  1. Do you want a copy of the letter FOS sent to me, or the complaint form I sent to them? By the way I have now received my other one from the Halifax and they are paying up the full amount. I have signed and sent back the forms the FOS sent, so should have the money paid into my accounts within the next 4 weeks.
  2. I haven't got the cash yet - I have to sign and return a form by 28th February, but have to wait to get letter - I am in Mallorca and my post was sent to UK..fingers crossed it will arrive today, so I can sign and send back...

I went through the whole process up to the part where I had to take the bank to court - didn't have the cash, so filled in complaint forms regarding the Abbey and Halifax and sent to Financial Ombudsman. I received a letter this week, and the Abbey have now offered £4100 out of £4690. I have to sign a letter saying that it this is in full and final settlement of this claim. I am currently waiting for the outcome of a complaint regarding the Halifax which I sent to them at the same time... I wrote to them in December, so it has taken 2 months for the FO to sort it out. Maybe they have started to do what they said in the Money Programme....

Well, as I'm at the stage where I can go to court if I wish, I thought i'd see whether the FO was all talk, or would actually do anything, so I've filled in two complaint forms for Abbey £4690 and Halifax £2105 (offer of £564 received but I rejected it) and to see if he does anything. I've sent it FAO Walter Merricks, so watch this space.... If this requires a new thread please do what you need to do - pretty new at this....

  7. Tonight's programme was music to my ears, as I'm about to file my claim at court with 2 of the banks. Just as a matter of interest has anyone tried writing to the financial ombudsman and had any success...
  8. I am waiting for a reply from Kensington Mortgage Co too, so I will let you know what I receive as I have changed address since I had my mortgage with them....
  9. I have charges going back more than 6 years, probably back to around 1996. I am at the stage where I have to complete my money claim for the Abbey and Halifax. Is it worth going to the Ombudsman first? Charges for before 1999 could be around the £500 mark. Any advice on filling in my claim please would be appreciated - i.e one prepared earlier ....I'd like to sopy a successful claim if possible..
  10. I know what the Abbey are like - they have taken £4600 off me in the last six years. To begin with I used my local branch address, and I received my statements with no problems at all. Then I replied to the address on the top of their letters with the rest of them...I have just sent my LBA, so keep going - you will be at that stage soon enough. I have just received an offer from the Halifax - so it's all going to be worth it in the end! Best of luck, Claire
  11. I have now received a reply from Abbey telling me to go through the ombudsman and that they will not pay back any charges. It makes me so mad, as I ended up changing mortgage company, more charges with Halifax whilst trying to get out of debt, and Shabby pushing me further down as far as I can see. I think I have to send my LBA, or can I go straight to Money Claim now seeing as they have replied. Shabby say that I entered a contract and that the charges are just because of the way I conducted my account. If they hadn't charged me excessively I wouldn't have to do this. I ended up selling my house in the end... Grrrrrrr..... Any thoughts anyone? Did aAnyone else get into the same mess as me.... Looking forward to watching Watchdog tonight !!!
  12. Thanks for that. I will send off my Prelim letter requesting the charges and see what happens next, whilst going after the rest of the banks etc. It will keep me busy for a while i think...
  13. I have received all my statements with no problems from the Abbey, and within the 40 days. I have calculated that the charges are £4,690. Do I claim for the £4,690 in the prelim letter and not mention the interest, and then claim the interest at a later stage. Or should I enter two separate claims for the last 6 years... It was quite exciting to see the amount it came to in the end... Just waiting for statements from the Halifax now. Can't wait !!! Abbey £4,690 - 18/08 SAR, Chiggins
  14. Hi All, How far back can I go to reclaim any charges from the Abbey - It must be about £2500 that I can possibly claim back. It goes back to 2003 I think.
