Hi there,

Was wondering if anyone been in similar situation and what route they took.

 

Yesterday I was filling in moneyclaim form as Lloyds hadn't responded to my 2nd letter. Post arrived with an offer of 750 pounds in full and final settlement. Obviously not accepting cos claim is over 3,000. Do I write back saying I accept but still want the full amount, hoping they will pay in full and avoiding court action? Or do I ignore letter and press ahead with action?

You will need to do a rejection letter accepting the offer as part payment. Keep an eye on your account as sometimes Lloyds just give it to you and disregard your rejection letter. I would inform them in your rejection letter that unless they pay up the full amount, you will take the to court on xx.xx07 (give them 7 days, 10 days or 14 days) Here is a copy of the letter I sent to HSBC when I was in a similar position to you:-

 

 

Response to settlement offer – without prejudice

Thank you for your letter dated xx.xx.xx (date of their letter of offer) offering £xxx.xx in full and final settlement of my request of the bank charges you levied from our account during the last six years. We are prepared to temporarily accept the sum offered as partial settlement on the clear understanding that the remainder of £xxx.xx is to be paid within the next 10 days. This amount is made up of £xxx.xx being charges levied from our account as detailed in my letter before action dated xx.xx.xx (date of your LBA). If this amount is not paid within 10 days of this letter, I will be forced to put a claim through the courts for the full amount plus 8% interest pursuant to Section 69 of the County Courts Act plus costs.
