      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Does anyone know if we can insist on the money being paid back in the form of a cheuque? The reason is as i may of said I've enterered a debt management programme and the account is working on a reducing overdraft policy at the moment! I obviously want the money and not the debt to be wiped off from the overdraft? I know if they don't act within the 28 'or so' days then i can insist on them paying via cheuque, that is with the judgement button on mcol.

 

But I'm not to sure how these reducing overdrafts work...can you still withdraw from them? or can i write to Mr Bacon asking for the money in cheuque format as the overdraft repayal has been agreed.?

 

Ne advice welcomed.

I think you'd have to state it in your Particulars of Claim. To do so you would have to pay to amend your claim.

 

I have no idea about the overdraft though. They've never been silly enough to trust me with one. ;)

Ok many thanks Kelly, I've just rang MCOL and they say you need to pay £35 to amend, and it can take upto 4 weeks, which would mean start waiting again, I think i'll just wait and see what they do next, if they make an offer i'll just insist on them not paying it into my account.

 

If not the lady said that they have until midnight on the 14th May to enter a defence or pay.

 

It's a little frustrating, all this waiting and then it may just be swallowed up by my overdraft, doh!

Good luck Ozz. I know you'll miss the lump sum if they do pay it into your account, but you'll feel the benefit in the coming months. I hope they do give you a cheque though. Spending it will be fun.

woop woop woop people!!

 

Just checked my balance online and there has been 2 corrections today!!

£999.99 & £159.00

Not quite all back yet but will check tommorrow.

My MCOL wasn't due to be up until 13th may so this is quite early!!

 

stick with it people, it's daunting but worth while.

Thanks to all the CAG community that helped with this - I've remomended this site to loads of friends.

Hi Guys,

 

Just got my MCOL letter saying that NBS will be defending "all of the claim". Deep joy. Cut-off date is now 30 May, so have to wait and start putting a court bundle together!

 

Thinking of calling the CEO of NBS as a witness, just answer some questions.

 

Anyone think of anything I need to do or find out specifically? Nice result by the way OZZ! Hope you didn't drink it ALL!

Hey Mrsid, i had exactly the same and i have no doubt it's NBS trying to stall it. They say they will defend and probably have no intention in defending, they use they time to process the claim and pay up. In reality you are now in a cue waiting for a refund. It's wise to have you court bundle easily available but most will be at hand anyway. Keep checking your balance, in some case as per other blogs they pay up before the 28 days expires but be aware they have been known to pay on the 29th, 30th, 31st day after you enter the judgement.

 

Just keep an eye on the situation - i became quite the opsessive compulsive when it came to checking my account balance.

SAme thing with my claim-one day they said that they would defend in full and then about a week later they sent a letter saying that they would settle the claim for about £40 less than I was looking for.

 

Gooid idea to get the bundle ready just to on the safe side but hopefully you will get paid shortly.

woop woop some more! Just checked my balance and it seems they have paid £260 (interest + court fee) back into my account - oh and whats this an extra £757...lol get in!!

Must be from my other account with them that got closed - was going to claim this one but didn't think it was that much!

 

Im going to have a great birthday now!

OK, received a letter, dated 24th April, from Nationwide thanking me for my recent letter about the charges applied to my Flexaccount.

I think this is a pretty standard letter, informing me of the rules I agreed to, etc.

The third paragraph reads:

"After careful consideration of your request, we're sorry that we can't agree to your charges being refunded. Only in exceptional circumstances do we arrange refunds, and on this occasion we feel it would be unfair to other members who find themselves in a similar situation and for whom the charges remain."

 

This letter did not arrive until 2nd May, possibly due to our postal area which is sometimes a bit slow. However, I checked my Flexaccount today, 8th May, as my MCOL time was up on the 7th, but being a bank holiday thought I would wait until today to see what if anything was happening.....

I was credited with two payments on the 3rd and one on the 4th May which amounts to my claim...so great news I've won!!!

Strange how the letter arrived on the 2nd and I was credited on the 3rd against the tone of the letter!

 

I still can not believe it. Can I say a great big thank you to all here on the forums for the support.
