Hi, guess I should've started my own thread ages ago!

Timeline as follows:

23rd Feb - 1st letter to bank

6th March - template rebuttal received

12th March - 2nd letter to bank

30th March - claim filed at MCOL for £2300

13th April - acknowledged

27th April - standard defence filed, no AQ required

1st May - 5 min small claims hearing allocated for 15th June

9th May - full details of charges & account sent to court as requested

1st June - court bundle filed to court & served to SC&M (thanks to CAG for template witness statement and thanks to shadeofblue, mistermind & notlam for T&C excerpts :) )

Today - no documents received from SC&M, sending 1st non-compliance letter.

UPDATE :)

 

YESTERDAY Letter received from SC&M (dated 7th June) acknowledging safe receipt of my bundle of documents.

 

TODAY Letter received from SC&M (also dated 7th June) informing me that LTSB will be SETTLING MY CLAIM in the next 5 working days :):D:)

 

The money's in my account already, I can't believe it!

 

They are about £300 short though :-| Is it worth trying to bash them for that??

 

Will be pursuing them for wasted costs, methinks!

 

Will keep you posted and will sort out CAG's percentage ASAP!

If you wish to pursue the balance you will have to write to the bank to tell them that you will accept the payment as PART settlement and that you will be pursuing the balance, plus interest, plus costs through the court.

They may then withdraw the GOGW which means that you will be pursuing the full amount in the courts.
