Hi all, its 8 months since i sent my S.A.R - (Subject Access Request) to my friends at Barclaycard! I have only recieved statements from may 04 & 8 months later im still waiting for statements prior to may 04. I did complain to the Information Commissioners Office & they basically said they were sending my details toBarclaycard at the end of April basically telling them to send the statements.

 

So, all well & good but how much longer are Barclaycard going to take? What is the next step?

 

P.S. With the statements i have recieved i claimed and im in court this Friday 18th May to obtain a DECREE FOR ASSESSMENT (going through Northern Ireland court service) as Bcard didnt enter a defence. I got a letter from Bcard Saturday past offering me the money but thats another story :rolleyes:

Was going to send them a letter now, what could i write? This is really annoying me!

 

Is there any reason why i shouldnt take them to court to get my statements? Coming up on 9 months since i requested & 1 month since ICO told me they were going to get BC to send me the statements.... :(

Well, im answering now.. sorry for the delay, ive been very busy with my friends mortgage express ;)

 

Ive just sent off another request giving BC 7 days to comply (like i did in Feb) so i have a feeling im wasting my time. Will email natalie now as well & let you know how i get on in a week or so time... Many thanks all

Ok guys & gals, after email & letters, just as i expected - no statements.

 

What can i do now? What is the best thing to do? I dont want to wait another 2 months for the court to get into action to get me my statements - ive waited long enough already :(

My 7 day LBA is now done, who will i address it to?? I have addressed all previous requests to "Barclaycard". Will i just stick to that? Here is my LBA:

 

**LETTER BEFORE ACTION**

 

Further to my letter dated 10 June 2007, please forward all remaining statements without delay. As you are aware, the original statement request was made on 15th September 2006.

 

I find it totally unacceptable that almost 9 months after the original request was made to you, statements on my account prior to May 2004 have still not been received. I am also aware that the Information Commissioner has advised you to send the remaining statements to myself without any further delay.

 

Please understand that failure to send my remaining statements with the next 7 days will mean that I will commence a claim at my local court to enforce your compliance.

 

This will additionally involve you in financial loss in the form of any court costs & damages as a result of your non compliance. Also note that I will commence proceedings without further communication from myself.

Hi, I sent a non compliance letter on the 19th june, signed for on the 20th, got my statements for 6 years on the 21st..

 

I added the CAG, LBA sticker to my envelope, got an oh so sorry reply from a Jazz Bradley 0870 154 0154 worth a call...

NatWest Claimed £1,639. Accepted £1,344.

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Barclays 2 Claimed £2,378. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.

Hi folks. Ill cut a long story short here...

 

I sent my Data Protection Act request last year on the 15 September 06. BC gave me the usual runaround, only they got away with giving me the runaround for almost a year.

 

I had to start court proceedings in July 2007 to get my statements & also for £116.00 compensation. (£100 for me & £16 for court fees).

 

They eventually provided my statements on the 25th August 2007 but no cheque.

 

Now they have disputed my claim & im due in court this week - Friday 28th September 2007

 

Just wondering what ill need to take with me as i have my statements, but no cash :(:confused:

The £116 compensation is for court fee (£16) & writing them & the Information Commissioners Office about 15-20 letters asking for the statements. I figured as ive used my time, electricity, recorded delivery mail etc etc that they should pay that back to me or should i give up? Seems unfair, am i right by saying unlawful, that it took them so long 11+ months to send something that should have taken them no more than 40 days?
