      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:) Hi everyone I was wondering if anyone in here can give me some good advices. Here is the story:

I've just received this morning a packet, it was delivered by the postman by normal post. I opened it and found a children book, a letter and a bill inside. I HAVE NEVER EVER ORDERED A CHILDREN BOOK OR ANY BOOKS AT ANY TIME !

The letter says: "Thank you for replying to our tale of rabbit offer "...bla bla bla... please remember to pay the postage charge of £1.50 .The bill shows that the book is free ( a very small rubbish book not even a kid would want to read it:eek: ) but that I have to send a payment of £1.50. And I never ordered a book and don't even know the company.

The bill is addressed to my name and the company got my full address I don't know how.

It's written in very small that if I don't want it I will have to pay the cost of sending it back:x and that by replying to their offer ( which I never did!) i have to buy at least 6 books per year otherwise, If I don't order I will have to pay for the price of 6 books a year anyway. Charges will be added in I don't:x .

There is only one phone number on the letter, and it's written that this number is to be called only if I want someone from the company to come to my house from SWINDON (far far far way from my home) to collect the book AT MY OWN COST!!!!

They gave me a website address :

I've had a look and the book they gave me for free is worth 50p which is a third of the postage cost they want me to pay:eek: .

Obviously, I don't want to pay for something I never ordered and to a company I never heard about and i don't even want to pay for returning a book that I never wanted or ask for. I know it's a small amount for now but if don't do something they will ask for even more in the future.

It 's strange because I've been receiving lots of harrassement calls lately from different book companies and and I had to hang up the phone many times because they won't accept NO I DON'T WANT ANY for answer. I don't know wher they got my full name,address and tel number (mobile and home ) from. Maybe there is a link between the calls and this bill.

Please help me what should I do???? Have you got any sample letters to send? or to whom should I report it?? Should I put everything in its original box and give it to the postmaN to return to the company??Have you ever heard of this company or this type of activity??

If you've not signed anything then they can't force you to pay, if they want to keep sending you books thats up to them. the same happened to me a number of years ago, i received a phone call to see if i wanted childrens Disney books, i agreed, they sent them, they asked for payment, i paid jack s..... Don't panic.

I am sure you didn't. My brother got a default on his credit record because some books he never ordered were delivered to his house while he had builders in. He only found out six months later when he was turned down for a loan and went to check his credit record.

Thx :) so you're saying that I should keep the book and ignore the bill and letter? so what if they send me another book and a bigger bill? what should I do next time?

 

I wouldn't acknowledge that you have received anything... and if they send you any more (which you will now recognise !), don't open them !! Write "return to sender" on them and drop them in the postbox. They are sending them out at their own risk by not asking for a signature anyway.
