Hi, i'm at quite a late stage in the reclaim process and have had a response from cobbetts that i'm not quite sure how to react to. I received a CPR Part18 request from them and replied using a letter from this web site that basically stated i do not need to produce this info unless requested by the judge. I sent one copy to Cobbetts and a copy to St Helens County Court by recorded post. I have since filled out and submitted an AQ form to St Helens County Court as well. Earlier this week i received a letter from Cobbetts saying they had submitted there AQ to the court and enclosed a copy. However, in the Other Information section they state

" Case Management directions cannot be proposed until the Claimant serves a reply to the requeest for further information which was due on 23rd February 2007. In light of this, the defendant may amend its Defence or apply to strike out. "

Can anyone help with what my response should be to this.

Thanks, dink

Yes i sent a draft order which i got from this website. Thought they might just be scare tactics. Thanks Fire fox for the piece of mind. I'll keep the thread updated with the response.

So the banks solicitors, Cobbetts, now want all the information, every charge listed over 6 years - they refute the claim stating "particulars of claim do not disclose reasonable grounds for bringing a claim.."

"...claimant must plead all accounts to which charges relate.." read the letters to your client I think is the reply here? "...the claimant is put to strict proof of each and every charge the subject of the claim..Dates the same was debited...the amount of same....the description aplied to the charge.."

They then go on with a string of areas I have to prove....within 14 days,

Come on! Why make an offer and then go down this road after our refusal, any help here would be gratefully recieved
