if i have incurred more charges on the same accounts which have stays against them, what is the best way to go? do i redo another claim now, or do i wait unitl there is a judgement or do i add the charges on to the existing small claims?

you will have to start another claim,as you cannot add charges on once it has been filed.

just wondering what happens now really.

i have not really kept up to date with whats been going on with bank claims.

i have a couple of stayed claims at court, have we any news now of what happens next?

is it worth claiming again on charges that have coem through?

just another thought what would be an effective arguement to be used in the appeal of getting the refund of charges, i read if you are under financial hardship? is there a criteria for this?

 

any help would be greatly appreciated.

The Test case is still on going, it is now in the hands of the House of Lords

at the moment.

If you have more charges then yes put in a claim

i have got the preliimnary letter together just trying to figure the total sum of charges over the 18 months. do you know where i could get hold of the tax excel sheet?

I think like many others im confused now the stay has been lifted do i now send the following letter:

 

To: District Judge [name], [court] County Court.

 

Dear Sir/Madam

 

I refer to my claim number [number] for the refund of bank charges dated [date issued], which was stayed on [date stayed].

 

I understand that the Judicial Press Office has advised Claimants to write and request a lifting of their stayed claim.

 

As my claim for Bank Charges is brought under Regulation 5 of the Unfair Terms in Consumer Contracts Regulations 1999, and is therefore not affected by the recent Supreme Court Judgement, in fact the Supreme Court has indicated that a challenge to "fairness" of my Banking Contract under Regulation 5 may be an appropriate route to take.

 

I therefore request that the stay be lifted, that any necessary directions be given, and that a date be listed for a hearing of my claim.
