the street) then they would need a court order to remove your car. so if it was on your drive you can report it as stolen. see what your local police say. have you had any letters from lbl ??

be it parked in the street or on your drive, this is not a hp agreement

 

its secured by a bill of sale AND THEY CAN TAKE IT OFF A DRIVE.

 

HAVE YOU SEEN THE BOS WHEN THEY TOOK THE CAR

 

CHECK WITH THE HIGH COURT TO SEE IF ITS BEEN REGISTERED AND MOST IMPORTANT

 

WHEN IT WAS REGISTERED

 

IF NOT WITH IN SEVEN DAYS ON SIGNING THE CONTRACT THE BOS IS INVALID AND WHAT LBL HAVE DONE WILL BE THEFT

 

MOST CARS SECURED BY BOS ARE INVALID

no there licence is fine for both logbook loans and nine reigions ltd.

as far as taking from drive. yes from a third party (not name on bill of sale) they need a court order.

OFT may revoke LBL's licence Following an extensive investigation by the Office of Fair Trading, the OFT have now issued a 'Minded to Revoke' notice to Log Book Loans Limited and Nine Regions Limited, both of SW15 2NN.

These companies can now make representations to the OFT and there is an

appeal process, so it may be some months before we hear the final outcome.

no it was not suspended (wish it was) it was stopped by appeal. and if people dont keep on reporting them they will win. (its up 2011)

about the court order it is on the oft site (amendments to bos) that a third party has to be told by a court order that the goods are held by a bos document before they can be removed.

ime now checking that out and if correct ladybird need to demand the return of the vehicle or issue an n1 claim form

  • Wrong consideration (meaning the amount repayable is stated rather than the amount borrowed)
  • Failure to state the rate of interest
  • Incorrect payment details
  • Not registering the bill in the High Court within the seven day time limit

If the bill of sale is void for not being in the statutory form, it means that the credit agreement is unsecured.

Hi Guys,

LBL license has been revoked I am dealing with nOFT as we speak.

They have lodged an Appeal, they are still allowed to trade untill the HC rule. The OFT are as we speak still putting their case together to challenge their application. Anyone who is having problems with LBL need to call OFT there is an appointed case worker handling all complaints.

Look on the front listing were LBL can be found and follow the links it gives full details.

Hi

The main thing with BOS is the attestaion. the amendment allows the rep of the company to whitness it. This is were they try to confuss us. Yes he can, as long as the same rep doent sign the CA then he becomes a party to the Bill.

LBL only have two sign borrower and lender, this is not correct there needs to be three people present the borrower the rep for the lender that puts together the credit agreement and signs it and then another person to whitness the borrower and the lender sign.
