      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

That's all I got from Halifax - a schedule of charges. No statements, no interventions (not that I had any).

 

Should I have got statements too?

 

Sent my repayment request today - recorded delivery so I can prove they received it. When is the 14 days - from posting or from receipt?

Well the LBA was sent off on the 16th and have not heard a thing from them... Im going to see if anything comes on Monday. If not I guess it's time to move the next stage.

 

I'll be honest. This is where I start getting nervous. I've done a bunch of reading.. I think I'm pretty clear on what to do..

 

Anyone got any last minute advice?

 

Did you get to this stage? What happened?

Well using the link Michael posted and some other advice offered on the forum it looks like I'm going to go with mcol. I can fit my claim in okay under the allowed amount of characters and so on.

 

It looks like it's going to cost 120 quid to do it though.

 

I have everything filled in and ready. I'm just going to wait (and pray) that it wont be needed and I'll have a wonderful little letter waiting for me when I wake up in morning giving me all kinds of good news....

Well nothing came on Monday morning... So I got my claim in using money claim online. This morning I sent off a few copies of my schedule of charges with the cover letter to the court...

 

Just time to wait now... I guess..

 

Overall, with charges, (120 quid) I'm claiming back just over £2000...

 

Wish me luck.. I'm scared stiff here. I think I would crumble like a digestive biscuit if this ends up in court...

Hi they have not taken anyone to court yet so just keep going they may make no effort to do any thing so you win by default they may enter standard defence on last day this gives them I think another 28 days then they settle with you. Don't forget if they ring with an offer now you want charges, interest and costs.

Okay guys. I just received my Notice of Issue. Says it was posted on 1st of May and that the 6th of May will be deemed the date served.

 

So now I have until the 20th for them to reply... Wish me luck.

Well I still haven't heard anything from the bank. I was expecting a Notice of Acknowledgement. Is that not a guaranteed thing? As long as MCOL says my claim has been issued do I just sit back and wait?

 

Like I said. May 20th is 14 days from date served. Do I just wait and hope I dont hear ANYTHING really and then just win by default?

 

I just feel a bit...Like I have no idea what's going on now.. If that makes any sense. Like I dont even know if Halifax has my claim or not..

 

Just have to wait I guess.

Well I just read the step by step instructions again. As always, everything I needed was there.. I guess I was just trying to reassure myself that Ive dont everything correctly so far.

Today I received the Notice of Acknowledgement. So that gives them an extra 14 days right?

 

So that's 28 days from the date served (which was the 6th) so that would make it the 3rd of June when I need to apply for judgement right?

 

Have many of you guys been to this stage? Ho do things usualy work out for you? If they make an offer before the days are up how do they contact you? Just by letter saying come and get it? Or do they pu it into your bank? Or would they ring me and try and get me to settle for less?

 

And if it does go to judgement have many of you guys been that far? How did that work out for you? Did they contact you after the judgement was made?

Yes they now have another 14 days.

 

They might put the money into your account, so keep checking, as they do this without letting you know.

Hey guys. Me again after some more advice.

 

I received a letter today from Halifax Customer Relations in regards to my "recent complained" about the charges on my account.

 

It says they carried out an investigation of my complaint and they are satisfied that the charges were applied correctly and then gave a bunch of reasons behind said decision. They then say if they don;t hear from me within 8 weeks then they will assume I'm happy.

 

The above also came alonge with a "helping you to understand our charges" leaflet.

 

Now as you can see above I have already put my claim in with MCOL and have received a Notice of Acknowledgement from their solicitors. They have until the 3rd of June before I consider making a judgement on them via MCOL.

 

So do I just ignore this letter? Is this just like a standard reply? Maybe to that initial claim I made where they then said they have several weeks in which to get back in touch with me?

 

I just want to make sure I dont mess this up by ignoring something I should have replied to or vise versa.

HOLY CRAP!!!

 

I just checked my bank account online. They've paid up. EVERY PENNY. The charges, the interest and the mcol fee. Just over £2100 quid in all. I'm in shock.

 

I'd like to thank you all so much. Especially sea-sidelady who has been there to help at every step of the way.

 

A few final questions though. I havent heard anything from the Halifax. The money just turned up. Docent even say who from.. just says "cash" and has two deposits. the initial charges and then the interest.

 

Do I need to do anything else now? Do I need to do anything else with mcol? Like cancel the proceedings so to speak? Or do I just go on with my life and everything will be finished up automatically?

 

This site has been a fantastic recourse. I've already recommended it to so many people. can't wait to tell even more people now.

Hiya thomasl - i am in ezactly the same boat as you - I got a "we are happy that these charges are justified" letter from Halifax and last Friday (25th) entered a MCOL online and have just spoken to the courts and the paperwork is going to be issued tomorrow 305/07 b4 10am, they then have 5 calendar days to acknowledge receipt and a further 14 calendar days to enter a defence........will keep you posted.
