    • Hi everyone, I have an update on my case that I’d like to share with you all.  so after submitting 371 pages in my bundle, a witness statement and skeleton argument for my court case due to take place in Manchester on June 21st I got an email from my litigator stating that hmrc have pulled out and the case is now closed!    this is the body of the letter….. This letter, which is copied to the Appellant, pursuant to Rule 17 of the Tribunal Procedure (First-tier Tribunal) (Tax Chamber) Rules 2009, the Respondents gives notice to the Tribunal of their intention to not defend the above appeal.   The Respondents respectfully invite the Tribunal to allow the appeal and close its file. In lieu of the above the Respondents would respectfully ask the Tribunal to vacate the hearing scheduled for Friday 21 June 2024. We would accordingly invite the Tribunal to close its file. Obviously this is extremely good news which hasn’t sunk in that after 3 years of fighting it is over.    I do have a further fight on my hands in that the Group Action I had joined with Independent Tax that had been disbanded in November last year and I chose not to continue with them. They are trying to bill me over 5k for the work they did under that Group Action which is ludicrous bearing in mind the whole point in joining was that it would keep the cost to a minimum as it would be shared between us all. They had asked if I wanted to continue to have them represent me on an individual level which I declined, if I hadn’t, goodness knows what they would have been trying to charge me now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Tinhat I think were about the same time scales, I posted schedule of charges yesterday too. I will keep an eye on your thread see how things are getting along, will also keep you posted of any developments with me. Hoping i have a bit of a leaverage tool, as FD sent statements to my old address and courier left them with a neighbour who 'kindly' opened them!!! so ive also registered an official complaint with them about it so fingers crossed they will want to get rid of me quickly!!

I sent my prelim on 31st March and on 5/4 I got a standard reply saying they wil write again in 10 days. I'm sure you will get this soon.

 

Roughly how much are you claiming? My claim is for over £3.5K!! If the interest has to go on it will be near £4.5K. I am wondering if they have a different process for different claims? :confused:

If at first you don't succeed, dig your heels in!!!!!!!!!!:D

Well got my letter today from the bank saying how sorry they were about my concerns and enclosing a leaflet which provides details of banks complaints procedure. They have advised that a response within the next ten working days will follow. Sounds familiar to anyone?

Kitty63, did you send recorded delivery as I sent my letter with spreadsheet of charges on Thursday before Good Friday by recorded delivery and I must admit I was surprised to see a response so quick. I will give them the 10 days from the date of their letter date and see what happens?

What do you do then when the 10 days are up? My letter is dated 11th April so I am assuming that I count 10 days from that or is it when I received it on Thursday 12th April. They also metion within the next 10 working days so I don't count Sat and Sun.

I'm just going to stick to my timetable and send the LBA at the end of my 14 days, I think they have had my money long enough!!

I got the same letter from them, I just ignored it and sent my LBA yesterday (recorded), If the 14 days you gave them (from your prelim) are up

I would just send you LBA

Guess what! HSBC have rung me tonight and made me the full offer. I haven't accepted I will now wait for the declaration in writing confirming this which they have promised to send me, said they would put the funds into my account. Sounded very keen to settle! :)

Thanks. My claim was for £1500. When they rang they did say they have been extremely busy. I was overdrawn anyway so maybe why the quick response? And also not as much as yours?

I got a letter yesterday saying charges fair and legal etc. but I've already sent my LBA off about 11 days left for them to reply so will see what happens!!

Happy with declaration but how do I go about claiming for the charges which are to be applied to the account in May? I don't want to deface the declaration they have sent me.
