      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

First thing I would like to say is the site is brilliant. Registered a few days ago and been reading all the things I need to know before I started my journey to get my bank charges back.

One thing that I haven't read or may have missed (more likely) is that the BOS charge £39 for dd charges and then £28 if your account becomes overdrawn due to the dd charge.

Can we claim for the £28 charges as well?

 

And I know BOS may close the account but anyone that has claimed have BOS closed the account?

 

I also have another account with them that it is joint names (the one I will be making claim isn't) would they close that account as well?

Hi and welcome Ida.

Yes you can claim the excess o/d charge and the returned d/d charges.

After being with BOS for about 28 years they have just closed my account and asked me to cut up my Visa card.(nice people). Might have something to do with the £7,000 they are due me !

Trouble is IDA, no one knows. You could be the unlucky one, you might not. If it troubles you, open a new account. You will find it 10 times harder to open one if they close your account.

Hi Folks,

 

Stupid question time!

 

I know it's prob aleady been answer and in th Q&A's but doesn't your head reel trying to take it all in.

 

AS it stands my charges are £735 so in Scotland going go to use small claims court route. I know the limit is £750 but if goes to smalls claims then the interest will take this about the £750 does that matter?

 

And as i Am just about to start my prelim letter - its states in there charges taken xxxx and charges in overdrawft xxxx as i don't have any overdraft charge do i leave that bit out

I believe it's net of interest. Have a look around the forums to confirm but I believe the limit is taken from your claim less the 8% added at court stage.

Well, if this was the case, yes you would....but.......

 

I only have the charges themselves and £28 charges for been overdrawn

The overdraft bit is overdraft interest charged to your account. If you have had charges for being overdrawn you must have been debited interest along the way. This will appear on your statement with the code INT and will be a debit figure.

 

These charges can be added to your first spreadsheet as this interest can be claimed at preliminary stage.

okay thought i would update - was getting ready to print off my prelim letter but me blooming printer is knacked grrrrrrrrrr will need to grab nephew later and get a shot of his!

Jusy got the hubby to check my statements and it takes me above the £750 so can claim through summary clause. Has anyone here went that way? are there any major differences between that and the normal small claims?

and! forgot to ask. I can find links to see if I can get court costs free in england but are they any for Scotland? I get tax credits! mcol is that only for cases in England?

Hi Ida,

 

I've just handed in my first Summary Cause. When you take your papers to the Sheriff Court, you will pay £39.00.They will then send the papers back to you with a Return Date and a Calling Date. You then have to take your papers to a Sheriff Officer's to get them to serve the summons for you, this cost me £15.97. The Court gives you a list of local Sheriff Officers, so it's not to much of a problem.

thanks maroon. SO would you say there's not much difference except getting sheriff officers? so it's still cheaper than making 2 claims!

Hmmm. What bank are you dealing with? And if I need any help will it be okay to pick your brain but with all the links and helpful folk should be relatively calm sailing( i am not going to say easy) and a wee clicky click for you too!

Thanks very much . I also had an account with TSB but couldn't remeber account number but I emailed them and told me to go my local branch where the account was help and they would be able to trace my details no problem and said if I had any problems to send an email by return and they would sort it out. The only thing is I don't know if I had any charges but it's worth a tenner to find out! just ordered cag's labels as waiting on another year of statements.

 

With certain posts it looks like you get your money sooner the smaller the claim! SO don't know whether to make two claims or just the one?

from what i have been readin, in your letter to them, you claim for it all back. only if it gets to the court stage do you then need to split into two cases to get under the £750 mark.

no moogs is right. dont need to split it unless it goes to court.

 

If you can't remember account numbers, I'd expect that most banks won't dislose account information to you if you send them an S.A.R - (Subject Access Request) (funnily enough moogs can vouch for that - read his / her thread). There are few posts that I'm subscribed to where banks are doing just this.

 

The way ppl are getitng round this is doing just what Lloyds have told u to do - by going to a branch (don't mention bank charges) saying you are trying to locate your account number. Give them address details and rough dates of opening / closing your account and they should give it to you.

Okay well recevied the remainder of my statements. Total £1053.......lovely. Have printed out prelim and schedule of charges , sealed in envelope and will be posted tomorrow!!!!!!!!

Hi there have sent my LBA sent it on Sat should have received it either yesterday or defo today phoned phone banking twice b4 this and was "assured that someone is obliged to call you back by 2.30 next day" no phone call not very good 4 customer relations was told b4 sent letter that BOS works to an 8 week policy of handling claims which is up on the 8th Feb meanwhile charges firing out of my a/c rapidly waiting 4 phonecall bricking it a bit! My charges come to over £5,000
