      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi ppl, im a noob :D

 

but none the less im in a position i need dealing with.

 

i hope this is the correct section for my post as the forum is huge so thought id take my chance here in the `halifax` section as thats the bank im with.

 

 

heres my story::

 

i made a purchase through paypal and the product was received. 4 days later i goto my bank and draw £30 out. a week later i get a £39 charge saying the money wasnt in my account. apparently paypal applied for the money after my purchase was received. i telephoned halifax and they refunded the £39 (upto 7 days)but in the process of them refunding the charge the direct debit from paypal was applied for again & so the bank chrged me again making the original refund go straight back to them plus the money for paypal not being in there!!

 

im currently on sick benefits and dont have pennies to throw around to xxxxxxx corporations, on top of this im a single dad and because of certain laws i get zero help financially on top of £55 sick benefits making life a struggle as it is.

 

i would appreciate any guidance in the process of claiming back my charges. im so angry with the halifax taking the p**s with me and playing god with my life as though blair himself doesnt do a good enough job!!

Let me just say that the Halifax have more claims than anyone else and are paying them out.........BUT to those who know what they are doing.

 

Granted you are a newbie but everyone who comes here for the first time is also a newbie......and many have gone on to claim and even stick around to help other newbies later.:)

cheers mate, ive fully read FAQ & various other parts of the forum to get myself semi-clued up on what im doing. im fully serious as theres plenty of others charges over the past few years.

firstly, thanks for looking.......

 

 

i received all my data from halifax with all statements quite promptly.

 

i sorted all my charges out(not much really,under £300)

 

sent the listed charges along with the letter requesting charges be repaid.

 

...........................

 

Today(28/6/07) i received a letter sating they have investigated and that the charges were correctly applied(as expected)

 

they then continue to say that it was part of terms and conditions and that i agreed when opening the account(i was under 16 when i opened the account. a minor?!)

 

and also go on to say that these charges are applied when insufficent funds in the account to cover a payment.

 

they also say about guidlines on credit cards by OFT(i never had a credit card but was in the standard letter i printed from template library) and that i dont have an account they will not comment.(did i send wrong letter? or just an added bit that i didnt need?!)

 

continue with they will continue to charge me should i carry on managing my account in this manner(under £300 in 6 years :confused: )

 

 

blah blah blah we decline your request for payment of fees.

hopefully this is all correct and the next step would be to send letter 3 in the template library offering a further 14days of thought on the matter before legal action.

 

so need to know if that is correct?

 

sorry if i waffled on a bit, but am sure you can understand any slight error may mess the situation or allow it to dragged on.

yes carry on send your letter before action just another fob of letter stick to your plan not thiers good luck

with letter 3 in the library being ignored/no response. whats my next course of action?

 

can some give me a basic run down either on here or VIA PM.

 

ive been confident upto now but dont want to mess up by sendi8ng wrong letter or sending a letter and not doing the correct thing i.e. courts etc.

 

 

today was the deadline for the letter, ive got drafts of all letters on my hard-drive.

read that but am still unsure TBH.

 

im single parent on benefits so seems ill have to fill in other forms correct? so that will allow exemption from fee's?!

 

i have not had a reply from the LBA letter and I would really really appreciate it if someone could run me through this.

 

filling form online, exemption cant do it.

which forms and when?

who do i contact now?

 

im really lost and putting up links is helpful but not really solving the situation. as you can imagine id like to keep to time scale as close as possible but without a run through i feel its going to take me a week to go through all the info and then try to understand and get it in order.

I see youve had no response to your LBA.

 

Next step is file your claim either by mcol or local court

You'll need to get an N1 and fill it in together with your POC (particulars of claim) and include your schedule of charges as well . It is now you can claim the 8% inthe alternative.

 

Once you have done this you will get a reply off the court telling you the date it was Deemed Served on the bank .

They now have 14 dys to respond with an Acknowledgement , which the court will write and tell you about.

 

Dont worry if they do File one as they very rarely Defend.

 

They have altogether 28 days from when your claim was Deemed Served.

So if it was served say the 10th Aug then you give them till 9th Sep ( are my maths right).

 

If no responce then you go for a Judgement against them.

 

Youve got a little way to go yet but this will let you know what to expect.

about the interest, do i add 8% on the total charges? or is it a % per year????

 

just want to make sure it is correct figures when applying.

Our posts must have crossed. My daughter is on benefits too and she filled in a form in the Courts

 

Be prepared to give them idebtification and you'll also need proof of being on them and which one .

She had to go to the local Job Centre to get a letter of confirmation off them . Also make sure they check it for you at the Court as she didnt know she had to fill in her incomings and outgoings on the back and hers was sent back to her, delaying it another wk.:)

18-04-2007--Prelim sent.

20-04-2007--Reply , Thanks , give us 8wks letter.

you might already have these links but i put them here just in case

the form for exemption is the ex 160 you need a recent copy of a letter of the beniefit your on

you can save the mcol online but the n1 will not save you have to fill it out and print it of hope this helps
