Cheera guys, i found the test case thread and had a quick read although it doesnt make things very clear but then im sure the case has been looking rather vague in the past. many thanks for your replies though guys. was thinking that if i ignore the situation long enough the banks would also ignore the situation. just felt a little un-responded to. many thanks and may the force be with us all tomorrow.

Hi all again, I filed to claim my bank charges back around a year ago, i got to the stage where the courts send out an order of stay. that was nearly a year ago and i have nothing from no-one regarding the situation. i know they was going through the court case which i thought was being dealt with in february butn ot were are nearly in may a year later and am getting no feedback from my banks or the courts. when i ask at my local branch they act all thick as though they dont have clue(and in all honesty they probably dont have a clue) so what do i do? who do i contact to find out what stage the situation is at? i think a year without any contact or response is being reasonably patientwithin myself. any help or comments would be really appreciated.   4. read about 'ROA' a while ago, after id sent the claim in which was around this time last year! all the paperwork went through before i got the knowledge about the ROA. all said and done the case got stayed and am happy to await the outcome but am guessing as always i gotta chase this up. So, theres is a huge court case yes? involving the banks? and no-one here knows whats going on with the case or the claims?

  6. Have had a search round the forum but with so much information and so many sections id be here all week looking for an answer possibly. I claimed my charges back last year but got put on a stay, didnt want to chase the stay to get it lifted as id thought id be patient, which i am being so far. also all monies taken were whilst i was on benefits but wasnt aware that the banks/courts should of known about this when i originally put my claim in. i may be wrong but im expecting the banks to lose, so in turn will be expecting my monies regardless. if this is so, then probably no need for me to do anything other than wait to hear from them again as ive not heard anything from anyone since last year now. is there anything i should be chasing? or am i ok where i am being patient? thanks in advance. p.s. it isnt a huge amount but is a when there charges amount to 80% of my weekly income.
  7. Hi all Having returned from my family holiday, on my doorstep were 2 letters. 1 from Optima legal services & 1 from the courts confirming the Halifax defence. Having a read in the forum the Optima is the standard letter, nothing more, nothing less. ok, that said and done im awaiting the courts for a date of hearing, correct? in the mean time, since i submitted my claim in the courts i now realise it was important to point out that i was on benefits at the time. Only finding out after ive submitted my claim, how do i go about submitting this 'further information' ? i still havnt got round to getting a letter from social security but will do this coming week if they agree to do it for me. im now going to have a good read of the past week or 2 threads as ive been away. cheers Foo

Have helped my friend claim back his bank charges. after the LBA was sent they replied with a letter stating that they will pay the amount asked for in full(£1200), with the letter was a slip that had to signed to agree with the payment being offered(as it was in full, it was accepted), so the slip was signed and sent. Now a letter has arrived stating that they will not be making the payment as offered until the OFT case is dealt with.(im aware payments are on hold and banks are asking for STAY on all claims) but because they have already agreed to the payment and the slip was signed agreeing to it, where does my friend stand at present? also with letter was another slip asking him to sign it to 'agree to not be payed until the OFT case has ended' ive told him not to sign the slip at the moment as he already agreed to the payment that was offered.it seems the bank are back-tracking in getting to agree to wait. whats the best course of action for this situation? in brief: 1.money offered 2.signed and sent agreement 3.they send further letter saying please sign and agree to not being payed til case has ended.
  9. yea the papers are stamped from the 13/8 so the deadline for hearing from them should be the 27th. im away on the 27th til the 31st so will have to preceed when i return. cheers
  10. Got my papers back from the courts yesterday and i assume Halifax received theres also. Do i hear again from the courts regarding a date for the hearing? or do i wait for Halifax reply to the courts? or do i wait another 14 days for a reply of some sort? had a good browse through various threads but cant see which one of these options is correct. i dont want to sit here waiting for a reply from halifax/courts if i shouldnt be. I assume i wait for second contact from the courts but just to confirm please, thanks.
  11. indeed i see your point, but im asking for account to be closed. no transfer is being requested or any other financial payment being made. i feel that if my account isnt closed i may well use them again when really i dont want to lose money to them anymore. when setting up the account it was all done online in a matter of moments. The only correspondence they have with me is through email, So to me it seems natural to end my activities with them via the same way i started with them. its no major hassle but i want to be sure i dont gamble on their site again, by having the account closed i will then not be tempted to use them again. im trying to protect myself if anything. no worries guys.
  12. hi all, im an avid poker fan and play live with friends when i can. have been playing online for a few years now with various companies. more recently WILLHILL, but i find that its more a game of snap online and so asked them via email to close my account and remove me instantly from any/all email subscriptions and asked them aswell not to email again. They replied saying they wanted, name, address, contact number, account number, bank details etc etc i said unless they was going to pay me for my time in providing such information when it is on their system then not to expect me to do so and just request the account that i opened with the email be closed. but they refused to do so. i have now said to them that under responsible gaming that if a customer requests an account to be closed then it should be done without question or hesitation. ive asked them not to contact me and said that if they contact me again after requesting to be removed from mail-outs that their emails would be unsolicited and i would report them to the relevant authority. i cant be arsed with all this, all i want is my account closed as ive asked and that they do so with out any further contact. why wont they just do this simple request? i can and will remove the program but i want to know that i will not use them in the future.
  13. yes mate all is good. was my Bday over the weekend so went out and got upto no good, am still in recovery mode. also popped onto insurance section due to a bad crash i had 2 and half years ago and its still being processed!!! As for halifax im waiting for there reply to court action aswell as my complaint from Financial ombudsman. have 14 days on both (17/8 deadline). Will certainly report as soon as i hear something. In the meantime ill keep reading up on the links given and try to map it all out and understand it. Will visit social tomorrow and ask if they will intervene with a letter from themselves and maybe force the issue a bit more, will also ask for print-off from them to confirm i was on benefits at the time of charges. ---------- p.s. Got a freebie off Tesco express saturday night. was out for my Bday heading up north for a night out. put £12 petrol in and bought a cpl of sandwiches on offer at 40p each and some crisp. total was £13.54, so gave the cashier 2 x £10 notes. Cashier gave me a £10 and a £5 and some change with the receipt. so i got out of the shop as quick as i could and left their property. On inspecting the receipt the cashier had rang in a £10 and a £20 note giving me £16.46 change. :roll::D oh how i laughed up the motorway. Cheered me right up.

    Crash 3/05!!

    Thanks guys, some good info there for me, i can see a little now how they can blame me for some of the incident. To me personally, the police confirmed they video evidence was poor and could not of been used to identify anyone, however they did confirm that the crash itself was on the tape and that they confirmed that the TP car was speeding excessively and that the vehicle lost control about 20 metres before hitting, they lost control due to heavy breaking over a speed hump, the speed and speed-hump combined caused the car to lose control. Independent witness statement: said they had seen the TP car over a number of weeks in the area driving very fast. on the medical side:i seen my doctor for report but he seemed sorta of 'what do you want me to write' instead of actually examining me!! i was then told to see an independent consultant who was very pleasant and helpful and also gave a report confirming my injuries. the police report is pathetic, all it says is 'The reporting officer PC 2054 Smith has confirmed that CCTV footage from a local shop was examined, however the quality was very poor and there was no evidence that could be realistically gathered from it. The CCTV footage was handed back to the shop owner. Think im going to accept the offer given. but will send a letter saying i will except the financial offer only as a means to end this saga but still do not accept responsibility. ill then see what there reply will be from that. you think that will acceptable?     Crash 3/05!!

    forgot to mention that when they hit i had made it across to my side of the road, they lost control onto the wrong side of the road, 80 in a 30 zone! they were 3 speed humps between me and the TP car when i pulled out, had they been doing the speed limit i would of made the manouver easily, TP had no tax or insurance and not registered to anyone!! so im guessing the didnt have a license either and on top they left me to call my own paramedics whilst making a sharp exit! you say i pulled out in front of them but in reality i pulled out with a clear enough path to cross but the fact they was speeding cut a 10 second distance into 2 seconds. im still baffled how i can be blamed for this under the circumstances as they were breaking every motoring law going whilst i pay a lot of money to be on the road and legal. anybody else care to enlighten me?
  16. in March 2005 i was in quite a bad car crash but got away with very little injuries considering. bad bruising, head wound and bad limp for a few weeks. i was looking to pull out of a junction and park across the road at a house i was visiting. on looking right a vehicle was well in the distance then on looking left all was clear so started to pull out, the car that was a few hundred metres away was doing around 80mph and so when i though i had time to pull out, they was speeding(30mph zone) at around 80mph, as i noticed them it was a split second decision that i hit my accelerator to get out of their way,they totally lost control of their vehicle and hit me side on in the drivers door, my car spun around 180 degrees and only stopped when i hit a lampost that was in somebodys garden. the driver and passengers got out of the car and just strolled off!!! i called the police and the station is literally 500 yards from the crash site but took 1 hour and 10 mins to arrive at the scene and obviousley the people had gone by now!!! the police checked a local cctv cam of the footage to which they agreed they was speeding when they hit me and confirmed by looking at the tape that it was their fault!! about 8 months ago i got an offer of £1500 on a 50/50 split basis which i refused point blank on the 50/50 issue. how can they blame me for half of this when they have no-one to defend to other driver!! that was 8 months ago, after speaking with solicitor only now he says that if id of taken that offer i would of only got actually £750 due to the 50/50!! now they off me £1350 and a 75/25 split!! the money i aint bothered about pushing for so my solicitor says accept on condition that you take no respnsibility. but i feel my solicitor just wants this ended more than i do!!! i dont want this to affect my insurance in having to say i was responsible for this! what should i do? im happy with financial TBH but i aint taking no blame for any of this. the police confirmed a while ago it wasnt my fault but the MIB beg to differ, the police did not keep the tape and therefore there is no footage of the crash for MIB to observe. loadsa slacking by the OLD BILL ere i feel and they want me to a deal i aint happy with entirely!! any help would be great. cheers.
  17. great stuff there. they are not charging me for anything at the moment as i usaully keep my account in order, 7 mess ups in 6 years aint bad i dont think but it still cost a good cpl of hundred which is a fair wack per charge when on only £60-£100 a week income!! i know what i would do if was the judge in this circumstance but i aint so ill have to wait if they apply for a stay and i can give my reasons for wanting the stay rejected this is the reason im going to use if i can. cheers again guys.

OK, i apologise if i did misconstrued anything said and also if i offended anyone. ill try and be more selective with my wording maybe, like said net chat cannot always be expressed in the manner its meant. lets start afresh then. earlier today i received the reply from the bank post dated for the 1/8 (deadline date) but post stamped for 3/8. there reply says basically that 'the case being taken by the OFT is in hand and that all claims are suspended from the normal timetable of dealing with this situation' until the case is settled. they also say that if i execute a court claim they ask for a stay.(as expected) and they also continue to say that they will KEEP ME INFORMED of the situation. After speaking with Financial Ombudsman yesterday afternoon i received today from them the complaint form reguarding their failure to supply me with T&C's as requested under protocol etc. i will be filling in the complaint form over the weekend and then posting it monday morning.
  21. eh?! criticise?! all i did was point that either information given to me is wrong or that i have no idea of what is being said or that links provided have no meaning to me without an explanation. im trying to keep to a deadline with my claim and on weds/thurs things got a bit tense for me with me wanting to submit court claim. so your kind of saying that if information is given to me that is wrong then i should say nothing and carry on?! ive pointed out the correct number after id made a 40min journey(of course i was annoyed), maybe it was my mistake for not checking to see if the number supplied was correct. if i gave you a map of directions from bedford to luton via inverness youd have an idea maybe. ive not abused anyone here, if to criticise is to point out peoples mistakes then im sorry. i cant express how much i do appreciate the help you guys give me, but that said that is all i want from you 'a little help'. maybe it best i dont post on here anymore. thanks for your time/help anyway.

  23. all done. submitted forms today. office at county court seem to think it was all looking like it was in order. i rang the ICO who advised to as it was data & consumer credit issues they put onto the 'office of fair trading' after explaining to them they put me onto the financial ombudsman who then advised i should be taking this up with the ICO!!! the women on the end of line at FO said she would sort it for me, so the FO have now put a complaint to halifax reguarding their ignorance for a request for T&C's twice since 22/6/07. gotta wait 8 weeks for them to reply if they decide to. So, just a waiting game now by the looks of things.
