    • Yes it would seem they make it up has they go along the IAS had the wrong vehicle and number plate it would have been the elderly lady's vehicle whom my grandson helped pay her fee has she didn't know how to do it so it would seem he paid again with her details by mistake

To answer your question, the value of the laptop is £255.  When filling in the online form to prepare the shipment it asked what the contents of the parcel was and the value and I specified "laptop" and "£255". Thanks.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

... yr having a laff aint u louis!!! From what ive seen on here its about 100 pages which u need an A level for and i left school b4 my exams (u can tell by my prev threads cant u)!

Kia, it was a BOTTLE of wine, in a strange way i was celebrating tho i dont know y.... another £120 bites the dust, but yes, it does feel gd walking out of the court (Knellyk), just dread whats to come!

Relying on u all (as always) 2 guide me thru the rest but im in good hands!!!

I filed my claim on friday, so what happens next??? do i get my claim number thru soon or will it take a while now theres loads of claims going in AND also, should i be doing anything while im waiting 4 details from the court??

also......... just read all of "Mariejaders" thread and now im realllly worried!! i started my claim in feb so my s/s i submitted to court starts from feb (even tho its may now), but ive read that u can only count the date u submit 2 court??? thats a lot of money 4 me 2 lose (3 mths worth of charges)!!!! pls tell me im reading this wrong???

Well ijust sent my preliminary approach for payment. Anyone know approx how long it takes from her and how much more likely they are to drag us through the courts due to ther lloyds bank bol****s??:confused:

I'd just about worked out what to say with your first question , and you add another one:) :)

 

Claim number through soon..........I got mine handed back to me then and there but some courts are taking 2 weeks to process. Abbey have 14 days to acknowledge and then a further 14 days to defend. these dates aren't set in stone for them ( see James33 and Knelly K threads for the different interpretations)

 

Then it used to be AQ stage, but if you've gone to Guildford I would expect them to miss out that stage altogether to speed things up.

 

Can't fully understand your 2nd question. Are you saying you've got charges more than 6 years old dating back to Feb 2001, which will be queried by the Abbey because they're more than 6 years old?

 

If you are then you can just give them 2 fingers, because lots of people are now claiming back beyond 6 years

 

 

 

Is that enough to keep you out of mischief or does it just make more questions?????????????????:) :)

sorry Charley......... i need to clarify myself................ when i first asked for my statements and wrote to Shabbey it was Feb, so my s/s charges start from Feb 2001, which was 6 yrs exactly, but because of them stalling its now may and i dont c how they can wriggle their way out of it, its wrong!! because of them stalling im gonna lose 3 months worth of charges???? which is a lot of money to me.

pls tell me im reading it wrong cos no-one when they start this thinks it will end up in court so the 6 yrs start from when u first write to them.

(ive gotta stop coming on here cos everytime i think im happy and on my way i read something that sends sivers up my spine)!!

You should still be happy, the 6 years technically starts on the day of the N1, but in reality you'll get the earlier ones included because lots of people are claiming beyond the 6 years limitation rule and winning, so don't worry about it....................and if you don't believe me ask mariejader herself, who's currently walking around with a smile on her face, a big cheque in her hand, and feeling disappointed that she never got the chance to execute someboody:)

Theres so many questions arising from that but im gonna keep quiet or u'll b here all nite.

anyway, GOT MY COURT DOCS THRU TODAY .... AAAAARRRRRGGGGGGHH!

It says the usual: deemed to be served 23/5

defendant has til 6/6 to reply!!

What do i do now, anything???

Also, after what charley said yest, am i ok to claim from Feb 2001 (when i started my claim) cos im worried my case might be lost/thrown out because of this??? Its REALLY scaring the wits outta me.

Worried the Abbey will cite this and the judge will bin my case (AND what if i lose............. do ipay court costs??):sad:
