Does this form comply with a CCA request ? It seems to be both Application and Agreement ?

 

Also, note the unticked boxes re PPI .... has been charged relentlessly for years !!

Hello Harry,

 

Some application forms can be credit agreements if they contain the prescribed terms, maybe post this on the credit agreement thread for comments before you proceed with anything.

 

As for the ppi, I think you have a good case :D

Looks like an application form to me, although I've been asking for mine since April and I've had nothing from them (well, other than an apology and a letter saying that it 'will follow').

Bank and credit card reclaims - £9,806

Sainsburys CCA non-compliance with FOS;

Natwest reclaim of £340 in progress;

Thanks guys, I should probably also mention the covering letter referred to it as the application form ..... I guess that is what it is then !! Yay !!

 

Did this come from the Dunfermline Card Services address or Halifax? My Sainsburys one (also listed as 'an application') came from the Dunfermline address and I wonder if this is a sign that neither Sainsburys nor the Halifax (who operate from the same addresses) actually keep the CCAs?

HBOS own 50% of Sainsbury's Bank so it's no great suprise they use the same premises and systems.

Sorry to drag this up again, can't believe it is nearly a year now !! Anyway, I was reading another thread where a CAGer is being taken to court on a similar "application form" after involvement by BOS. I have just heard from them and assume this may end up in the same way, however I do have it in writing that this copy is my "Application Form" and I have been provided with a copy of a full blank Consumer Credit Act Agreement and the Terms & Conditions that would have applied at the time. Now these run into several pages and certainly are far more extensive than what is on the Application Form. As my copy is unreadable in parts anyway owing to poor copying I am still hoping that coupled with their continual reference to application form I am going to be able to defend this successfully if I do get to court ? Balance is around £2kish and I haven't paid a bean for well over a year. Looks like a default notice was issued last June, however the interest and charges have still been going on, I am not altogether sure of the implications of the default as this was issued whilst the account was in dispute re CCA and charges. Lastly, amazingly, amongst the scraps of paper my wife did keep is the Credit Card Agreement issued with the last card she was sent in 2006, again this isn't signed at all ?? Will keep you posted

I'm at the court stage with them at the moment and the correspondence I have received from them purporting to be the CCA has even less info in it than yours! They have even described it as an application form in their correspondence with me thus far.

 

I have less and less respect for this shower after each passing day.
