    • Ok, I don't necessarily want to re-open my old thread but I've seen a number of such threads with regards to CCJ's and want to ask a fairly general consensus on the subject.   My original  CCJ is 7 years old now and has had 2/3 owners for the debt over the years since with varying level of contact.  Up to last summer they had attempted a charging order on a shared mortgage I'm named on which I defended that action and tried to negotiate with them to the point they withdrew the charging order application pending negotiations which we never came to an agreement over.  However, after a number of communication I heard nothing back since last Autumn barring an annual generic statement early this year despite multiple messages to them since at the time.  So at a loss as to why the sudden loss of response from them.   Then something came through from this site at random yesterday whilst out that I can't find now with regards to CCJ's to read over again.  Now here is the thing, I get how CCJ's don't expire as such, but I've been reading through threads and Google since this morning and a little confused.  CCJ's don't expire but can be effectively statute barred after 6 years (when in my case was just before I last heard of the creditor) if they are neither enforced in that time or they apply to the court within the 6 years of issue to extend the CCJ and that after 6 years they can't really without great difficulty or explanation apply for a CCJ extension after of the original CCJ?.  Is this actually correct as I've read various sources on Google and threads that suggest there is something to this?.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

right i have sent of my very 1st letter to lloyds asking for my six years worth of statements (i know i have paid a hell of alot of charges over the six years possibly about £3000 - £4000 not quite sure) but i'm sure i'll find out!! anyway i need advice the 40 days Lloyds have to get back to me is up on the 21/05/07 not too long now! slighty concerned that i havn't heard from them already! am i being impatiant or am i right to be concerned?? and i am complete newbiee to all this! i have read many threads and to be honest they slighty confuse me!! so i may be asking for quite a bit of help along the way!! what is the average timescale for the entire process from statement request to recieving my money back? from what i have read its about 4-7 months. am i correct? anyway i waffling on HELP ME PLEASE!!!:o :!:

Who knows what the time scale is with Lloyds TSB, its just a matter of

following the procedure, with the correct time scales, and you will get there:)

I started in feb, my court date is in July, so just doing the waiting game

and reading as much as I can on the way:p

My last post for the night! So thought I would say hi!

Ok............well that wasn't exactly it but is close to what can happen when you read lots of posts that may be conflicting, but everyones story is different and each journey of it along the way with different twists and turns.

 

The 40 days they are entitled to by law. So there is little to do now but wait, but is perhaps worth a phone call to make sure they received the request. This might make you feel a little more sure that they are on their way.

 

If, you sent the template letter from the site and £10 you can be assured that you have complied with the Data protection act which a link is below, and that by law they have to send the information.

 

Data Protection Act 1998

 

I always say, wait 47 days. The reason is that if you read the act it states the 40 days starts from the day they have identified you as the data subject! So not the day of receipt as you may think.

 

So hang in there! No you can't go with the mob squad and storm the bank for the information, it will eventually arrive, however the thought not a bad one.

 

Why not spend the next few days - looking at the spreadsheets!

thanks alot remus glad to hear you are so far having good luck hope you get a full settlement soon! however reading other threads looks like youll have to wait till about a week b4 the court date! hey? how helpful have they been to you so far i sent my request to the customer care dept was this right for my statement? i also put a cheque in for £10. i am very excited of the thought of getting my money back, i just hope i am a success story with it? do you know if it is really true that everyone who has tried to reclaim has won? i just find it very hard to believe?!? thanks fot the link too!

It really is a waiting game, I've got cobwebs all over me sat at this computor;)

It is nice to hear a bit of enthusiasm though:p

 

As the charges are unlawful, and the banks are not prepared to go to court to defend the charges, then yes they are having to settle our claims.:D

 

Not without a fight though,:mad: which is why you need to read as much as you can and follow the guidance to the letter/date etc.

 

You will win in the end, with a few more grey hairs:rolleyes:

For some reason I really liked this post, maybe cos im drunk. There is a lot of info to digest but is worth it in the end. Suffice to say I myself was in the same boat some time ago wondering how we could take the banks on and win. The answer is of course quite simple - the banks are in the wrong and we are in the right. Follow the guidelines on this site and you cannot fail. The law is very clear on the subject, take a look at the successes forum if you don't believe me. Lloyds alas seem to derive a great deal of pleasure in dragging things out to the last minute, but think of it along these lines - the longer they drag it out the more that 8% interest clocks up. Damn fools. Remember to just keep the faith and pull up a comfy chair, it will take a while but u'll win in the end

Hi- don't worry- i'm with Lloyds TSB- i received my statements 2 days before the 40 days were up. lloyds should not of won the last case because they didn't even bother to turn up at court. The chap who's claiming said hes going to appeal, he's been offered help from Martin lewis who appears on t.v. If this goes to the high cort there's no way Lloys will defend. I also think the chap was missing some details when he made the claim. Don't worry you will get there.

No Lloyds have not won a really big case against bank charges reclaims, they did not even attend court. but they have jumped on the see its a service charge! also it was in the county court, which can not set a precedent.

 

It just proves the point you must ensure you know your points of law when questioned by the judge.
