you just turn up at court on the day if you want to object to the set aside, no doubt they will still get it but it gives you the chance to have your say, its also a good time to put forward your draft directions, i did and the judge ordered citi to comply, ive put in all my side of the order citi have yet to comply, my court date is the 8th august but will request a strike out if they fail to comply to the directions, good luck..GC

Claiming back:

Capital one - £1622.66p – settled in full

Capital one - £632.69p – settled in full

Capital one - £ 353.15p – settled in full

Citicards - £ 790.00p – MCOL - 15th June - WON!!

Citicards (OH) £941.56? – asked for judgement - CITI requesting set aside - court sept.

Barclaycard – - made silly offer!

Studiocards £422.44p – settled in full

Lloyds - £35 – settled in full + ex gratia payment of £25

Halifax bank account - £39 - settled

Halifax visa – awaiting S.A.R - (Subject Access Request)

Cant fathom this out - both my OH and myself had citicards - both paid them off beginning of year - both submitted mcol claim , OH - Citi say they are defending - have asked for a setaside of judgement by default because they say they didnt get the original claim and are defending because they say they have a good chance of winning. ME - they didnt send their defence in after a further 14 days ,I issued a 'judgement by default' - same as OH did - that was a week ago - this morning a cheque arrived in post for full settlement.:o - I was expecting them saying the defence had been lost in the post and was prepared for a court date. I dont understand how 2 identical claims can be treat so different - one they defend and one they settle in full:confused:
