      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ummmmm, I was just telling Enaid though earlier. I think Ive cut back a bit too much this week, because not only have I gone onto organic, this is all just for a month, no more, and only eating super foods, i.e. lots of spinach, broccoli, fish, chicken, blueberries, cranberries, nuts of all kinds, lol.......... and drinking at least 3 litres of water a day, and only having black coffee, no milk, no dairy, no carbs, no bread, no potatoes, but every other vegetable you can think of, but only organic, but Ive also cut down the portion sizes to those of a 3 year old child........ and today Ive taken it a bit too far............. Not eaten enough I dont think. I was all spacey and floaty and felt like you could peel me off the ceiling, so I cheated tonight. I had a matchbox size piece of vintage cheddar. I needed it........... I thought I was gonna pass out. Lol. So I think I need a few more veggies tomoz......... Lol. I dont wanna end up ill.............

 

Yeah, those nuts, pine nuts, hazlenuts, brazil nuts, theyre gorgeous. I just love nuts of any kind.................

Work was a bit of a nightmare................ why does the government depts you need to speak to move around and change so much. Was trying to find the dept that refunds duty and VAt on imports and took me 9 numbers before I got through to the right department...............mad......

yea i was looking on it yesterday then i tried to go on the original CCA one but theres 101 pages!!!

Eyes blurry, my chuffin brain went blurry........... I just dont get what its all about but it seems to have some peeps fired up. Lol.............. They just need to learn to keep a lid on it I think.............or find other ways of venting their steam............ like me.......... when I get letters from Cobblers, I just boot the football against the garden wall for 10 mins, and pace up and down the stairs till Im tired and not angry anymore. Lol Lol xxxx

As i know the main natwesters pop on this thread, Mortee has confirmed the 21 days for a letter is WORKING DAYS, i think we have to advise suing the bank from now on as the timescale is over a month which is not right, I am afrraid to say.

Boobies, I think Nutty Westy have had and are still having their fair share of boobies.

Ta Caz......... although I think I might have to change it......... cos every time I see it dancing there, it just makes me think of food, and Im not really having that much at the mo. So might have to change to something else. Lol Lol Lol.xxxxxxxxxxxxx gotta stop thinking about food.................. I only do it when I bored........ and boy am I bored, its my day off, all jobs done, and can only think about food.............. Im busy filling in kids passport renewal papers cos their passports run out next month both of em, and I cant be doing with me winning my spondoolies back from Nut West, then wanting to book a holiday to places distant, then finding I forgot to renew kids passports. I couldnt possibly leave them at home.......... no fair............................ So Im renewing them, just in case................. more bl**dy expense.......... Just had my decking wood delivered this morning and that was 850 squid. Good job hubby paid for that............................ Lol Lol. Im broke till bank payout day.............. Lol xxx
