    • I applied to the Court to act as litigation friend has my son is Severely Mentally Impaired and sent the proof they requested from his GP so I thought this might have been accepted without a hearing. I cannot believe the claimant is still convinced my son was the driver.
    • I had to call an ambulance for my wife, but one of the paramedics was not happy, about the condition of our house, as it's cluttered. And he  would only see to my wife, on the ambulance itself. After diagnosis they took my wife to hospital. My wife was ill for a few months, and received help from the district nurses. We then got a call from a social worker, who wanted to visit us, and discuss ways to make my wife more comfortable. When I asked for more details, she became vague, but could give us a phone number, if she visited. I politely declined her offer, as I was coping, along with my daughter in caring for my wife. Then a letter arrived from another social worker, saying similar things, to the first. I didn't bother to reply. Another letter has just turned up, from the social services legal department, which doesn't say anything specific, but refers to the other social workers trying to visit us. Coming from a legal department, has badly upset my wife, who's recovery was on going, and she now fears that someone will be coming to the house, to do whatever. Do we have to respond, or take notice of these people. Also we recently had a fire prevention officer come and fit, smoke and heat detectors. He didn't voice any concerns with the conditions at the property. Worried, Paul.
    • By not sticking to the deadline which you set you have lost credibility. Your letter of claim becomes one of hundreds of others which they receive and which they put in the bin because they think that you are just bluffing.  
    • 05.05.24 Ever so sorry if I have entered this in the wrong part of this website.   My grandfather is in his 70's and retired.  He asked me to help him find a work pension that he was paying into when he was working. From 1967 - 1982 he worked for a Fabric Dying Company, Celanese, Spondon Derby UK. I have already used the GOV.uk Trace Pension Scheme. It listed a few pension companies : Akzo Nobel (CPS) Pension Scheme formerly Courtaulds Pension Scheme.  I do not fully understand how this works but I think this scheme is administer by a company called Willis Tower Watson. We have called this company, got through to the pension department submitted all my grandfather's details (D.O.B. , N.I. no. etc.) but that agent tells that they have no record of my grandfather and ask what is the name of the pension scheme. Here is the problem, his home was burgalled in 2005 and a briefcase which contained his legal documents was stolen. So he does not know who was the Pension Scheme company. I have a this phone number 01332 681 210 for Celanese but it just rings and never gets answered. So I am asking for help if anyone can tell us where we can try next. I am also hoping for a massive long shot that one of them members on this website, worked for or knows someone who worked for British Celanese Spondon Derby and could tell us of any pension company. Thanks for any help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In panic mode - just been reading through my particulars of claim which was issued on 30 april, (they have until midnight Monday 5th June to file a defence) and I never made reference to my account number!!! I did however, send schedule of charges to court, and to contact at Eversheds who is dealing with my claim where I did cross reference the court claim number and my account number. Do you think this will be acceptable or are they going to defend on grounds of insufficient information. I did refer to the two previous letters and schedules already sent to Nationwide, so could my argument be that I had already provided all the necessary information?? Please let me know what you think and advise on anything you think I should do. So close to deadline don't want to give them any opportunity to stall further!!!:-|

Well finally at day 28 after Acknowledgement of Service!!! Nothing been paid in to my account as at 11am - MCOL still says acknowledged on 03/05/07, therefore no defence lodged as of yet - they have until midnight! Wondering if I should hit the judgment button at a second gone midnight or give them a further 24 hours as it states on MCOL "if defendant files a response with the court by 4pm on the same day as your request is processed the response will take priority". I have also read somewhere that if this happens it can lead to the case being delayed further!!! Any thoughts on this please?

Hi thelegend, I know your 28 days are up today as well, are you just sitting back to see what happens or have you made a last ditch attempt to talk to the solicitors to see whats happening - keep thinking maybe I should phone them but then I dont want to remind them their deadline is today just incase they have forgotton!!! What are your thoughts here and are you pushing the judgment button at just gone midnight???

if you do they can get a stay which can delay it by a further 28days!
Can be a lot longer than 28 days if U have to wait for a Hearing to get the 'Stay' removed!...;)

Update - still no defence filed on MCOL - still no money paid into my account -

Still some time to go yet but expect to see defence filed at some point as it pretty much appears to be the norm with NW!!

I've done the same as you. My claim was issued on the 30.05.07.

Nationwide has until 18th June to reply. Any news on your case?

Sorry, i`ve got no new news. I`m just waiting for a reply as to what ther defence is going to be on Friday8th

Latest update - no change - no defence listed on MCOL (doesn't mean they haven't filed as may not register until tomorrow if filed after 4pm) - no money paid into account - looks like I will have to sleep on it and check again tomorrow!

Update - well slept on it - very restless night, was checking bank account in my sleep!! However, no change - MCOL still states Acknowledged - no money paid into my account!!

 

Will phone MCOL as suggested at about 10.30am to see if they have filed a defence.

 

Anyone got any thoughts on how long I should give them until I push the judgment button - read somewhere that perhaps I should give them another 3 -4 days????!!!

Hi Girlybiker,

 

I have been reading the threads on here and I think you best way is to write to their Solictors Eversheds and give them another 7 days to either put in a defence or pay up, just to let them know that you are being more than generous as they seem to be ignoring you and the courts requests. There is a link on here about entering judgement by default and its not that easy I think MilktrayMan has a court link on here read the Judgement by Default first. Nationwide have until the 13th June with my claim and I've not heard anything yet or had any money put into account, they seem to be becoming quite awkward either that or they cant keep up with every claim. I will be contacting their solictors to remind them that they have until 13th June next Monday as someone had sucess this way if no defence is put or they dont pay up! Good luck!

If it has been acknowledged it just means that the NW have "acknowledged that you have filed a claim" in order to get your money you have to wait naother 28days from the acknowledgement date, THEN you will be able to enter JUDGEMENT on the NW.

 

Some cases dont even gothat far, but NW like to drag it out as long as possible to see if you will just give up! So, just hang on on there and you will get YOUR money back off the sheriff.

FULLY PAID UP 17/04/07

Second Prelim sent 20/04/07

Second LBA sent 01/05/07

MCOL acknowledged

County court letter saying PAID UP 20/06/07 - although this wasnt the claimed amount, so i disputed it.

Still awaiting court date/decision due to OFT case.

just been thinking about these `terms and conditons`. Surely if the N/W or even a Judge quotes them they would have to physically produce them from when the account was opened otherwise they are inadmisable evidence. Right or Wrong ????

Just a quick word of advice - DONT PASS JUDGEMENT FOR A COUPLE OF DAYS - otherwise NW will file a late defence giving them, possibly, another 28 days to make you wait.

Rang Eversheds, spoke to Catherine Falvey, asked her if she knew what was happening as no defence filed yet, she asked me for claim number and then told me she had no information as of yet from Nationwide but that I would be paid back it was just a matter of waiting!!! Mentioned Nationwide outside the 28 day response period and she said it is up to me if I file for judgment but suggested I give it a couple of days!!
