Moved case forward to 24/05.   He said there was no signed agreement and after a bit of “erm, erm, yeah but, erm” when he asked them, he allowed time for sol to contact claimant.  what is the next step now? thank you UCM  
    • I've had a quick (well, quick for a thread of this length),  read of this thread and to be honest I'm struggling to make heads nor tails of the actual crux of the issue here. You seem awfully convinced that whatever is going on is worth the fight and the odds are in your favour but with how the thread has gone it seems that one trail goes cold so you simply move on to another in an attempt to delay the inevitable. All it does is end up digging holes and confusing others and yourself which means any advice given to you is completely pointless. I note that for the life of this thread there has not been any documentation or correspondence uploaded for people to have a look. Have you got any that you'd be willing to redact and upload for members to assist you? Right now, it seems people are shooting out advice while being in the dark because it's starting to become very difficult for people who weren't here at the start of this (including myself) to follow along. Right now, this whole thread is just hypothetical "He said, she said" and is going nowhere fast. Nothing more than basic advice can be given which, as you've sought out some legal advice, is likely not sufficient to actually come to any sort of conclusion. I, personally, am starting to agree with others that it may be best to consider bankruptcy and put the matter behind you.  
    • Thanks for coming back to us. There are no guarantees - but remember that so far MET have not had the guts to put even a single case before a judge.  Not once. Yours is one of seven court cases. Three ongoing like yours. In two MET bottled it as Witness Statement stage approached. In one the allocating judge decided their Particulars of Claim were rubbish and threw the case in the bin. Just the one victory by MET by default when the motorist stupidly didn't file a defence. So there is every chance that MET will throw in the towel in your case too if you stand firm. Please keep us informed of what is happening. Regarding being abroad, that is no reason for things going wrong, you can request an on-line hearing and we've had several cases where the PPC gave up when the motorist moved abroad. But please keep us in the loop.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I am in the process of claiming late fees etc from MBNA for a A&L credit card and so far have had all the charges and about half the contractual interest credited on to my card. While I was looking through my statements it occured to me I have been paying PPI on the card, not very large amounts, they range from about 3 to 9 pounds each month.

 

Then I found this section of the forum and decided to have a read. I cant remember whether I requested ppi or not but what I want to know is, I only work 15 hours a week and have done all the time I have had my card so isnt that under the hours I need to be working to claim on the insurance and also shouldnt they ask me how many hours I work when I applied for the card?

 

I've had the card since 1998 but cant remember whether I applied online or by application form, should I send a CCA to find out? I already have 6 years statements from when I sent my SAR for my charges claim.

 

Any help would be appreciated.

I would sent them a CCA request to get a copy of the original Agreement and take it from there.

 

The more info you have regarding the PPI the better.

If you have sent CCAs to other companies and have not recieved anything within 14 Days (12 days + 2 for Post) , you need to get chasing them, Remember if after a further 30 Days (44 in Total I think..lol) they will have commited a CRIMINAL offence, so dont let them get away with it.

I sent CCA request to MBNA on 6th of July and have had nothing back from them so I am going to send a letter requesting PPI payments back. I've had all my late and overlimit fees refunded and the card now has a credit of about £200 on it but I am wanting to get that back and close the card, will I still be able to go ahead with the PPI claim if the account is closed?

Anyone have any idea about my last question, I have a credit of about £200 on my a&l credit card after reclaiming charges. I want to now claim PPI so do I need to close the card to get the £200 credit back and if I do close the card can I still go ahead with the PPI claim.

I've already CCA'd them but have not received anything yet, they have credited my card with the pound though. I already have all my statements from when I SAR'd them for my charges claim.

Well, still no agreement and by my calculations the 2+12+30 is up on the 26th August so they have 4 days to send it, somehow I don't think they will. I think I will now get on with my letter to reclaim PPI charges. I know that the PPI would not pay out if I lost my job as I only work 15 hours per week and I would need to be working at least 16 hours to benefit from it so it has basically been a waste of money paying it to them. Would that be my best argument or the fact that they have not supplied any details of whether I requested PPI or not?

I have done a rough copy of my PPI letter to MBNA, I will post it here, mainly so I can keep myself updated to where I am and also if anyone has any comments or advice feel free;

 

Dear Sir/Madam,

 

Ref: Payment Protection Insurance/Credit Card a/c No: xxxxxxxxxxxx

I took out the above credit card with Alliance and Leicester in 1998.

I believe I was mis-sold this insurance. Firstly, I was, and remain to be working under 16 hours per week and therefore I now understand that I would not have been eligible for any payments from the PPI if I had been unable to get work or was sick.

Furthermore, it was never made fully clear to me that the insurance was optional, or indeed that, should I have so wished, I was at liberty to look at other, cheaper or more suitable insurance alternatives, instead of the one that you provided in-house.

Thanks to the extensive coverage of PPI mis-selling in the media, and the recommendations made on this matter by the OFT, and having consulted with a company specialising in compensation for mis-sold financial products, I believe that I should be entitled to reclaim in full the amount in PPI which I paid on this card, which totalled £xxx. Moreover, I should be entitled to interest, charged at your own APR rate of 24.9%, to the sum of £xxx. I am therefore requesting that you refund me a total amount of £xxx. A spreadsheet detailing the individual payments and interest due is attached for your convenience.

I would appreciate a reply to this letter within fourteen days. If you reject this complaint, I would require a full and detailed explanation of your reasoning, and I would be grateful if you could explain whether you provide an internal appeals process. If you do not, please supply me with a final response letter, so that I can take up the matter with the Financial Ombudsman Service, and if necessary pursue the matter via the courts.

I'm hoping to get that sent off in the next couple of days, they will have run out of time for the CCA request on Monday so it doesnt look like I will get that. Does that help my claim in anyway? Any help would be gratefully received.

Well, I have received nothing at all from MBNA regarding my CCA request and the 12+2+30 days are well and truely up so I have sent the above letter today first class recorded. They have totally ignored me and not even acknowledged my request so I shall see what they come up with next. Does it improve my chances if they havent sent a copy of my agreement as they have not proved whether I asked for PPI or not?

I havent had much time to update this but I received a reply to my CCA request on Saturday, I dont know if it had anything to do with the letter I sent them asking for my PPI back but that letter was signed for on the 31st of August and they have not responded to that yet. I will try and post their agreement on here later on as I'm not sure if its all above board or not.

I have today received a letter from MBNA in reply to the letter I sent them asking for my PPI payments back, it says:

 

Thank you for your letter dated August 29, 2007 which we received on August 31, 2007. We are currently investigating your complaint and will send you a full response by September 27, 2007.

 

I suppose thats a standard reply, at least they are investigating it. I said 14 days though, not 28 but they were never ones to rush things were they?

Well, surprise surprise. I was told by MBNA that I would get a response by today for my PPI prelim letter and guess what.... NOTHING. Not even a get lost letter.

So I shall start working on my LBA, see if that spurs them along a bit (I doubt it!!)

I got all excited when a letter came from MBNA this morning, I didnt dare open it incase they were saying no I cant have my PPI back, but no, it says:

Thank you for your recent letter.

Please accept my apologies for the delay in responding to you; however, our investigations are taking longer than anticipated. We will provide you with a full response by 25th October 2007.

WHATTTT!!!!!!!!

That will be 2 months its taken them, how long does it take to investigate that they are in the wrong!!! Is that a good sign that it is taking so long cos they havent said no yet and they are looking in to it? I hope so.

Should I wait an extra month or carry on with the LBA to see if that kicks them into action? If so what should I put in my LBA?

Long time no see!! I am just about to start PPI reclaim for hubby so i'll be interested to see what info Ian posts up too!!

 

Also, an answer to your question on 12th Aug re reclaiming from a closed account interests me as well....

Good luck with your hubbys PPI claim. I've got a couple on the go, this one and the other on a Halifax loan. I've also got a couple of credit card and store card charges claims to do but my brain can't cope with too many things at once:confused:.

It does your head in doesn't it!! I'm always relieved when DCAs don't respond to CCA requests straight away because it gives me time to focus on something else. I seem to have a nice cycle going at the moment, so i'm only ever dealing with a few at once.

 

Good luck Pennypenny. I'm hoping to have a response from MBNA tomorrow. The person i have addressed dealt with me pretty swiftly last time - i'm actually quite excited!!

I think I need to start preparing an LBA cos at this rate I'll be waiting forever:rolleyes: !!!

A copy of the Original Credit Card application

Terms and conditions

Recent statement of account

I think they are confused cos I asked for my credit agreement not an application, and what they sent me is barely legible, there is ticks in boxes but I cant read the writing to see what they are for.

Not much cos I requested it to check on the PPI information and I already had all my statements when I sent the SAR for my charges claim which cleared the balance of the card and it is now in credit so now I have sent a prelim for PPI which I am still waiting to see if they will pay up or not. I suppose no news is good news:roll: . At least they havent said no. Yet.
