I do acknowledge that you have mentioned in your letter that the value was higher, however, you did not take out any protection to that amount. The protection for this shipment was £20 and we will not be increasing our goodwill offer any further.    Please log into your account online in order to accept our offer. Once accepted, our accounts department will process the claim accordingly. The claim payment will be processed and received within 7 working days.                                  In addition, a refund of the carriage fee will be processed as a separate payment and will be received within 3 working days.  If I can further assist, please feel free to contact me.   I have also just noticed that yesterday afternoon they sent me an email stating that "after my request" they have refunded the cost of shipping. I did not request the refund so will mention that in my letter as well.
    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy?     • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks. Just contacted them and lady I spoke to agreed with me that there should be something inside saying letter 1 of X etc. She apologies and said that they have no excuses really. She also said that she would contact the department (OFT dept or something) and said they'll be looking into it and contact me back if need.

 

I reminded her that I would expect a call either way advising me as they have 40 days to comply from the day the letter was received by themselves. She agreed and said they are very busy right now with a lot of 'these' requests :lol:

 

As for my 40 day. It's quite far away yet, although never hurts to keep reminding them of that! Which is the reason why I didn't want to wait until the 40th day to see if anymore would of arrived. Preferred to know.

NatWest called me back already and you were right, Micky. They are sending 2 batches and said I should receive the 2nd very shortly and if I don't to call them back on same number I call.

Just a quick question. I'm starting on the spreadsheet now to get a headstart as theres a lot to go through before getting the rest of the statements. I'm only on 1st page and have the following...

 

"Interest Due - Interest 5th Feb-4th March - £3.76"

 

Is this overdraft standard interest which can't be claimed back?

 

How about card misuse fees? Can those be claimed back. They charged me £75 for one :eek:

Also, what about the OD Interest? Can I get that back? I'm thinking I can't unless I went over the agreed OD facility. I'm talking about standard overdraft interest.

Worked out that I have £678 from the period of statements received (22/03/01-01/10/02) This is entirely penalty charges. No interest on there. Not sure if I can claim that back so haven't added.

 

God help what the rest will be for the next 5 years :blush:

Hi Lisa, you can claim back the overdraft interest - but only a portion of it! If you download the right interest calculation spreadsheet (depends whether you're on excel or works as well) you can reclaim the portion of interest that's been applied purely because charges made you overdrawn/go over your overdraft. Personally, I didn't bother (went way over my head!!!) but loads of peeps on here have gone for the overdraft interest and got it back! Good luck, hedgey xxx :p

Hi Lisa, I have attempted to claim a lot further back than you, but if you still have problems in receiving all of the statements you require it may be useful to include the code for accessing pre 2001 that Nattie has posted on my thread. i only received 4years (need 15) there are now 15 days left on DPA SAR, letter to post tomorrow! Good luck, bob m.

Got remaining statements and got weird A/C charge of just £2.14 and directly above it is an interest charge, so it's not additional interest. It says "charge" on the left also and all interest charges say "interest"

Not got a clue what that is Lisa - it's a bit baffling! Best advice I can think of is to phone Nat West and ask them to clarify what the charge is - they should be able to identify it, then you can see if it's something you can reclaim or not. Hedgey xxx :p

OK remaining statements received today and calculated all penalty charges totals £2,235.14! Much more than I imagined actually.

 

Pre-lim letter will go out on Monday recorded delivery. Going to scan all statements that have charges upon them and highlight charges and make copies for my records.

 

I assume for this amount they're going to ride it out to the court stage. Any help on the courts would be appreciated as I have literally NO idea what I'm doing *blush*

To be honest Lisa, the amount being claimed doesn't seem to matter whether it goes to court or not. Some peeps have claimed more than you and received payout at LBA, while some have claimed less and yet had to go to court! There isn't any real rhyme or reason to how nat west deal with our claims............ it's a bit 'eeny, meany, miney, mo'!!!!!

 

It won't do any any harm to start reading up on the court stuff now - particularly the stuff that tells you how to fill in the N1 claim form with your particulars of claim (see here - http://www.consumeractiongroup.co.uk/forum/bank-templates-library/681-4-particulars-claim-n1.html).

Just finished my pre-lim letter and it's ready to go Monday. I'm quite excited about this now :lol: Just spent the evening scanning and highlighting the statements that have charges on them ready for their defence (if it goes that far!) I'll provide all the evidence needed and these thieving gits won't get away with my dosh :)

 

Couldn't get the spread sheet to print though so had to put it on a webpage and PDF it from there, good enough for me.

Just an update to say that pre-lim letter has been sent today 1st class mail. They should get tomorrow hopefully *bites nails* :lol:

 

Hopefully *crossing fingers* this claim will settle fast. I really hope so because I can't be arsed for hassle. But on the other hand, if they cause hassle and refuse, I will fight for my money back.

 

Robbing gits took our money when we were at our lowest and now it's time we got it back.
