Hi all,

 

I recieved a letter from a DCA stating that they had, had to employ a tracing service to find me with regards to ant outstanding debt with RBS, now i am going to request the original agreement if i am right in thinking that is what i want.

 

Can anyone just tell me which letter i need and is a SAR or CCA that i am sending. I am all confused.

It is a CCA request that you send in to them. You need to send in a £1 postal order as well with it to cover costs.

Thanks for that it is much appriciated. Just out of interest if i send this and they are unable to supply me with a copy am i still able to go after the penatly charges as from what i understand of all this if they are unable to supply the CCA within 12 days the debt does not have to be paid till they can provide one and they have to do this within 6 years. Ids this correct

The CCA goes to the DCA as long as they have bought the debt. If the DCA have not bought the debt, the CCA letter goes to the original creditor. I am assuming mean the penalty charges imposed by RBS? You can still claim these, RBS took them and RBS can pay them back!!

You can find out by contacting the original creditor. If you send them a SAR then they should send you any info held in your name. You can still CCA the DCA however just to be on the safe side.
