Can anyone help me..........I was told I had to withdraw my original rtb befoe subsidence works would be done on my council house,,,when I put straight back in for the rtb when works eventually finished,,,,price had risen approx £60k,,,,,,,question is: was I hoodwinked,,,,,know I was bullied by them,,,,but eventually ended up buying and struggling to pay mortgage....can anyone advise please.

Did they as you to withdraw your applicaiton in writing? or are there any othere records, correspondence etc showing the pressure that you were under? have you made a formal complaint to the council?

If you do have any evidence that you were 'hoodwinked' you could take your case to the ombudsman who has hte power to look into cases such as this and recommend furhter action.There have been cases in the past whereby the Ombudsman has recommended that the property be sold at the original price offered and if this was the case you would obtain a refund.

 

In any event, if you are struggling with your mortgage and your lender threatens court action - seek independent legal advice as this may save your home.

I wrote many, many emails at the time and council really dragged their feet in doing the works even after I had complied and withdrawn,,,,almost begging emails asking them to start the works as promised........they were very clever and no, did not put it in writing but when I compalined the complaints dept did put it in writing to say words to the effect of "they have been advised by their legal department council were right to ask me to withdraw"......I have no money to get a solicitor and this was approx 3 years ago,,,,,,,can I still take action and also is there any legal people that could help me,,,,,I don't know how to proceed from here although I know they almost gave me a nervous breakdown at the time and I was very badly bullied by them.....

You are supposed to make a complaint to the Ombudsman within a year but, as I understnad it, they do have the discretion to listen to complaints outside this time so may be worth asking again, although three years may be too long. I would suggest that you seek advice from a housing specialist advice agency or CAB.

I did try the ombudsman, and they said I should get a soliticitor,,,,cant afford it,,,,,but know what the council did was not right,,,I was uneplyed at the time and struggling single parent studying,,,,,is there anyone here on this site that can advise of solicitor that would deal 'no win no fee' for housing matters.....?,,,oh think I should mention I even had to move out of my house for council to do massive repairs,,,,,,:(

Doubt you would get a no win no fee for this. However, might be worth looking to see if any would take it "pro bono". What timescal between your initial RTB and your second?
