    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes this just confirmed today by GE Money and is coming in writing.

The story how this happened....right I requested my S.A.R and the deadline was 17th Jan. Rang and spoke direct to DPC to ask what was happening and to remind them of the deadline. Ok a Denise promised to ring me back the next day to allow her to investigate. She did and and I received my mothercare statements and charge transactions, which I found confusing to say the least and told them this. No top shop account statements either, even though this was always paid by Direct Debit so I remember there was only a couple of times this was not paid back in 2003 when I closed it. Still I had requested these.

Anyhow a Joanne rang friday promising to ring concerning these issues on monday. I missed the call I had already totted up the mothercare charges £120 and beleive top shop to be £30 more so £150. Well I missed the call and she rang back today. They offered because of this muck up to clear my mothercare account of £266 and balance down to zero and advised I had every right to reject and make a formal complaint concerning Top Shop.

Well I accepted cos I have been give approx £116 more so all in all VERY HAPPY and never really did athing:)

Hi rosemary

Send them a S.A.R - (Subject Access Request) (http://www.consumeractiongroup.co.uk/forum/bank-templates-library/516-1-data-protection-act.html) to get all your statements if you haven'e kept them.

Once you have your statements you can then list all the unlawful charges they have made on your account and the interest they charged on top.

You should start your own thread on the 'store cards' forum so that we can help you along, encourage you and offer congratulations when you win.

I was wondering this too, as I had an Etam card, and Newlook which used to be GE Capital. Now called creation??

I think Creation are a different company than GE Capital. Different stores use different providers and they can move them around. Creation have a DUET card. They used to do the cards for the Sears Group of companies. Some of those companies were sold on and changed to their new owners partner usually GE. Creation still provide cards for some companies - this link should give an idea of who they provide cards for. Creation Financial Services Limited - A unique range of skills

  • 4 weeks later...

Hi there, I sent an SAR to GE Money some time ago for two store card accounts, I recently had to send them a letter of non-compliance as they never sent my statements. Anyway today I received a letter from Mark Metcalfe of GE Money offering a full refund of the charges applied to the two accounts, and that I will receive this amount shortly.

Firstly, I have never received my statements or even a schedule of the charges, so how do I know if the amounts are correct. And secondly I had these cards some time ago and have since closed the accounts and cut up the cards as any owing amounts were paid off, so I don't know whether they're going to send me a cheque or refund onto these old accounts. So what I want to know is has anyone got a direct number I could phone, as there isn't a telephone number on the letter they sent me, even though Mr Metcalfe told me in the letter to ring if I have any queries!!!

Thanks x

Can Someone Help Me Here? I Have Asked Ge Money For The Charges On My House Of Fraser Store Card And Have Been Sent Statements For The Time That The Account Was Passed To A Collection Agency, But The Previous Two/three Years To That, They Are Saying That They Cant Retrieve Because Of Technical Problems. Can They Do This? And What About The Interest That Was Charged During The Short Time Before It Was Passed To The Collection Agency? Its Collossal! What Started Out As Me Owing Them £350 Ended Up At Almost Two Thousand!!

I am claiming back charges from GE Money store cards . I hava had a full refund of £120 from my Debenhams card. This was offered after just one letter. They won't pay the interest though, but to be honest I didn't expect to receive it as I don't particularly want to go down the court route.

I am still waiting for statements for the other cards.

I also successfully claimed back £180 from Creation Financial Services relating to an Adams store card I had some years ago when my children were small. They settled after the second letter and included interest in the final calculation.

It's money I didn't think I'd ever see again!! My advice is.....GO AHEAD AND CLAIM IT! NO MATTER HOW SMALL OR LARGE AN AMOUNT -IT'S YOUR MONEY AND YOU'RE ENTITLED TO IT!!

GOOD LUCK EVERYONE!
