    • Hi I've dropped myself init now. Just found a letter of claim down back of my radiator, it's gone over date by 4 days, i was waiting for one to arrive so i could send off oca letter, what is my position now.
    • Thank you very much. I will take this on board. I have spoken to the site manager who has confirmed they can provide a written statement. They are also trying again through a different route to get hold of the owner to confirm their arrangement. Hopefully this would help my case.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Abbey are up to their old tricks again !!!!!!!!!:confused:

Today I got a statement with charges from before when I got my payout from them will they never learn......

In the same post I got a letter addressed to my other half not me saying that they would investigate my complaint so not only are they addressing it to the wrong person they obviously don't realise in the complaints department that they have already sent me a big cheque.......

DO ABBEY HAVE ANY IDEA WHAT THEY ARE DOING ???????????

Why not send a copy to the Financial Ombudsman so that they can add it to the ever increasing Abbey file.

 

It just proves that the left hand does not know that the right hand even exists.

My cheque arrived with a letter stating as promised here's your cheque now please stop the court action I never did get the letter promising me the cheque.

I really hope their nights out aren't in a brewery.......:lol: :lol: :lol:

LOL nightnurse, i had exactly the same problem with them, when i rang them to remonstrate and told them that if they didnt refund them immediate I woud commence another claim, they hung up on me and I started a second claim and won and now i am starting a 3rd!!! The short answer is that , no, they never learn

This might explain why they have dollies in their the branches and you have to use those stupid phones to speak to india if you have a problem even if your in branch.

Also the last time I went into Gloucester branch they had a person apologising for the queue instead of putting her on the tills and reducing the queue.........

Perhaps the squirrels from their adverts could do a better job higher IQ.....

When I told the teller at my local branch in Carmarthen that abbey had paid me and how much she just stared at me as if I'd spoken in Swahelie so nothing surprises me with abbey anymore.........looks like it's mcol for me again if abbey insist on these new charges.......yeah I vote we ask for the squirrels to take over the company.

I wonder just how much inside info the bank clerks actually have, are we slagging them off unfairly? Did they know that the banks were acting unlawfully or were they just trained without certain knowledge? If so, poor things, they are at the frontline too, they are the ones looking like idiots. But then again, if smuggness comes with innocence then they are fools to themselves for not knowing about the company they work for.

If they did not know what was going on they sure do now.

 

They may well agree that the charges are too high but they will not bite the hand that feeds them-the more money the bank makes the more they take home whne the bonus season hits.

 

I wonder if they have to pay the same charges as us?
