I had a mortgage with Gmac and have over £2000 in late payment fees.. I have sent them the first letter and have received a reply back but they are addamant they are not paying anything back..

 

Do I have a chance of getting this cash back ?

Yes they have paid out on all claims so far without going to court. Although you may have a long wait the generally pay out a few days before court and will try every trick in the book to put you off.

  1. SAR
  2. Preliminary Letter
  3. Rejection of Offer...if any
  4. LBA
  5. File in Court.

If you follow the process...it is.

 

Trick is not to fall for their arguements, and not be scared of taking court action.

 

If you stick to your guns, you'll get what you're owed.

GMAC have indicated in a costs hearing with us the they are awaiting the result of the court hearing in the High court, but as I understand it this is just a delaying tactic as they are not party to it so its onward and upward I have allready got some of the solicitors costs back and the case has been adjourned until the 6th November when I expect to get a ot more back

The OFT test case doesn't relate to Mortgages, only to bank accounts.

 

If you claim gets stayed, you can appeal.

I have not been on site since August due ongoing health problems, but am now about to start reclaiming fees back from GMAC and Kensington can you give me any tips? Also is anyone recaiming mortgage ERC no or is that still on hold?

SPML - issued MCOL on 21.11.06!

Kensington - statements received letter requesting £2455.55 refund of charges issuing MCOL for ERC

MBNA - refund £341 offered-sent letter requesting refund of £3846.59 charges!!!!!!

Capital One-going to issue MCOL for £1243!
