    • By not sticking to the deadline which you set you have lost credibility. Your letter of claim becomes one of hundreds of others which they receive and which they put in the bin because they think that you are just bluffing.  
    • 05.05.24 Ever so sorry if I have entered this in the wrong part of this website.   My grandfather is in his 70's and retired.  He asked me to help him find a work pension that he was paying into when he was working. From 1967 - 1982 he worked for a Fabric Dying Company, Celanese, Spondon Derby UK. I have already used the GOV.uk Trace Pension Scheme. It listed a few pension companies : Akzo Nobel (CPS) Pension Scheme formerly Courtaulds Pension Scheme.  I do not fully understand how this works but I think this scheme is administer by a company called Willis Tower Watson. We have called this company, got through to the pension department submitted all my grandfather's details (D.O.B. , N.I. no. etc.) but that agent tells that they have no record of my grandfather and ask what is the name of the pension scheme. Here is the problem, his home was burgalled in 2005 and a briefcase which contained his legal documents was stolen. So he does not know who was the Pension Scheme company. I have a this phone number 01332 681 210 for Celanese but it just rings and never gets answered. So I am asking for help if anyone can tell us where we can try next. I am also hoping for a massive long shot that one of them members on this website, worked for or knows someone who worked for British Celanese Spondon Derby and could tell us of any pension company. Thanks for any help.
    • Well I sent them the letter of claim, the only responses so far was a few emails reopening the claims on the parcels where they asked for information such as proof of value (which I get) but other things like photos of the parcels, which I haven't got as I never took photos of them. It's been well over the 14 days since I sent the letter now anyway, so what do you think I should do now?
    • Know it has already been answered, but? Does not explain why JCI has registered a different default date when they get the information from the original creditor, Virgin

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

first i received a letter in response to my DPA letter requesting statements ect , from mr Bailey saying they are looking into it by the 8 May thats 8 days b4 the 40 days .

 

also i rang MBNA today asking that they freeze the charges and intrest as they have received my budget plan from MY dmp , I THINK IF YOUR ON A DMP WITH CCS they will freeze charges as they know they are getting a payment, now what i want to know will they get funny if i ask for old charges from 5 years ago .

 

thanks for all the help b.t.w always give them a mobile no and use a spare sim card for banks ect .

Personally I'd give them NO phone number and keep everything in writing :)

Most likely all they will do is refund to your account - but this will reduce your debt anyway - this applies to any others with charges in your DMP as well.

Personally I'd give them NO phone number and keep everything in writing :)

im after charges dating from 2002 till 2005 as from 2005 till 2006 i was paying them on time ect.,i dont know what happens next got to wait till my DPA letter gets a response i think its a good idea to always pay them something cant beleive the hassle every 1 is having with MBNA.

b.t.w whats a I.E form ?? the women i talked to at MBNA said a budget plan was on the cccs website ,so MBNA must have acess to my details can they see my other creditors to who im paying .

And if you sent one to MBNA yes they will be able to see who your other creditors are and what you are paying them. Which is agood thing as then they will know this is all you can afford to pay them.

 

As for will they get funny if you claim back charges? Who knows with this bunch of (no best not say what I really think).

 

As I'm in almost the same boat as you in regards to MBNA this is what I received in responce to my S.A.R - (Subject Access Request) on three cards I have or had with them.

 

1. For two of the accounts, a list detailing Card No./Date/Fee Type/Transaction Type/Transaction Description/Trans. Amount

 

1. A letter which basicly say that their charges are fair you knew what they were when you applied for the card. They mention the Office ot Fair Trading recent guidlines on the level of charges and how they don't agree with them but reduced their charges to £12 anyway and you will receive

notification of the changes in terms and conditions. The next sentence says "We expect you to honour the revised terms of your agreement with us. If you do not do so, we will have no alternative but to formally terminate your credit ageement." Then on the next page as a gesture of goodwill my accounts with £80 on one and £10 on the other. This represents approx. 30% and 50%, respctively, of the charges discovered so far.

 

3. A copy or their "Our commitment to YOU" leaflet.

 

Sorry to be so long winded about it but had get it right as this is what you might get. If not plaese post what you get, omitting all personal details of course.

basically i am after the charges before the £12 was put on the account the charges since 2001 to 2005 as 2006 was frozen till i missed 2 payments jan till aprill this year i was charged the £12 hopefully they will freeze the intrest and charges as they know they are getting some payments ..
