      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

holiday in Majorca already booked!! i decided to decorate and have a holiday so lowered my sights slightly lol.

 

i have two alternate bank accounts opened, i actually have not used A&L for over 12 months as i was so angry about the charges they were making - dont know why i never closed the account - but it does not matter to me at all what they do!!

 

i keep giggling like a school kid !!! i am making a copy of the cheque before i send it off for banking!

Fantastic news Julie.......now you can chase the other 100 quid,small change compared to this result but you have the confidence and knowledge now .....

and of course a hundred quid is more spending money for the holiday !!

Well done Julie, it's always good to see a happy outcome. It gives hope to all newbies, and those in the middle of the process who can't yet see the light at the end of the tunnel.

If they are in the middle of their own horror story it's difficult to be optimistic. Hopefully this can help them take heart. :cool:

like many have said, its the banks job to make it as difficult as possible, at the start i wasnt sure i would see it through!! so take heed folks!! its worth it, just chill between letters and stick to your time scales, use the lettes on here and you will not have any problems!!

I had something similar, now they have just told me they will close my account in five weeks.

Hiya - am new in the forum. Have had such awful dealings with Aand L too. Rang to ask for details of all bank charges over the last 6 years and they have sent throu the £10 standard data protection letter. Once I return this, will they send me all the dates and amount of charges applied or will I be told to apply for back bank statements too and have to work it all out myself? (Knowing THEM - I can't imagine them being so helpful! ) Am so sure some of their staff take courses in rudeness technicques. Which link or template letter would it be best to use when they reply to the data protection request? Sorry for probably asking the obvious - but I just what to get it right first time. Many thanks and best w ishes. Cathy X

hi Julia, no word as yet about account closure - have had final court papers through and dealt with those saying all settled.

I dont use the A&L account so it will make no differance if they do, i have two accounts with other banks now, first direct that i opened last year, and i have just opened a smile acount for back up.

Welcome CAthy, there is a FAQ section where you will find a step by step instruction, read this through several times (i did read it most days to digest it all)

make yourself some notes that apply in your particular case, i made a spreadsheet with dates of action i took i.e. posted a letter/made a call to the bank - and the date i needed to act by.

 

When i was taking my action i never contacted the bank by telephone or email etc, i just sent the letters in on the dates due - filed the reply in my bulging folder and waited for time to pass,

 

when your statements arrive, you have the wonderful labourious task of going through the statements to highlight charges -

1-arm yourself with a pot of tea or coffee,

2- get a highlighter pen, sticky notes and a folder to file it all in

3- enter all the information into the spreadsheet that was kindly put on the site and this works out the information for you.

4- cut and paste all the letters off the forum your going to need to see your case through, this saves having to find the correct forum page each time, and allows you to prepare yourself for the next stage.

We are both at exactly the same stage with A&L - I requested 6 years of statements yesterday - will be keeping a close eye on your thread (I take it you have started your own) to see if our treatment by A&L differs in any way. Make sure that you have another bank account opened up as it seems that, in some cases, A&L threaten account closure at a really early stage in the proceedings. Best of luck to both of us in getting back what is rightly ours (about £5000 by my estimates).

just a quick update, recieved today the letter stating they are going to close my account 25th August, no loss, i havent used it for over a year, so i will go take the fiver out and by a bottle of wine to toast there health!!!

i have posted a request for help on anohter thread and not got a reply so i will try here,

 

i need a letter in reply to a non compliance of data protection request that gives more than the standard reply in the library - i know theres one on a thread somewhere!! if anyone can point me in the right direction i would be grateful.

Hi all

Another newbie joining the ranks of A&L disatisfied customers.

 

I have this morning recieved copies of statements and charges requested on 7th April, so just 20 days for this to be complied with, i didnt think this was to bad!

The £10 that i sent along with the request is now sitting in my account.

 

My claim is spanning over the last six years, i have just made initial notes and totals but so far the amount is 679.00 this is made up of:

 

monthly overdrawn charges 419.00

 

paid item charges 260.00

 

if someone could just clarify it is all these charges we are claming or not? i have read and re read a lot of the forums - but find the amount of information so vast my head spins with it all!!

i find it interesting(!) that these charges when applied nearly always were the reason for the acount going over drawn on subsequent occations - so just one small blip results in an ever cascading flow of charges - no wonder the banks are running.

I have my parachute ready and with the support of this group will take it all the way.

 

IM ALSO NEW TO THIS BUT HAVE BEEN WATCHING WITH INTEREST 4 A WHILE, I SENT MY LETTER REQUESTING STATEMENTS TO A&L 33 DAYS AGO AND HAVENT RECIEVED EVEN AN AKNOWLEDGMENT AS YET! ALTHOUGH THE 1ST ONE I SENT IN WHICH I 4GOT TO ENCLOSE THE £10 PROMPTED A SUPER FAST REPLY. ANYONE KNOW THEIR AVERAGE TIME TO RESPOND??

Im Also New To This But Have Been Watching With Interest 4 A While, I Sent My Letter Requesting Statements To A&l 33 Days Ago And Havent Recieved Even An Aknowledgment As Yet! Although The 1st One I Sent In Which I 4got To Enclose The £10 Prompted A Super Fast Reply. Anyone Know Their Average Time To Respond??
