      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well Done, enjoyed reading this thread. Good to hear these stories.

 

I started mine in August and got my court date in December for the 27th March - not heard a thing from them as yet - hope i hear something soon, sent my bundle to Abbey at the End of December!

He rang me in the end and they caved in totally (I don`t know how I stopped myself from laughing when I was talking to him)

Oh yes, the Shabby Round 2 (They sent me microfiche statements going back 12 years:o ) so after I`ve cashed their cheque I`ll start preparing my case.

When I made my SAR request last year, I got the normal "Not a relevent filing system" letter, and wrote back telling them basicaly if they don`t play ball then I`m going staight to court with them.

I received a delivery by TNT Courier of one massive envelope, inside was all the documentation I`d asked for, along with my microfiche data going back as far as 20/04/1994

The paper that they are printed on has the following reference on (MISC 0337 Jul 06 F), so it`s not that they found these prints somewhere and decided to send them, they actually printed them off of their system.

Hey Armsoft , you and everyone saved my weekend from being a total bag of wobbles hee hee. im so pleased for you hun well done. They are in such a mess arnt they ha ha..

 

You know if you had a credit card about 3 four years ago and dont have any info about it. ie acc no etc is there anyway you can get the info about it or is it tuff i should have kept a statement??

Write to the Card issuer with a general SAR request.

Use the wording "any accounts held by me during the past 6 years" rather than heading it with account details etc.

I had 3 accounts with the Shabby and could not remember the details of all of them, so sent a general SAR and ended up with the information for all three accounts, so as long as you hav`nt moved house since the account closed you`ll be fine.

Hi there,

 

CONGRATS first of all. I am just preparing a court bundle for my MIL but it has to be in by Friday so time is running out!!

 

Anyway, sorry!!, I had a similar issue with a Nationwide account that I held and they were really on the ball and sent everything through to me. Basically you just give them as much info as possible about yourself, previous addresses, names etc and they have to provide any info they hold on you so subsequently you should get you info, just send an SAR to Barclaycard and start all over again!! Good Luck, sure you will not need it now you have suceeded once!!

Hiya To everyone, Just thought Id give you a quick update!!

 

Went to Court today the judge was wonderful, he said that he was very impressed with my court bundle, ( i mentioned CAG !!!) and that he was happy to adjourn for 14 days. James Arrandale bless him, sent me the receipt for the payment made to my new bank account, and told him thanks very much and will talk to him again in another 6 months when i put my claim in for the last 5 months hee hee ooh did he stutter ha ha Love it!!!!
