    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation? I’m determined to clear out all my debts but need bit of breathing space and time. Let me know please if you need any additional information. Thanks in advance for all your help and guidance. MM

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well was wondering that myself Uncle Pete, always had my doubts about him!!!!....... I have been sticking my tounge out at them but I will nto be held responsible for my actions on Tuesday if they are granted a stay....... am going in a straight jacket..........

Not sure about the stay part yet as they have not been granted it........ am hoping the my arguement has been strong enough ot convince the distric judge.... if he does grant it then I will go for that option............. thanks for the link.....

tell you what I would rather have another baby than do this........... 3 folders, 3 copies of just letters to the court, DG & bank, receipts from rm, fax receipts, 2 court notices, original letter to hsbc in January........ 99 pages.............

 

99 friggin pages............... thats not even the basic court bundle........... hells fire........

 

pray pray pray is the order from now till tuesday...... am getting out of my sick bed again tomorrow and handing the courts copy in, in person, and sending the ****** theirs via special delivery......

 

I tell you woe betide anyone within 100 miles of me tuesday if they get granted a stay.............. the prospect of doing 9 out of 15 years for life could be very attractive!!!!!!

i have spent the last hour filling 3 bliddy ring binders you ......... and erm I have spelt more than 4 right.......... in my letter to the court there was ! only 1 and even you didnt spot it na na na na.....

my kids say at 51 I am old!!!!! hahahahaah what is it about that hat I wonder. I thought it was lovely. ofcourse it is not real fur...........

 

right sorry folks but i am coughing and splutterign all over the pc and me keyboard now.......time for bed

 

oh yeah and incase I forgot to mention it nothing from DG this am in the post.............lol............ and I reckon it will be the same every day now till the 7th.........

Yeah I know Pd, have checked and re checked and re checked the checking, ( hell am I on a till) am sure there is something missing........

Oh now I do wonder if she has left Pete and who else is following her, you know might explain why I had zilch, nada, zero......I am sure they have lost my file.......... which is good for me cos they missed the deadline. hahaha

 

and one of the questions I will be asking tuesday is....... excuse me your worship but I can see the oft telling the banks what to do and making a waiver with them, but they have no powers within the legal system and therfore the waiver they have assured the banks of is nul and void......... it is not legally binding...I am not asking the court to decide fi they are fair or not, I am asking that based on case law judgements have been awarded.

 

They beleive they are above and beyond the courts jurisdiction by ignoring the guidlines set out by this court onthe 15th may, it does not apply to them they are above this court jurisdiction and can treat everyone the same..... ( now gets off the soap box........lol)

 

Right am off down town to the court house to han my little blue file in and post off DG's...

Hi, sorry to jump into this thread, may need moving but...

 

am in court 10am friday morning (3rd Aug), DG have offered full settlement, but have asked me to sign a standard letter to keep it confidential, can someone guide me to a template letter so its not confidential????

 

started all this nov 06.........nearly there :)

Hi Leepy,

Just rule through the bit about keeping it confidential and send it back - they'll pay up anyway.

 

Unless you want to add a bit saying that for the additional sum of £XXX you will agree to keep the transaction confidential. Some people have done that - DG won't do it of course, so the end product is the same.
