I have to disagree with MitM regarding the effect of informing DVLA and S.88 A diagnosis of sleep apnoea doesn't mean a licence wont be granted, and, indeed, here it was. However, the fact the licence was then later granted can be used to be persuasive that the driver’s belief they met the standard was correct. I’d be asking DVLA Drivers’ Medical Group why they believe S.88 doesn’t apply.

    • think about it, if you don't pay the full amount, what more can they do , default you  they've already registered a default notice by that point.  why have you got to await sale to a DCA.... for what?  
    • I see what you mean. In terms of resuming payments does it matter the amount?  I read that they eventually sell these on eventually anyhow ? But I guess based on what you are saying this is years in the making and I may as well wait for one to be sold on?
    • never said anything like that. read whats been posted from post 1  get your debts issued a default notice by each original creditor, then once thats done, simply resume payments. DCA's were never bought into it as your debts are not sold on. for a couple of months it would not have hurt you and then you'd have been guaranteed the debts not on your file come 6yrs regardless to whatever else happened  in the future.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Question:

 

I had an old account with Abbey National about 2003 and it went into the red a few times along with a £1,000 plus overdraft that I still owe. I have since moved and not received any details about this account from Abbey National and I have never cleared this account.

 

I have noticed that my credit file has this account listed and its now upto over £2300 plus with charges. Can I attempt to claim the charges back from my old account and can I also claim back charges that they have imposed on this account since it was closed?

Start a thread in the Abbey National forum and someone will answer your question properly, but it sounds like you should be able to get money back.

Being realistic about this what should happen is that any charges they have applied to the account should either be cancelled or offset against the overdrawn balance. The net result is likely to be that you owe the bank £1,000 plus legitimate interest on this amount. You are certainly not going to walk away from this with cash in hand.

 

As we always recommend, you would be best off sorting this out with the bank as they will eventually find you and quite possibly sue you.

They know where live but never got it touch with me after the move. I intend to use what ever comes my way anyway to go against what I owe them, but what Im trying to do is get back what the bank had illegally charged thats all.

Hi All,

 

I claimed against Halifax a few months ago and won that, but only now I have found my old Abbey bank statements (2 or 3) and amazed at the charges they placed on me then, this was back in 2002.

 

With all the courts throwing out claims, is it worth me going ahead and having a go at Abbey?

yeah they are striking them out to try and get the banks to go to a higher court to which Shabbey or the others will not turn up to!

 

They are likely to pay out before going to a higher court!

Found the templates after and a letter is ready for posting. I do indeed need the statements because its a no longer used account and its closed, been closed for a few years now so I need statements.

 

The other problem I have is that I have moved address since so I have had to include a copy of an old statement I found but I presume they will ask for further proof who Iam.

Hi,

 

4 years ago I took out a 25 year mortgage under the assumption that I had a early repayment charge of £5,000 stuck to it for the first 3 years of the mortgage.

 

Well after 3 years was up I sold and cleared the mortgage and had a shock to be told the redemption charge was not for 3 years but 5 years.

 

Now, I paid that under duress but I have now found the mortgage application form copy and it was indeed 5 years but my question is this......

 

Concidering I cleared my mortgage 3 years into this 5 year penalty can I not claim back the differance from year 3 to year 5?

Having read through a few threads, i believe it is possible to reclaim charges on accounts which has been closed.

You have nothing to loose by trying. I am currently pursuing the Shabbey for penalty charges appled to my mortgage account, i am sure you can claim against ERP!

suggest you read the sticky in the mortgage forum on claiming erc's because a couple of claims have been lost in court with costs awarded against the claimant - is it really worth it?

I myself have had to pay a large ERC before and wanted to claim it back, but unfortunately there just is not any kind of legal precedent right now for you to challenge the charge.

Obviously do a bit of reading in the mortgage section and then if you decide to go ahead then all the luck in the world mate. Gonna subscribe to ur thread and see how you go.

Hi,

 

I had a joint account with the wife back in 1999 with Abbey and moved house in 2003 and since closed the account. I called Abbey the other day and asked if I could get details of our old account and the lady said they dont hold account details after 7 years.

 

Is this correct?

 

Also, how do I go about claiming from this account concidering I've moved 3 times since but I do have a few old statements available but not all.

 

I estimated that they owe us ££££ figures.
