      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

We have just recieved are statements and have totted up that we have been charged £8410. We are gonna fight for our money back.

 

But we need help we havent got a clue where to start.

 

Any help would be much apprieciated

Hi,

 

Thanks. We have already done are spreadsheet of charges we want back so hopefully i can send the letter off on tuesday. Then sit and wait. I'm still very nervous. But reading other peoples threads have really helped.

Sounds good! Don't forget, you can't include the 8% stautory interest until you file at court, but if you're claiming contractual interest you should tell them at the start of the claim - I don't know much about contractual interest, just went for the charges and then 8% at court stage!

 

Read as many threads as you can cope with - you'll know what to expect before it arrives!

I would urge you to go for at least the 8% interest, this is your right under section 69 would be paid automatically (if you ask for it) from Abbey at settlement, if you need a spreadsheet, pm me with your email address and i will send it to you, it is 8% and calculated from when the penalty charge was taken, it will add quite a bit to your claim and you are entitled to it, if you need help with the spreadsheet then there are enough of us around to help you

Hi

I sent off my 1st letter with my schedule spreadsheet demanding my money back within 14 days. i've recieved a letter tis morning from shabby today saying they are sorry to hear i've been so unhappy that i felt i had to complain and that they will look into it and get bak to me in four weeks.

 

what should i do shall i still send my LBA after the 14days is up.

Hi BankAvenger. I am one step ahead of you. If you follow timescales as per letter sent on Tuesday 5th June 07. If they haven't responded with a settlement (unlikely) you should be looking to send them a Letter before action on 19th June 2007. I have subscribed to your thread and will follow up. all the best. I've heard not one thing from abbey, i went and got my N1 from the courts and i'm now in the process of getting everything ready to take down on thursday.

Go get them! Remember they used to have no hesistation taking our money and then sending threatning letters.

 

I sent my LBA last week. I'm itching to file my N1 but am still a week away. As I have just started a new job, I will need to send it Special Delivery to the court or by bike courier. My file date is 12/7/07.

 

I can't wait! So come on get dressed (think of the money hinging on this form)! :p

 

I've got to go as I'm off to court myself (for another civil matter).
