    • So, Sunak has managed to get someone to 'volunteer to go to Rwanda hasn't he? .. for just £3000 payment to the person plus 5 years free board and lodging isnt it? - cost to UK taxpayer over £300M+ (300 million quid+) isnt it? - Bargain says Rwanda, especially with all the profit we made privately selling those luxury chalets Bravermann advertised for us   I wonder how many brits would jump at that offer? Thousands? Hundreds of thousands? Lets see, up to 5 years free board and lodging and £3k in my pocket .. I'd go - and like that person - just come back if/when I get bored. First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have they actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I replied to MIL Collections with a fuzzybobble special letter.

It's basically the no cca get stuffed one but I also added......

 

Also failing to provide a CCA or any proof I owe this alledged debt, are Moorcroft, Frederickson International, Bryan Carter Solicitors, Capquest, Asset Collections and Investigations Ltd. JB Debt Recovery.

 

If MIL Collections would like to be added to this list of failed attempts at debt collection, then please let me know as soon as possible. :D:D:D

We shall see what happens next.

 

Fuzzy, it would seem we have been hassled by the same DCA`s also, only I haven`t heard from Crapquest yet.

Evening all,

 

It`s been a while with this one, but it seems someone is trying to spoil my Christmas, although moving house in the next week will take some beating. We need a 3 bedroom for the kids.

 

Anyways, this morning I received the following from some ball-bag at DLC.

 

It goes something like this -

Also included in the envelope was a letter originally what looks like from Argos.

Also included was a cheap looking expenditure sheet, asking if I`m a house owner and am I employed.

 

I can`t say I`ve had any dealings with these before, but I`m kind of wondering why Argos would pass the account on. This account has been through quite a few DCA`s and Solicitors.

 

Any idea`s people?

 

I`d also like to take this opportunity to wish you all a very Merry Christmas and all the best for the New Year, and we`ll all need it, with the way Judges are denying us of our rights under the CCA, to protect the financial wellbeing of our bankrupt and extortionate country.

Ok bud,

 

Mine has PPI added, but it`s just a tick in a box, anyone could have ticked that box at any time.

 

Although the CCA has on that PPI is xxp in the pound, it doesn`t state the amount of interest.

 

Also, the statements they sent me had the monthly interest and charges combined, instead of itemising them, so, one can`t really work out what the true costs.

 

Let me know what you find :p

 

I might just see what comes next, then send them my account in dispute letter, which I`ve sent out a number of times now, to various clowns.

Ok the nearest i could find was signed five months after yours, so it is possible they changed the agreemants in that time scale, but for the worse?????? doubt it:rolleyes:

 

Yours looks enforceable, i can just make out the APR, but i also think its a forgery.

 

Firstly no where on yours is an account number, why, because the staff wrote it in on the left hand side;)

 

 

Also note the dotted line above the DD section, it suddenly stops two thirds the way along on yours, while not conclusive, a tad odd dont you think?

 

Also the DD is missing boxes for originators and referance numbers, how would the bank know who to pay or to what account the payment applied????? so is incomplete

 

The only way to be 100% sure is to find someone with a copy signed exactly when yours was, even better if the print run numbers down the side match, But im as sure as i can be thats not a copy of an argos agreemant

Mmmm, that is quite interesting. Now, they could say the agreement is also a Direct Debit mandate, BUT, if the whole sheet was sent to the Bank, then Argos would not hold the original agreement.

 

So, if they cut off the bottom bit to give to the Bank, the Bank then does not have any reference / account numbers, as you point out.

 

And yes, now you`ve mentioned it, there is no reference / account numbers on the actual agreement, in which case, as you also point out, how could they prove that the account number on the card was attached to my actual account?

 

I`m also curios as to why Argos would sell this account on, as it has been through no less than 7 DCA`s and Solicitors.

 

Does anyone else have any thoughts on this?

Not mine, nor the customer, it was the staff members name, removed it anyway:)

 

That is not my agreemant, mine is from 2004, but is identical to that, I searched for one that was taken out as close to yours as i could to see if they had changed, they had not, which is my point, yours has been photoshoped to 'squeeze' in the prescribed terms;)

 

Thats why its been dumped sold to a DCA because the real one you would have signed did not have them there:rolleyes:

Hi folks!

 

just thought you'd like to know that I got the exact same letters from dlc. Ive told them to get lost as Argos Card Services didn't even manage to provide me with a CCA so they have got no chance!

 

As was said, it seems Argos have sold the alleged debts on to this bunch of no-hopers who have a snowballs chance in hell of recovering jack schidt from their investment...Happy Christmas dlc :D

These DC`s must be really numb in the head. They simply can`t check the status of accounts that they buy. I mean, if an account was legite, why would Argos sell on loads of accounts?

 

The mind boggles. It has been for a while.

Had the same DLC letter myself a couple of days before christmas. Nobody has managed to send an Argos application form for me yet though.

 

I sent DLC a CCA request this morning. Be interesting to see what they come back with. I also noticed when going through my Argos paperwork that they didn't sent a Default Notice before selling the account to DLC. Looks like they have bought a bunch of accounts from Argos that they'll not make a single penny on. lol.

 

You would think by now that the DCA's would be checking that debts are enforceable before buying them.

I can think of a far ruder and shorter word than "chancers" to sum up DLC. By the way DLC is a trading name of Hillesden Securities. Quite well known here for chasing the unenforceable.

 

Got a feeling I'm going to be having some fun with this lot. Time to get out the recording gear and a kidney donor card. ;)

 

I sent them my CCA request and added the following from my letter a few months back to the last lot of losers chasing this account....

Evening boys and girls,

 

Right, I got another letter this morning from these cranks.

 

I don`t have amy scanner and printer sorted out yet, as we have just moved house and the place is a tip. We don`t even have a phone line, but are getting one installed next week. At the moment, I am using my mobile as a modem.

 

Anyway, the letter goes something like this -

 

 

 

Dear N.P

 

You have failed to respond to our previous letter and the balance remains unpaid.

 

Please telephone us immediately on 0844 3358498 to discuss your payment options which includes;

 

1. A discounted lump sum in full and final settlement. (We will then sell on the remaining balance to some other gimp who will then hassle you).

2. Monthly payments over an agreed ter,.

 

Failure to respond to this letter may result in Legal action and additional costs may be added to your balance.

 

Yours sincerley.

Has anyone else had one of these yet? I`m thinking of sending them a letter at the weekend, stating they have been mis-sold the account and need to contact Argos for a refund, unless they can supply me with a legite CCA instead of a Photoshop forgery.

I got one this morning, and it's exactly the same letter word for word. If they're offering a discount if you pay in full, then it's either to tempt you into calling and agreeing to stuff or they know it's unenforceable and that's why they've paid peanuts for it.

 

I just sent them a CCA request and a cease and desist processing my personal data without permission. On their previous bit of loo paper they sent me they stated that they would be reporting on my credit file within 30 days.

Fuzzy, do you have your letter handy for your cease and desist processing of your personal data? Could I whip it off ya please?

 

Also, which template are you using for your CCA request? I think I only have old versions hanging around.

 

Yeah, they also they stated they would bombard my credit rating also, not that I`m bothered. I don`t think any more nasties on there will make any difference :D

How very dare they say they haven't heard from Moi! They did, and even signed for it so it's there for all to see. They wouldn't be lying by any chance would they? I mean, a DCA that doesn't tell the truth..that's almost unheard of :rolleyes:

 

As for me, I'm not bovvered. Not one of the DCA's that Argos set on me have been able to supply a CCA. Why? Because they don't have one. I'm not even going to waste £1 on a CCA request. So I will, (whenever I can be ar$ed), write back and tell them politely to put up, or shut up.

Right, this morning I had another silly letter from those empty heads at DLC, or whatever they call themselves.

 

We are still very much so, in a mess following our recent move, and my home network, including server, printer, router etc is not yet up and running again. I am simply using a PC connected to my mobile phone, for a modem.

 

Anyways, FUZZYBOBBLE, do you copy? Could you paste up a copy of your recent CCA request and also your `cease and desist processing your private data` letter please? I have all my letters etc on my server which is still offline at the moment. I have a lot of decorating to do before I knock everything back up. Thanks in advance :D

 

Anyways, my scanner is still boxed up somewhere, so the letter goes something like this -

Anyways, has anyone anything at hand to send them, untill I get fully up and running again.

 

By the way, this letter went to our old house. We popped down today to shovel up some more stuff.

I just used the CCA request from the CAG templates library, as it's been updated.

Only changes were a digital signature, just in case they try and pass off a photoshopped job as they genuine article, and I have something to hang them with if they say it is. I also added the following line.

 

"On the letter you sent on 15th December 2009 you stated you will start reporting against my credit file within 30 days of this letter. May I remind you I have never given your company my permission to process my personal information. Any adverse information you add to my credit file will be deemed as defamatory, as well as a breach of the Data Protection Act, and will be dealt with accordingly."

 

I'm hoping they'll come back with a CCA containing my digital signature, and then get to to say in writing that it is a true copy of the agreement. Then I can sit back and laugh at them. I also have an improperly served DN with more things wrong with it than a waiting room full of hypocondriacts.

Ok, I`ll whip that CCA off later and have it sent recorded delivery, with our new address on, so I know they have received it and don`t try anything by sending all stuff to the old house, like a claim form which I wouldn`t know about.

 

I don`t think I actually received a DN from Argos, I can`t remember seeing one.

May be worth you trying the digital signature thing. I got a nice one I knocked up in photoshop. Looks like it was done with one of those gel pens in blue, while the letter is printed in black. I'll laugh my socks off if it shows up on an argos application form in a few weeks time.

Hi N.P

Afer all this time mum had the same letter on the 18 Dec but i have not had time to do anything then a letter on the 5 jan then onther on the 12 january. So argos must off been doing some selling but have not had our permission. will post mum letters up on my thread if any one can help
