    • Yes, it was, but in practice we've found time after time that judges will not rule against PPCs solely on the lack of PP.  They should - but they don't.  We include illegal signage in WSs, but more as a tactic to show the PPC up as spvis rather than in the hope that the judge will act on that one point alone. But sue them for what?  They haven't really done much apart from sending you stupid letters. Breach of GDPR?  It could be argued they knew you had Supremacy of Contact but it's a a long shot. Trespass to your vehicle?  I know someone on the Parking Prankster blog did that but it's one case out of thousands. Surely best to defy them and put the onus on them to sue you.  Make them carry the risk.  And if they finally do - smash them. If you want, I suppose you could have a laugh at the MA's expense.  Tell them about the criminality they have endorsed and give them 24 hours to have your tickets cancelled and have the signs removed - otherwise you will contact the council to start enforcement for breach of planning permission.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I went through the whole process up to the part where I had to take the bank to court - didn't have the cash, so filled in complaint forms regarding the Abbey and Halifax and sent to Financial Ombudsman. I received a letter this week, and the Abbey have now offered £4100 out of £4690. I have to sign a letter saying that it this is in full and final settlement of this claim. I am currently waiting for the outcome of a complaint regarding the Halifax which I sent to them at the same time...

 

I wrote to them in December, so it has taken 2 months for the FO to sort it out.

 

Maybe they have started to do what they said in the Money Programme....:-)

I haven't got the cash yet - I have to sign and return a form by 28th February, but have to wait to get letter - I am in Mallorca and my post was sent to UK..fingers crossed it will arrive today, so I can sign and send back...

Do you want a copy of the letter FOS sent to me, or the complaint form I sent to them?

 

By the way I have now received my other one from the Halifax and they are paying up the full amount.

 

I have signed and sent back the forms the FOS sent, so should have the money paid into my accounts within the next 4 weeks.

Hi

 

Head of FOS on watchdog tonight and suggested that through them people were getting money back. Doubt any 8% though or proper compensation for the banks, IMHO, known disregard for the regulations. They is still charging people for breaches.

Hi Craigam

 

I didn't have the money to take Abbey to court either. My claim is jsut over the 3,000 mark. I visited the FO website and downloaded their form. On that i explained that i'd made a reduced offer without interest but it had been ignored. I included copies of all correspondence sent by Abbey. I have asked the FO to claim for full amount plus interest. I 've had regular letters to let me now where they're at in the process. The claim has been allocated to an investigation officer sos i'm just waiting. Obviously it could be a long wait as more and more people use them..hopefully it will be worth it in the end. I wouldn't mind, but it will only be used to pay off debts, but at least i could sleep peacefully hey?.
